Nonsubstantial Amendment to the Land Use Plan and the Final Subdivision Plan
Ordinance# 2002-05
ISSUE:
Should the Mayor and City Commissioners adopt Ordinance #2002-05, approving the proposed
amendment to the Land Use Plan and the Final Subdivision Plan for Olympia PUD? The Code
requires that an amendment to an approved PUD Land Use Plan be done by Ordinance.
BACKGROUND:
The Olympia PUD is a 37.8 acre multi-use development which was approved in 1999. The
subdivision included six commercial lots, a public library and an elementary school. The project
is located at the southeast corner of Silver Star Road and Clarke Road. Two of the commercial
lots as well as the library and the elementary school have been developed. Two additional
commercial site plans are currently under review for lots in this subdivision.
DISCUSSION:
The proposed amendment to the Land Use Plan and the Final Subdivision Plan for Olympia
PUD will re-subdivide two of the commercial lots facing Clarke Road into three commercial lots.
Each of the new lots will still be one acre or more in size— the minimum commercial lot size
required by the Code. A traffic analysis was done by the developer to evaluate the impact of the
additional lot on the transportation concurrency reservation obtained with the approval of the
original subdivision. The City's traffic consultant (Renaissance Planning Group) has reviewed
the traffic study and confirmed that the proposed development changes will not negatively
impact the projects approved transportation concurrency reservation.
A new plat reflecting the re-subdivision of these two lots into three lots will be presented o the
City Commission on the same agenda as the second reading of the Ordin ce, c rrently
scheduled for March 5, 2002.

The proposed amendment to the Land Use Plan and the Final Subdivision Plan for the Olympia
PUD was reviewed by the Development Review Committee (DRC) on February 8, 2002. The
Committee voted unanimously to determine that the proposed amendment is a nonsubstantial
amendment to the PUD Land Use Plan. If it had been determined to be a substantial
amendment, then public hearings would have been required. The Committee also voted
unanimously to recommend approval of the proposed amendment, subject to resolving one
minor issue from the Utilities / Engineering Department. That minor issue from the DRC has
now been satisfactorily addressed on the current set of Plans.
STAFF RECOMMENDATION:
Based on the finding of the DRC that this constitutes a nonsubstantial amendment to the PUD
Land Use Plan and the recommendation of the DRC for approval, Staff respectfully recommends
that the Mayor and City Commission adopt Ordinance # 2002-05, approving the proposed
amendment to the Land Use Plan and the Final Subdivision Plan for Olympia PUD, as date
stamped received by the City on February 12, 2002.

AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA
APPROVING A NONSUBSTANTIAL AMENDMENT TO
THE LAND USE PLAN FOR THE OLYMPIA PUD ON
CERTAIN REAL PROPERTY LOCATED AT THE
SOUTHEAST CORNER OF THE INTERSECTION OF
SILVER STAR ROAD AND CLARICE ROAD AS
PETITIONED BY THE PROPERTY OWNER; AMENDING
THE OLYMPIA PUD LAND USE PLAN TO INCREASE THE
NUMBER OF APPROVED LOTS; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the owner of certain real property located within the corporate limits
of the City of Ocoee, Florida, as described in the Exhibit "A" has petitioned the City
Commission of the City of Ocoee, Florida (the "Ocoee City Commission") to approve an
amendment (the "Amendment") to the Olympia PUD Land Use Plan, as approved by the Ocoee
City Commission on April 6, 1999 (the "Land Use Plan");
WHEREAS, the Amendment was scheduled for study and recommendation and
was reviewed by the Development Review Committee("DRC") on February 8, 2002;
WHEREAS, the DRC found that the Amendment constitutes a nonsubstantial
amendment to the Land Use Plan and approved said Amendment;
WHEREAS, the Ocoee City Commission held a de novo public hearing with
public notice thereof with respect to the proposed Amendment and this Ordinance on March 5,
2002;
WHEREAS, the Ocoee City Commission considered this Ordinance in
accordance with the procedures set forth in Section 166.041(3), Florida Statutes, and determined
that this Ordinance is consistent with the Ocoee Comprehensive Plan.

NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. Authority. The City Commission of the City of Ocoee has the
authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of
Florida and Chapter 166, Florida Statutes.
SECTION 2. Amendment to the Land Use Plan. The Land Use Plan is
hereby amended to decrease the size of commercial Lot 2 from 2.00 acres to 1.40 acres and
subdivide Lot 1 into two lots (Lot 1A and 1B). The Amended Land Use Plan, which is attached
hereto as Exhibit "B" and by this reference incorporated herein, is hereby approved, subject to
the Conditions of Approval set forth in Section 3 below. Said Amended Land Use Plan
supercedes and replaces the previously approved land use plan for the Olympia PUD. All
references to the Land Use Plan or the Amended Land Use Plan for the Olympia PUD shall
hereafter refer to the aforementioned Amended Land Use Plan.
SECTION 3. Conditions of Approval. The property described in
Exhibit "A" hereto shall be developed in accordance with and subject to the Conditions of
Approval set forth in the Amended Land Use Plan. Notwithstanding anything herein to the
contrary, in the event of any conflict between the Amended Land Use Plan referenced in Section
2 above and the Conditions of Approval, the Conditions of Approval shall control.
SECTION 4. Ocoee Comprehensive Plan. The Ocoee City Commission
hereby finds that this Ordinance is consistent with the Ocoee Comprehensive Plan.
SECTION 5. Effective Date. This Ordinance shall become effective
immediately upon passage and adoption.

TESTING AND INSPECTION REQUIREMENTS

CONTRACTOR TO NOTIFY THE ENGINEER 48 HOURS IN ADVANCE TO SCHEDULE
INSPECTION.
2. THE CONTRACTOR SHALL MAINTAIN THE STORM DRAINAGE SYSTEMS UNTIL FINAL
ACCEPTANCE OF THE PROJECT, THE STORM SYSTEM WILL BE REVIEWED BY THE OWNER'S
ENGINEER PRIOR TO APPROVAL FOR CERTIFICATE OF OCCUPANCY PURPOSES.
SAFETY NOTES
1. DURING THE CONSTRUCTION AND/OR MAINTENANCE OF THIS PROJECT, ALL SAFETY
REGULATIONS ARE TO BE ENFORCED. THE CONTRACTOR OR HIS REPRESENTATIVE SHALL
BE RESPONSIBLE FOR THE CONTROL AND SAFETY OF THE TRAVELING PUBLIC AND THE

CONDITIONS OF. APPROVAL
1. The Developer shall dedicate to the City, of Ocoee; an additional 22.0 feet of
right-of-way. along. Clarke Road and contiguous to the. western boundary of the Property.
This right-of-way dedication willbe by deed to be recorded in accordance with the terms
of the Developers Agreement. The Owner of the adjacent Lot shall maintain the
right -.of -way prior to development. No .person or entity shall be entitled to any impact fee
credits or the other compensation for or on account of the conveyance.
2: The Developer shall dedicate to the City of Ocoee, an additional 25.0 feet of
right-of=way along Silver Star Road and contiguous to the northern boundary of the
Property. This right-of-way dedication will be by deed to be recorded in accordance with
the terms of the Developer's Agreement. The Owner of the adjacent Lot shall maintain the
right-of-way prior to development. No person or entity shall be entitled to any impact fee
credits or the other compensation for or on account of the conveyance.
3. Access Improvernents on Silver Road will be constructed in conjunction with the initial
subdivision improvements and include the right turning lane and directional left turning lane
as shown on the plans.
4. Cross access, utility, and stormwater easements will be provided as part of the plat
across all PUD lots.
5. Parking for individual lots shall be provided in accordance with City of Ocoee Land
Development Code.
6. The public school/residential site shall be developed in accordance with R-1AA zoning
Code if developed with a residential use.
7. The City is subject to the terms, provisions and restrictions of F.S. chapter 163
concerning moratoria on issuance of building permits under certain circumstances. The City
has no lawful authority to exempt any private entity or itself from the application of such
state legislation and nothing herein shall be construed as such an exemption.
8: The developer intends that all internal streets will be private streets which shall be.
maintained by the property owners' association, with access granted to the City of Ocoee
for emergency and maintenance personnel. This emergency easement will also be noted on
any plats. .The appropriate access and utility easements shall be granted to the City over
all private roadways.
9. All lots with uses other than public uses will be subject topreliminary and final
concurrency review. Lots with public uses will be considered in any evaluation of the
adequacy or availability of public facilities, infrastructure, and services necessary to serve
the lots with private uses.
10. Impact fees for this PUD will be calculated in accordance with City ordinances as from
time to time " amended,
11. The uses permitted within the commercial portion of the PUD, consisting of Lots 1A, 1B
through 6, shall be those uses listed under C-2 Zoning District, Table 5-1, Use
Regulations, of the Ocoee Land' Development Code, as it may be from time to time
amended. Any uses under the C-2 Zoning District which require a Special Exception shall
o1so; require a. Special Exception under the PUD, except for Child Care Facilities, which is an
approved use under this PUD for Lots M 1B-6, and Automobile Service Stations and
Convenience Cormnercial with. Gas Sales (including those with a Car Wash), which are
approved . uses under this PUD for Lots 1A, 1B and 2. Lot 7 isapproved for use as a
Library. Lot 8, is approved for use as a School or, alternatively, for those uses listed under

21. Tract D will be conveyed to the City of Ocoee by warranty deed in form and
substance acceptable to the City free and clear of all liens and encumbrances at
the time of platting. The pump station shall be owned and maintained by the City

22, As required by Section 4-5(B)(5) of the City of Ocoee Land Development Code,
the Developer shall enter into a Developers Agreement incorporating all pions and
Conditions of .Approval by reference. As used herein, the term "Developers

First Union Notional Bank, as Trustee, contemporaneously with approval of .the PUD.
