BACKGROUND: The ForestBrooke subdivision will have a total of 362 single family residential lots to be constructed in multiple phases. The Developer will decide whether or not it will be a private gated community prior to submittal of the Final Subdivision Plan. The property is located on both sides of Ocoee Apopka Road (CR 437), just south of the McCormick Road. Some of the lots in the western portion of the property are on the shore of Lake Apopka. Most of the subject property west of CR 437 is currently occupied by orange groves and there are a few existing structures, including an existing home which will remain on one of the lots in the subdivision. There are also a significant amount of wetlands in the southwestern portion of that property. Most of the property east of CR 437 is currently wooded, but there are also some wetlands in the interior of that property. All of the subject property west of CR 437 currently has R-1-AA zoning. Part of the property east of CR 437 currently has R-1-A zoning and part of it currently has A-1 zoning. The property surrounding the proposed subdivision has R-1-AA zoning (south and west— undeveloped), R-1- A zoning (east— undeveloped), A-1 zoning (south and east— mostly undeveloped) and Orange County R-1 zoning (north — single family homes). A rezoning application has been submitted concurrently with the Preliminary Subdivision Plan, requesting that the portion of the property which is currently zoned A-1 be rezoned to R-1-A. P \A.\ \ Protect€lcoee's Water Resources September 21, 2001 Honorable Mayor and City Commissioners Page 2 DISCUSSION: General Project Description As shown in the Preliminary Subdivision Plan (PSP), the ForestBrooke subdivision includes a mixture of lot sizes consistent with the property's current and proposed zoning. East of Ocoee Apopka Road (CR 437), lots with a width of 70' to 80' are proposed (areas with existing and proposed R-1-A zoning). West of CR 437, larger lots with a width of 80' to 100' are proposed (areas with existing R-1-AA zoning). There will even be four lots along the lake which will be more than an acre in size. The main entrance to the portion of the subdivision west of CR 437 will befrom CR 437, with a secondary entrance from a new road to be constructed along the southern edge of the property. The Developer of this subdivision will construct half of that road, which will be used initially for emergency access only. The other half of that new road will be constructed by either the Developer of the adjacent property to the south (Battaglia Property) or the Avanti/West Groves Developer. The main entrance to the portion of the subdivision east of CR 437 will be from CR 437, with a secondary entrance from McCormick Road to the north and another secondary entrance from a new road to be constructed along the southern edge of the property. That new road east of CR 437 will line up with the other new road to be constructed west of CR 437. (It is anticipated that at some point in the future, a traffic signal will be installed at this new road's intersection with CR 437, which will benefit all three subdivisions— ForestBrooke, Avanti/West Groves and the Battaglia Property). In addition to those new road improvements, the PSP provides turn lanes for the two main entrances from CR437. The PSP also provides additional road right-of-way for the future widening of Ocoee Apopka Road (CR 437). As with other subdivisions, there will be a 6-foot brick wall with appropriate landscaping along both sides of CR 437. The PSP provides large stormwater retention ponds to buffer most of the lots from McCormick Road. There will be a 6-foot brick wall to buffer to lots closest to McCormick Road near the secondary entrance. However, where there are large retention ponds adjacent to McCormick Road, the buffer will be a 6-foot decorative metal fence with brick columns and appropriate landscaping. There will be several park areas located throughout the project with variety of recreation amenities. There will be three Master Community Parks and four Neighborhood Parks. The amenities include facilities for lakefront activities, a swimming pool and a 1,000 square foot meeting room, large open play areas, as well as pedestrian walkways, park benches and tot lots. Wetlands There are two areas of wetlands on the subject property, one in the eastern portion of the property, which will be preserved in its entirety, and another in the western portion of the property, most of which will be preserved. A small part of the wetlands in the western portion of the property will be impacted by the proposed development. These wetlands are associated with what is apparently a man-made canal. In addition to any mitigation requirements of the Water Management District, this small wetland impact will be mitigated by dedicating to the City most of the wetland area west of the canal for preservation (see Condition of Approval# 56). September 21, 2001 Honorable Mayor and City Commissioners Page 3 Waivers from Code Requirements This Preliminary Subdivision Plan includes three proposed waivers from certain Land Development Code requirements. The first waiver is related to the removal of trees from the individual lots before a building permit is issued for the home to be built on that lot. The Developer is requesting this waiver because there are portions of the site with significant slopes which he feels will require significant grading for proper drainage (see Sheet 7 of the PSP). The second waiver is related to the requirement for a tree survey. The Developer is requesting this waiver because there are so many trees on the site that he feels the cost of a tree survey would be very high, and he feels that it would not provide much of a benefit considering the grading issues related to the first waiver and the very specific Conditions of Approval on the PSP related to tree preservation. The third waiver is related to the requirement for sidewalks along public roads. This waiver is being requested to allow the Developer to provide one 8' sidewalk along the west side of Ocoee Apopka Road, rather than two 5' sidewalks with one on each side. Regarding the first proposed waiver, there are various Conditions of Approval on Sheet 9 of the PSP and Sheet 7 includes shading on the plan and special notes regarding the potential effects of grading on tree protection. It has been determined that those Conditions and notes satisfactorily address this issue, so the first proposed waiver is not necessary. Therefore, the Planning Department recommends that that waiver be deleted from the PSP. Regarding the second proposed waiver, the grading plan is still preliminary and we do not yet know how existing trees might be affected by grading in areas with significant slopes. Also, in recent weeks, the City Commission has expressed concerns about tree preservation on another site currently under construction. Therefore, the Planning Department recommends that the second proposed waiver be deleted from the PSP and when more information is available regarding the grading plan during the review of the Final Subdivision Plan, a waiver from requiring a tree survey over certain portions of the site could be requested at that time if it becomes necessary. The Planning Department supports the third proposed waiver related to sidewalks on Ocoee Apopka Road, and therefore recommends approval of that waiver request. Development Review Committee The Preliminary Subdivision Plan for the ForestBrooke subdivision was reviewed by the Development Review Committee (DRC) on September 4, 2001. After discussion of a few outstanding issues, the Committee voted unanimously to recommend approval of the Preliminary Subdivision Plan, subject to certain revisions to the plans (as described in two Staff memos) that would be made after the City Commission public hearing. The two attached Staff memos were referenced in the DRC recommendation. The DRC recommendation included making all the changes to the plans described in those two memos with one clarification. Comment # 2 in the Planning Department memo indicates that the PSP should include construction of a secondary road along the southern edge of the site, east of CR 437 (within Tract Y). The DRC agreed with the Developer's request to provide a note indicating that that road improvement would be constructed with the final phase of the subdivision. Due to emphasis being placed on various other issues that were outstanding, the DRC did not discuss the three proposed waivers. Therefore, the DRC did not make a formal recommendation regarding the three waivers. September 21, 2001 Honorable Mayor and City Commissioners Page 4 PLANNING &ZONING COMMISSION RECOMMENDATION: The Planning and Zoning Commission held a public hearing on September 19, 2001 to consider the Preliminary Subdivision Plan for the ForestBrooke subdivision. When the Staff finished its presentation, the Developer expressed agreement with the Staff recommendation and then presented additional information about the extensive park amenities proposed with the subdivision. A gentleman from the audience who owns property adjacent to the subdivision expressed concern about his access and the potential for stormwater backing up into the low area on the site and on his property. The Developer spoke to the gentleman's concerns and he was satisfied. Again, there was concern from certain Commissioners about saving trees. However, most of the P & Z members expressed great appreciation for the Developer's desire to provide larger lots and indicated that they were pleased with this subdivision plan. When the discussion was finished, the Planning and Zoning Commission voted unanimously, with one abstention, to recommend approval of the Preliminary Subdivision Plan for the ForestBrooke subdivision as recommended by Staff. STAFF RECOMMENDATION: Based on the recommendations of the DRC and the Planning and Zoning Commission, Staff respectfully recommends that the Mayor and City Commission approve the Preliminary Subdivision Plan for the ForestBrooke subdivision, as date stamped received by the City on September 6, 2001, subject to City Commission approval of the associated rezoning application, and subject to the conditions listed in the attached Staff memos as recommended by the Development Review Committee (DRC). The Planning Department respectfully recommends approval of the third proposed waiver, but that the first two proposed waivers be deleted from the Preliminary Subdivision Plan. Additional changes to the plans can be made after the City Commission public hearing, with the outstanding issues addressed as conditions of approval referenced in the Staff Report. The Planning Department recommends approval of the ForestBrooke Subdivision Preliminary Subdivision Plan, subject to the following conditions: 1) In order to avoid confusion, all graphic representations of entrance gates on all the plan view drawings need to be removed from the plans. The elevation views of the gates and the call box on Sheets L2 and L4 should also be removed from the plans. If the Developer chooses to have entrance gates, plan view graphic representations and detailed drawings of the gates will be provided with the Final Subdivision Plan. 2) The PSP needs to show that the subdivision improvements will include construction of the secondary road along the southern edge of the subject property within Tract Y, from Ocbee Apopka Road to the project entrance. The design of the Ocoee Apopka Road intersection should show the lanes on the east side to be properly lined up with the ' lanes on the west side of Ocoee Apopka Road. 3) Condition of Approval # 16 on Sheet 9 needs to be revised to read: "Conservation and drainage easements over Tracts F, H, DD and EE, and lakeside of the 50' upland buffer line along Lake Apopka (50' from the wetland line), shall be prepared by the City, executed by the owner and recorded at the time of platting." 4) The previous submittal included a note in the middle of Sheet L1 which read: "Per City of Ocoee landscape code, for common areas abutting rights-of-way, one tree per 50' of frontage will be provided.
