SUBJECT: McElroy Place - Preliminary Subdivision Plan

ISSUE:
Should the Mayor and City Commissioners approve the Preliminary Subdivision Plan for
McElroy Place.
BACKGROUND:
McElroy Place subdivision, which includes a total of 127 single-family residential lots, is located
on the south side of McCormick Road immediately north of Trout Lake. The proposed
subdivision is surrounded almost completely by unincorporated Orange County. The subject
property is currently undeveloped and is planted with pine trees. The southern edge of the
subject property abuts a wetland area and lake. Most of the surrounding land is wooded or
former citrus groves.
DISCUSSION:
As shown in the Preliminary Subdivision Plan. McElroy Place will have two points of access, one
from McCormick Road and access onto the northward extension and terminus of Clarke Road.
As with other subdivisions, there will be a 6 foot brick wall with appropriate landscaping along
the northern and western boundaries of the subdivision adjacent to McCormick Road and Clarke
Road respectively. The property has R-1-AA zoning, dictating a minimum lot width of 75 feet
(minimum 9,000 sf).
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Preliminary Subdivision Plan for McElroy Place was reviewed by the Development Review
Committee (DRC) on February 8, 2002. The DRC voted unanimously to recommend approval
of the Preliminary Subdivision Plan with no conditions to the Planning & Zoning Commission.
PLANNING & ZONING COMMISSION RECOMMENDATION:
The following issues were discussed at the Planning & Zoning Commission public hearing on
April 9:
- Traffic on McCormick Road. Concern was expressed about truck traffic hauling
sludge to the nearby Orange County landfill.

- Use of the sinkhole on McCormick Road as a retention pond. Concern was
expressed about the possibility of contamination of underground water supplies to the
neighbors well to the southeast. The consultant gave assurances that contamination
would not occur since the well was at a depth where the underground water flow was
from southwest to northeast.
- The nearby airfield. The nearby airfield is used by general aviation but infrequently.
The noise is at a low decibel level.
- A pedestrian trail. The property owner adjacent on the east side of the proposed
subdivision expressed concern that trail users might wander onto his property. It was
agreed by the developer that there would be no stabilized pedestrian trail located
within Tract J, the 25-foot environmental swale/upland buffer.
- Gopher Tortoises and Sandhill Cranes. A nearby property owner said there were
gopher tortoises and Sandhill Cranes around the southeast portion of the proposed
subdivision property. The environmental consultant for the developer indicated that
he did not find any evidence of active nests of Sand Hill Cranes or Gopher Tortoises
on the property.
- Clarke Road extension. Discussion centered around possible extension southward
to existing Clarke Road and the right-of-way layout. It was noted that the Clarke
Road Extension is indicated in the Transportation Element of the City's
Comprehensive Plan, but that the City has not funded this project yet.
- Removal of trees around the sinkhole, clear-cutting. Some nearby residents
expressed concern about the degree of tree removal. The developer indicated that
as many trees would be saved as possible.
After finishing its deliberations, the Planning & Zoning Commission voted unanimously to
recommend approval of the Preliminary Plan for McElroy Place (date-stamped February 14,
2002). The Chairman noted staff and applicant's agreement to defer consideration of the
Preliminary Subdivision Plan to the May 7, 2002 City Commission meeting.
STAFF RECOMMENDATION:
Based on the recommendation of the DRC and the Planning and Zoning Commission, Staff
recommends that the Mayor and City Commissioners approve the Preliminary Subdivision Plan
for McElroy Place, as date stamped received by the City on February 14, 2002.

CONCERNING MORATORIA ON THE ISSUANCE OF BUILDING PERMITS UNDER CERTAIN CIRCUMSTANCES. THE CITY HAS NO LAWFUL
AUTHORITY TO EXEMPT ANY PRIVATE ENTITY, OR ITSELF, FROM THE APPLICATION OF SUCH STATE LEGISLATION AND NOTHING HEREIN
SHOULD BE CONSTRUED AS SUCH AN EXEMPTION.
9. ALL LEGAL INSTRUMENTS, INCLUDING BUT NOT LIMITED TO HOMEOWNER'S ASSOCIATION DOCUMENTS SUCH AS ARTICLES OF
INCORPORATION, BYLAWS, AND DECLARATION OF COVENANTS AND RESTRICTIONS, SHALL BE PROVIDED TO THE CITY FOR REVIEW AND
APPROVAL PRIOR TO OR AT THE TIME OF PLATTING.
10. EACH FIRE HYDRANT SHALL BE OSHA YELLOW IN COLOR AND A BLUE REFLECTIVE MARKER SHALL BE AFFIXED TO THE STREET
IN THE CENTER OF THE LANE CLOSEST TO EACH HYDRANT.
11. ALL UTILITY AND DRAINAGE EASEMENTS UPON INDIVIDUAL LOTS SHALL BE MAINTAINED BY THE LOT OWNER. THE LAND
BURDENED BY SUCH EASEMENTS SHALL BE OWNED BY THE INDIVIDUAL LOT OWNERS. SUCH EASEMENTS SHALL BE DEDICATED TO
THE PERPETUAL USE OF THE PUBLIC AT THE TIME OF PLATTING.
12. THE DEVELOPER SHALL CONSTRUCT APPROPRIATE CURB CUTS TO ENABLE CONSTRUCTION RAMPS AT ALL RIGHTS -OF -WAY
INTERSECTIONS (AND OTHER AREAS AS REASONABLY REQUIRED) IN ORDER TO ACCOMMODATE ACCESS TO SIDEWALKS AND STREETS
FOR PERSONS WHO ARE IN WHEEL CHAIRS AND OTHER PERSONS WHO ARE PHYSICALLY CHALLENGED. SIDEWALKS ABUTTING EACH
PLATTED LOT SHALL BE CONSTRUCTED AT THE TIME A HOUSE IS CONSTRUCTED ON THE LOT. WHEN SIDEWALKS ARE CONSTRUCTED
ON CORNER LOTS AT CERTAIN LOCATIONS, THE SIDEWALKS WILL BE EXTENDED TO THE CURB AND THE APPROPRIATE RAMPS WILL
THEN BE CONSTRUCTED. SIDEWALKS ADJACENT TO COMMON AREAS SHALL BE CONSTRUCTED AT THE TIME OF CONSTRUCTION OF
THE ADJACENT COMMON AREA.
13. THE PLAN SHOWS AVAILABLE PAD SIZE FOR REFERENCE ONLY. FOR EACH INDIVIDUAL LOT, THE BUILDING SHALL NOT EXCEED
35% LOT COVERAGE AND THE TOTAL IMPERVIOUS SURFACES SHALL NOT EXCEED 50% LOT COVERAGE.
14. STREET LIGHTS SHALL BE INSTALLED BY THE DEVELOPER PRIOR TO CERTIFICATE OF COMPLETION AT HIS EXPENSE AND THE
COST OF THEIR OPERATION WILL BE ASSUMED BY THE DEVELOPER IN ACCORDANCE WITH ORDINANCE NO. 95-17.
15. ALL THE UNDERGROUND UTILITIES SHALL COMPLY WITH ORDINANCE NO. 95-17, WHICH REQUIRES PEDESTAL -MOUNTED UTILITY
BOXES TO BE PLACED BACK OFF THE STREET, NO MORE THAN 5 FEET FORWARD OF THE FRONT BUILDING SETBACK LINE, ON ALL
RESIDENTIAL LOTS WHICH ARE LESS THAN 70 FEET IN WIDTH WHERE THE LOT ABUTS THE STREET RIGHT-OF-WAY LINE.
16. NO PERSON SHALL UNDERTAKE LAND CLEARING OR THE REMOVAL OF ANY PROTECTED TREE WITHOUT FIRST OBTAINING A
PERMIT FROM THE BUILDING DEPARTMENT. THE REMOVAL OF PROTECTED TREES SHALL BE MINIMIZED TO THE MAXIMUM EXTENT
POSSIBLE AND NO AUTHORIZATION SHALL BE GRANTED TO REMOVE A TREE IF THE DEVELOPER HAS FAILED TO TAKE REASONABLE
MEASURES TO PRESERVE PROTECTED TREES.
17. A STREET TREE SHALL BE PROVIDED BY THE HOME BUILDER AT THE FRONT OF EACH LOT (TWO STREET TREES ON CORNER
LOTS, WITH ONE ON EACH STREET), PRIOR TO ISSUANCE OF A CERTIFICATE OF OCCUPANCY FOR THE HOUSE CONSTRUCTED ON
THAT LOT. EACH RESIDENTIAL BUILDING LOT SHALL HAVE A MINIMUM OF THREE (3) TREES PROVIDED BY THE HOME BUILDER.
EACH TREE SHALL BE A SHADE TREE AND SHALL BE A MINIMUM OF 2" DBH AND 10' TALL AT THE TIME OF PLANTING.
18. ALL HOUSE PAD ELEVATIONS SHALL EXCEED THE 100 YEAR FLOOD ELEVATION BY A MINIMUM OF ONE FOOT.
19. THE DEVELOPER SHALL TAKE SUCH MEASURES REQUIRED BY THE CITY AND OTHER GOVERNMENTAL ENTITIES WITH JURISDICTION
TO PROTECT TRACT F (CONSERVATION AREA) AND THE 100 YEAR FLOOD ELEVATION FROM DISTURBANCE, SILTATION, OR OTHER
CONSTRUCTION. FURTHER, THESE AREAS SHALL BE ROPED OFF (AND SILT FENCES SHALL BE INSTALLED) DURING CONSTRUCTION
ACTIVITIES IMMEDIATELY ADJACENT TO SUCH AREAS, IN ORDER TO MINIMIZE DISTURBANCES DURING CONSTRUCTION.
20. REMOVAL OF EXISTING PROTECTED TREES WILL BE LIMITED TO CLEARING ROAD RIGHT-OF-WAY AND RETENTION AREAS, AND
AREAS OF MASS GRADING. ALL EXISTING PROTECTED TREES ON INDIVIDUAL LOTS WILL BE EVALUATED AT THE TIME A BUILDING
PERMIT IS ISSUED FOR THAT LOT, TO DETERMINE WHETHER OR NOT EACH TREE NEEDS TO BE REMOVED.
21. IN ORDER TO ENSURE THAT AS MANY EXISTING TREES AS POSSIBLE WILL BE PRESERVED, ALL ROAD RIGHTS -OF -WAY AND
RETENTION AREAS WILL BE FLAGGED FOR REVIEW BY THE CITY AND THE ENGINEER PRIOR TO ANY TREE REMOVAL. NO CLEARING
PERMITS WILL BE ISSUED FOR SITE WORK OR BUILDING CONSTRUCTION UNTIL ALL TREES TO BE PRESERVED HAVE BEEN CLEARLY
MARKED WITH TREE PROTECTION BARRIERS.
22. ALL UTILITIES TO BE PLACED WITHIN THE 10-FOOT EASEMENT ALONG THE FRONT OF EACH LOT WILL BE PLACED AROUND
EXISTING PROTECTED TREES TO BE PRESERVED.
23. THE EXISTING GRADES ON INDIVIDUAL LOTS CONTAINING PROTECTED TREES WILL BE MAINTAINED AS MUCH AS POSSIBLE TO
PRESERVE EXISTING PROTECTED TREES. FOR LOTS CONTAINING PROTECTED TREES, THERE WILL BE NO GRADING OR OTHER
CONSTRUCTION ON INDIVIDUAL LOTS EXCEPT AS SPECIFIED IN THE FINAL SUBDIVISION PLAN, UNTIL BUILDING PERMITS ARE ISSUED

24. ALL TRACTS WHICH ARE TO BE OWNED AND MAINTAINED BY THE HOMEOWNER'S ASSOCIATION SHALL BE CONVEYED TO THE

CONVEYANCE OF THE SAME, AND THE PRORATED AMOUNT OF SUCH REAL PROPERTY TAXES ATTRIBUTABLE TO THE OWNER SHALL
BE PAID AND ESCROWED BY THE OWNER IN ACCORDANCE WITH THE PROVISIONS OF SECTION 196.295, FLORIDA STATUTES. NEITHER

EXTENSION ("THE CLARKE ROAD RIGHT-OF-WAY PROPERTY"). THE CLARKE ROAD RIGHT-OF-WAY PROPERTY SHALL BE DEDICATED
AND CONVEYED BY THE OWNER TO THE CITY BY WARRANTY DEED FREE AND CLEAR OF ALL LIENS AND ENCUMBRANCES EXCEPT FOR
THOSE MATTERS ACCEPTABLE TO THE CITY. THE FORM OF THE WARRANTY DEED SHALL BE SUBJECT TO THE APPROVAL OF THE

48. PURSUANT TO ORDINANCE NO. 2001-18 ALL SUBDIVISION SIGNAGE MUST BE CONSISTENT WITH THE LEGALLY ASSIGNED NAME
OF THE SUBDIVISION. ANY SUBSEQUENT CHANGE TO THE NAME OF THE SUBDIVISION MUST BE APPROVED BY THE CITY COMMISSION.
