SUBJECT: Plat for Brookestone Unit 3 !/
Brookestone Unit 3 is a 92 lot single-family subdivision located west of Maguire Road,
south of the Florida Turnpike. All required documentation pertaining to the proposed
plat has been reviewed and approved by City Staff.
A performance bond is on file to cover the cost of site improvements uncompleted at
the time of plat approval. At this point, there is a very limited punch list, and most of
the improvements have been completed.
A maintenance bond has been provided to guarantee the workmanship of the
improvements that will be maintained by the City.
I recommend that the City Commission authorize the Mayor and City Clerk to execute
the plat of Brookestone Unit.

DESCRIPTION.
That part of Section 30, Township 22 South, Range 28 East, Orange County,
Florida, described as follows:
BEGIN at the Westernmost corner of Tract "K". BROOKESTONE UNIT 1,
according to the plat thereof, as recorded in Plat Book 43, Pages 47 through 49, of
the Public Records of Orange County, Florida, thence run S 495527" E along the
Westerly line of said Tract "K" and the Westerly line of Tract "L" of said

South 774.40 feet of the Southeast 114 of said Section 30; thence run

NOTES:
- Bearings based on the Westerly line of Tract "K" BROOKESTONE UNIT 1,
being S 49 5527" E (per plat).
NOTICE. This plat, as recorded in its graphic form, is the
official depiction of the subdivided lands described herein and
will in no circumstances be supplanted in authority by any
other graphic or digital form of the plat. There may be
additional restrictions that are not recorded on this plat that
may be found in the public records of this county.
- All lines are radial to curves unless otherwise noted as non radial (NR).
- A 10.00 foot wide utility and drainage easement is reserved within each lot
adjacent to all right-of-way lines.
- A 5.00 foot wide utility and drainage easement is reserved within each lot
adjacent to all side lot lines except those side lot lines also being right-of-way
lines.
- A 5.00 foot wide drainage easement is reserved within each lot adjacent to all
rear lot lines.
- The surface area encumbered by all utility and drainage easements lying
within any individual lot shall be maintained by the owner of that lot.
- Vehicular access rights to Lots and Tracts abutting Windermere Road are
dedicated to the City of Ocoee.
- Concurrency Note. The City is subject to the terms, provisions and
restrictions of F.S. Chapter 163 concerning moratoriums on the issuance of
building permits under certain circumstances. The City has no lawful
authority to exempt any private entity, or itself, from the application of such
state legislation and nothing herein shall be construed as such an exemption.
- Tracts E, R, S and T depicted on this plat constitute "Common Areas" as
defined in the Declaration of Covenants, Conditions and Restrictions,
recorded in Official Records Book Page _ , of the Public Records of
Orange County, Florida (hereinafter referred to as the "Declaration"). Said
Tracts are not required by and are not dedicated to the City of Ocoee or the
general public, except as expressly stated on the face of this Plat. Said Tracts
are reserved for the common use and enjoyment of the Owner and of the
owners of residential lots described in the Declaration. The nature and extent
and the reservations and restrictions governing the use and enjoyment of said
Tracts are more fully set forth in those provisions of the Declaration
pertaining to Common Areas and in the following notes.
- Tracts E, R, S and T shall be owned by the Homeowners' Association and
maintained in accordance with and pursuant to the Declaration.
- Owner does hereby grant to the City of Ocoee a non-exclusive easement for
access and utility rights within Tracts E, R, S and T as are necessary for
emergency purposes and for maintenance of equipment and facilities which
are owned or operated by the City and which lie within said Tracts or within
the subject property.
- Owner dedicates a non-exclusive easement through, over, under and across
Tracts E, S and T for use by utility companies to construct, maintain and
replace their respective facilities servicing the subject property, but only to the
extent that the use of such easement does not and shall not interfere with the
purpose for which each Tract is dedicated.
- Tract R is a Conservation Area (Drainage Easement) and Tract S is a
Stormwater Management Area. Items to be constructed, maintained and
operated within said Tracts may include, without limitation, drainage control
structures, pipes and similar improvements. A Drainage Easement is hereby
dedicated to the City of Ocoee over the entire Tract R.
- Tract E is dedicated for access including, without limitation, access to the
residential lots to be located on the subject property. Items to be constructed,
maintained and operated within said Tracts may include, without limitation,
the paved surface of roadways, utilities, stormwater drainage improvements
and any landscaped areas lying within said Tracts. Drainage easements are
hereby dedicated to the City of Ocoee over the entire Tract E.
- Any wall and landscaping within the Wall and Landscape Easements are to be
maintained by the Homeowners' Association. The land burdened by such
easements shall be owned by the individual lot owners.
- Cable Television Note (per Chapter 177, Florida Statutes):
"Ai► platted utility easements shall provide that such easements shall also be
easements for the construction, installation, maintenance, and operation of
cable television services, provided, however, no such construction,
installation, maintenance, and operation of cable television services shall
interfere with the facilities and services of an electric, telephone, gas, or other
public utility. in the event a cable television company damages the facilities
of a public utility, it shall be solely responsible for the damages. This section
shall not apply to those private easements granted to or obtained by a
particular electric, telephone, gas, or other public utility. Such construction,
installation, maintenance, and operation shall comply with the National
Electrical Safety Code as adopted by the Florida Public Service Commission."
- Note regarding setting of lot corners (per Chapter 177, Florida Statutes):
"In those counties or municipalities that require subdivision improvements
and have the means of ensuring the construction of those improvements, such
as bonding requirements, (lot comer) monuments shall be set prior to the
expiration of the bond or other surety."
- Zoning: R-1A: Lots 209 through 211, Lots 237 through 285 and
Lots 298 through 300.
