Should the Mayor and City Commissioners approve the Preliminary Site Plan for Kane's Furniture at
Ocoee?
BACKGROUND:
The Kane's Furniture site occupies Lot 5 of the Heavener Subdivision, previously discussed, and
contains 3.6 acres. The site is located on the north side of the SR 50, just west of its intersection with
Clarke Road. The property has frontage on SR 50 and access from the subdivision's internal road.
The parcel known as the Ozanian Property lies just east of the site,on the other side of the internal
road. The subject property is currently undeveloped with a large number of trees on the site. The
property has C-2 zoning and the surrounding property has P-S zoning (east — vacant land [Ozanian
Property]), and C-2 zoning (north — vacant land; west — wetlands).
DISCUSSION:
As indicated in our report on the Heavener Subdivision, a unique feature of this subdivision is that it
will include some filling of an area below the 100 year flood elevation along the western portion of
the site. That filling will occur in the southern and western portions of Lot 5, the lot upon which the
Kane's Furniture store will be built. The required compensating storage volume for that filling will be
provided off -site with the subdivision improvements by constructing a new retention pond on the
adjacent property to the north. Because of the fill that will be needed for this site, a retaining wall will
be constructed along most of the southern and western edges of the lot. The foundatiorof building
itself will function as a portion of that retaining wall.
At the rear of the site, a retention pond will be constructed along with the subdivision improvements
which will provide stormwater treatment for a portion of the internal road and for Lot 5. Due to site
constraints, that retention pond will have essentially vertical sides constructed with decorative blocks,
like the ponds constructed with the West Oaks Town Center at the northeast corner of SR 50 and
Clarke Road. Because of the steep sides on the pond, there will be a decorative fence and
landscaping along the rim of the pond.

This Preliminary Site Plan includes two proposed waivers, one related to the building setback on
the west side and the other related to the parking requirement. The building setback waiver is
requested because of site specific issues — the western property line is adjacent to a wetland
area, which will be dedicated to the City as a conservation area. The parking requirement
waiver is requested because the developer feels that the very low parking demand of a furniture
store does not justify building so many parking spaces that will never be used. Both of these
proposed waivers are supported by Staff.
Declaration of Restrictive Covenant:
Based on the size of the proposed building, the Code would require that a minimum of 360
parking spaces be provided on the site. However, the applicant has demonstrated that 360
spaces are not needed for this type of furniture store. The applicant has proposed to include 77
parking spaces (at least 4 of which will be handicap spaces). Based on the analysis provided by
the applicant, 77 spaces should be adequate for this building, as long as the use remains a
furniture store.
Consistent with the requested waiver, the applicant will execute a Declaration of Restrictive
Covenant which will be executed and recorded in the Public Records prior to construction and
which would restrict the property from being used for anything except a furniture store. This use
restriction would expire upon the earlier of: 1) fifty (50) years from the date of the Declaration; 2)
the date the building is demolished or removed; or 3) additional parking is provided to meet the
then existing Code requirements.
Development Review Committee Discussion:
The Preliminary Site Plan for Kane's Furniture at Ocoee was reviewed by the Development
Review Committee (DRC) on November 20, 2001. There was discussion during the DRC
meeting about a variety of outstanding issues which were identified in a DRC staff report and an
additional memo from the Assistant City Attorney. The concerns of Staff were explained and the
Applicant agreed to comply with Staff recommendations. The Committee voted unanimously to
recommend approval of the Preliminary Site Plan, subject to the changes outlined in the staff
report, the City Attorney's comments and the discussion in the meeting. All of the changes
requested have now been satisfactorily addressed in the plans received November 28, 2001.
PLANNING & ZONING COMMISSION RECOMMENDATION:
On December 11, 2001, the Planning and Zoning Commission held a public hearing to consider
the Preliminary Site Plan for Kane's Furniture at Ocoee. The applicant spoke in favor of the
Plan, but there was no other input from the public. There was discussion on issues including
tree preservation, the parking waiver and the appearance of the building. When the discussion
was finished, the Planning and Zoning Commission voted unanimously to recommend approval
of the Preliminary Site Plan, in accordance with the Staff recommendation.

STAFF RECOMMENDATION:
Based upon the recommendations of the DRC and the Planning and Zoning Commission, Staff
respectfully recommends that the Mayor and City Commission approve the Preliminary
Site Plan for Kane's Furniture at Ocoee, as date stamped received by the City on
November 28, 2001, including the two proposed waivers,and subject to execution of the
Declaration of Restrictive Covenant.

STANDARD SPECIFICATION: POLYETHYLENE DRAINAGE
PIPE MATERIAL
1. HDPE PIPE MATERIALS
E Pipe Sizes: 12 inches through 36 inches nominal
diameter:
Type "S" smooth interior pipe in conformance with
AASHTO M294. Note: Corrugations shall be
annular configuration only.
Pipe Sizes: 42 and 48 inches nominal diameter:
Type "D" smooth interior, smooth exterior
pipe in conformance with AASHTO MP6-95 Type "D"
Pipe Joints: The joint system to be used will be
integral bell and spigot with a gasket on the
spigot end of the pipe over the first corrugation for
deepest penetration into the bell and highest
performance. The bell should span over two
full corrugations at minimum. The
gasket material to be used should meet ASTM
F-477 and be covered with a protective wrap to
prevent damage prior to installation.
Resins: Extruded pipe and blow molded fittings
- Extruded pipe and blow molded fittings shall
be made of virgin PE compounds which conform
with the requirements of cell class 335420C
as defined and described in ASTM D3350,
except that the carbon black content shall
not exceed 5 percent. Compounds
that have higher cell clossificotions in one or
more properties are acceptable provided
product requirements are met.
2. SUBMITTALS:
For all HDPE pipe and joint products and
materials, contractor must submit
the manufacturer's certificate of material
conformance with these specifications.
3. PIPE INSTALLATION:
A. Installation shall be in accordance with ASTM
D2321 and manufacturer's recommendations_
Where applicable, Contractor shall adhere to
more stringent requirements
within these specifications.
B. Minimum Pipe Cover: Provide a minimum of
12" of cover over pipe in non -traffic applications and in
H-20 applications. Allowable minimum cover is
measured from top of pipe to
bottom of flexible pavement or top of pipe to
top of rigid pavement. Minimum cover in unpaved areas
must be maintained.
***Both cover requirements are measured from
the finished grade.
C. Excavation: Backfill and compaction shall
conform with applicable
Local and State specifications.
4. REFERENCES: The latest revisions of the
following standards are applicable as noted herein:
AASHTO M294: Standard Specification for
Corrugated Polyethylene Pipe
12 to 36 inch diameter. Note: Corrugations
may be annular configuration only.

GENERAL NOTES
1. CONTRACTOR AGREES THAT IN ACCORDANCE WITH GENERALLY

6. THE CONTRACTOR SHALL CONFINE HIS ACTIVITIES TO THE PROJECT
SITE UNDER DEVELOPMENT OR THE EXISTING RIGHT-OF-WAYS,
CONSTRUCTION AND PERMANENT EASEMENTS AND SHALL NOT TRESPASS
UPON OTHER PRIVATE PROPERTY WITHOUT THE CONSENT OF THE
OWNER.
7. ALL WORK SHALL BE DONE IN ACCORDANCE WITH THE APPLICABLE
CODES, ORDINANCES AND STANDARDS SPECIFICATIONS OF ALL AGENCIES
THAT HAVE THE RESPONSIBILITY OF REVIEWING PLANS AND
SPECIFICATIONS FOR CONSTRUCTION OF ALL ITEMS PER THESE PLANS
AND SPECIFICATION IN THIS LOCALITY.
8. THE CONTRACTOR SHALL OBTAIN ALL THE NECESSARY PERMITS AS
REQUIRED FOR CONSTRUCTION OF THIS PROJECT.
9. THE CONTRACTOR SHALL DISPOSE OF ALL SURPLUS EXCAVATION OR
PROVIDE ALL SUITABLE FILL MATERIAL AS APPROVED BY THE SOILS
ENGINEER. THE COST SHALL BE INCLUDED IN THE PRICE BID FOR THE
RELATED ITEMS.
10. EROSION AND SEDIMENT CONTROL SHALL BE PROVIDED IN
ACCORDANCE WITH LOCAL AND / OR STATE REQUIREMENTS. PROTECTIVE
MEASURES SHALL BE TAKEN BY THE CONTRACTOR TO PROTECT
ADJACENT PROPERTY AT ALL TIMES DURING CONSTRUCTION. THE
CONTRACTOR SHALL TAKE PROTECTIVE MEASURES SO AS NOT TO
CAUSE ANY MUD, SILT OR DEBRIS ON PUBLIC PROPERTY SHALL BE
REMOVED IMMEDIATELY.
11. ALL WORK SHALL BE GUARANTEED BY THE CONTRACTOR TO BE
FREE FROM DEFECTS IN WORKMANSHIP AND MATERIALS AND IN
CONFORMANCE WITH THE APPROVED PLANS AND SPECIFICATIONS FOR A
PERIOD SPECIFIED BY THE LOCAL MUNICIPALITY (MINIMUM OF ONE YEAR)
FROM THE DATE OF WRITTEN ACCEPTANCE FROM THE OWNER OF THAT
PORTION OF THE TOTAL PROJECT WHICH THE CONTRACTOR HAS
CONTRACTED TO COMPLETE. THE CONTRACTOR SHALL REPLACE OR
REPAIR ANY WORK OR MATERIAL FOUND TO BE DEFECTIVE UPON
WRITTEN NOTICE FROM EITHER THE DESIGN ENGINEER OR THE
MUNICIPALITY ENGINEER.
12. CONTRACTOR TO VERIFY THAT THE PLANS AND SPECIFICATIONS
THAT HE IS BUILDING FROM ARE THE VERY LATEST PLANS AND
SPECIFICATIONS AND FURTHER, TO VERIFY THAT THESE PLANS AND
SPECIFICATIONS HAVE BEEN APPROVED BY ALL APPLICABLE
PERMIT -ISSUING AGENCIES AND THE OWNER. ALL ITEMS CONSTRUCTED
BY THE CONTRACTOR PRIOR TO RECEIVING THE FINAL APPROVAL AND
PERMITS, HAVING TO BE ADJUSTED OR RE -DONE, SHALL BE DONE AT
THE CONTRACTOR'S EXPENSE.
13. SHOULD THE CONTRACTOR ENCOUNTER CONFLICT BETWEEN THESE
PLANS AND THE SPECIFICATIONS, EITHER AMONG THEMSELVES OR WITH
THE REQUIREMENTS OF ANY AND ALL REVIEWING AND PERMIT -REISSUING
AGENCIES, HE SHALL SEEK CLARIFICATION IN WRITING FROM THE DESIGN
ENGINEER BEFORE COMMENCEMENT OF CONSTRUCTION. FAILURE TO DO
SO SHALL BE AT SOLE EXPENSE TO THE CONTRACTOR.
14. THE CONTRACTOR IS REQUIRED TO TAKE DUE PRECAUTIONARY
MEASURES TO PROTECT THE EXISTING UTILITIES OR STRUCTURES AT THE
SITE. IT SHALL BE THE CONTRACTOR'S RESPONSIBILITY TO NOTIFY THE
OWNERS OF UTILITIES OR STRUCTURES CONCERNED BEFORE STARTING
WORK.. THE CONTRACTOR SHALL NOTIFY THE PROPER UTILITY
IMMEDIATELY UPON BREAKAGE OR DAMAGE TO ANY UTILITY LINE OR
APPURTENANCES OR THE INTERRUPTION OF THEIR SERVICE. IF EXISTING
UTILITY LINES ARE ENCOUNTERED THAT CONFLICT IN LOCATION WITH
NEW CONSTRUCTION, THE CONTRACTOR SHALL NOTIFY THE DESIGN
ENGINEER SO THAT THE CONFLICT MAY BE RESOLVED.
15. UNLESS NOTED OTHERWISE, ALL DIMENSIONS ARE TO FACE OF CURB.
16. THE LOCATION OF UNDERGROUND FACILITIES OR STRUCTURES SHOWN
ARE BASED UPON AVAILABLE RECORDS AT THE TIME THE PLANS WERE

30. THE CONTRACTOR SHALL MAINTAIN ONE CLEAN SET OF MARKED
