ISSUE:
Should the Mayor and Commissioners acquire a 20 +/- acre park site adjoining a future
elementary school site?
BACKGROUND:
Last year the City submitted a proposal for a Florida Communities Trust Grant to fund
the acquisition of a 35 +/- acre park site at the subject location adjoining the West
Orange Trail. This proposal was based upon the developer contributing the minimum
required City share of the purchase amount (25%) in the form of a discounted sales
price on the land. This proposed grant was not ranked highly enough against the many
other proposals submitted from around the State, and the City was not allocated any
State funds to acquire the parcel.
Part of the reason for seeking to secure this park site had to do with its excellent central
location within the expanding north end of the City. It was also due, however, to its
location in proximity to a proposed elementary school site which was to be set aside by
the developer of the adjoining property to the east. Since last year, the developer
deleted this school site from his plan, and an alternate location was sought to replace it.
Knowing that the Pineloch Property was still available, the Planning Director set up a
meeting with Jon Martin of the Orange County Public Schools (OCPS) staff and Richard
Gonzales of Pineloch Management Corporation to discuss acquisition of a portion of
their property for the elementary school site.

DISCUSSION:
After researching the location and physical attributes of the proposed site, Orange
County Public Schools staff determined that the northern 15 +/- acres of the site would
be very suitable for an elementary school site. While the OCPS staff believes that this
site could stand alone, the potential joint acquisition of an adjoining City park would be
an important consideration as part of the final determination to be made by the School
Board regarding the school site acquisition.
Based upon the School Board's interest in the acquisition, PMC has made a proposal to
sell the land to Orange County Public Schools contingent on the City acquiring the
remainder of the property. The attached letter from Richard Gonzales (February 25,
2002) outlines the terms for acquisition of the property. In general, Orange County Public
Schools would pay cash for their part of the property this year, but the City would pay
for their portion over a 4 year period beginning in 2004. It is estimated that these annual
payments would be in the $175,000 - $200,000 range, based upon the final approved
value of the property. It is important to note, that the sale is contingent upon a
simultaneous closing by both OCPS and the City. PMC is not interested in just selling
the northern portion of the property for the school site.
The acquisition of this school / park combination is similar to the deal that was worked
out on South Park. OCPS would pay for 15 acres of the site, but give back 1-2 acres to
the City if stormwater could be held in a master stormwater pond on City property. The
City could also make use of the recreational facilities on the school site after regular
school hours and on weekends. Both the school and park are consistent with the
Comprehensive Plan which identifies the need for both facilities in this growing area of
the community.
It should be noted that this park site is suitable for lower intensity forms of recreation
such as picnicking, nature walks, bicycling, tot lots, and neighborhood play areas. The
site is heavily wooded and contains a low-lying pond area as well as a conservation
area. It is well suited as a possible location for a trailhead, and its acquisition could open
opportunities with the Orange County Parks Department to work on joint recreational
uses related to the West Orange Trail as well as further open space acquisition in the
area.
Even though this proposed acquisition offers an opportunity to purchase needed school
sites and park land from a willing seller at favorable terms, the financial implications
need to be identified to put the project into context. According to the City Finance
Director, the acquisition of the park would need to be funded out of general revenue.
Park Impact Fees being generated by new growth in this area are committed to paying
down debt service for such items as the Beech Center and Swimming Pool.

Despite the fact that the City will apply again this year for a Florida Communities Trust
grant, there is no guarantee that we will be successful. Additionally, this proposal is for
acquisition only. Funds will still need to be secured for the actual construction of
facilities, and the City would be required to take over the developer obligation to pave
the initial extension of Clarke Road north of Clarcona-Ocoee Road when the Elementary
School is constructed. For the short term, however, it may be possible for the City to
utilize the vacant school site for some practice fields, although some re-grading of the
site would still need to be accomplished to permit this. Also, the City would retain
ownership of a 1+ acre parcel at the northwest corner of Clarcona-Ocoee Road and
Clarke Road which could possibly be sold in the future for a higher-intensity use to help
defray park development costs.
STAFF RECOMMENDATION:
The acquisition of park property is a policy decision for the Mayor and City
Commissioners to make, although the Planning Department believes the possible
acquisition of this site for a combined school and park site is timely and should be
seriously considered given the development pressures in this area.
