SUBJECT: Miracle Ear Office Building -Waiver Requests

ISSUE:
Should the Mayor and the City Commissioners approve the five (5) Waiver Requests for Miracle
Ear Office Building Small Scale Site Plan.
BACKGROUND:
The Miracle Ear Office Building is proposed to be located at the northwest corner of the
intersection of Silver Star Road and Ridgefield Avenue. The first of two phases comprises a
building of 4,048 square feet of floor space on a lot size of .869 acres, along with associated
parking and a retention pond. The second phase involves another office building of 4,000
square feet along with its own parking area and retention pond. There would be a common
driveway for access to both lots. There is a proposed lot line down the center of the curb cut to
the property off Silver Star Road, resulting in both parcels falling below the minimum lot size of 1
acre. The east parcel, under consideration, meets only 86% of the required minimum lot size.
As a result, the developer must request a waiver from the City Commission. In addition, the
developer is requesting four (4) other waivers due to the unusual physical constraints
associated with the site.
The City Commission has sole discretion to approve waivers from Code requirements based
upon four criteria:
1) If the project is part of an integrated and master planned development;
2) If the project is compatible with surrounding developments;
3) If the project imposes no impacts on City infrastructure greater than that generated
by other uses normally permitted in the underlying zoning district; and/or
4) If the project provides an off-setting public benefit which is technically sound and
measurable.

DISCUSSION:
The five (5) waivers requested by the developer are summarized as follows:
1. A minimum 25-foot landscape buffer is to be provided along public primary and
secondary streets. (a 15-foot landscape buffer is requested)
2. A minimum 15-foot buffer is to be provided between low-rise office and single family
residential areas. (a 10-foot buffer is requested)
3. A maximum 5:1 ratio side slope is to be provided for unfenced retention ponds.
(4:1 ratio is requested)
4. Outparcel lot shall not be less than one acre in size. (two lots of 0.86 acre are
requested)
5. Minimum 15-foot buffers to be provided along public primary roads. (5-foot
encroachment requested.
In order to justify the requested waivers, the developer has identified the following off-setting
public benefits:
1. The developer is giving to the City 20 feet of right-of-way along the entire length of its
property.
2. The developer is giving to the City an easement in the rear of the property for a
waterline owned by the City.
3. The developer is moving and relocating a waterline owned by the City both on the
developer's property and on off-site property as well.
4. The site is an extraordinarily narrow "in-fill site with unique site development
circumstances.
The developer will need to dedicate the 20 feet of right-of-way and execute an agreement for
easement to the City.
Although not specifically a waiver request, the Code requires construction of a 6-foot wall along
the north boundary line utilizing brick not concrete block.
STAFF RECOMMENDATION:
The determination to grant waivers is solely at the discretion of the City Commission, However,
should the Commission grant these waivers, it is recommended that the approval be subject to
the following:
1) the developer dedicating the 20 feet for future right-of-way expansion at platting;

2) the developer granting an easement to the City for the purpose of maintenance and
expansion of the waterline within the proposed parking area; and
3) agreeing to construct a brick wall adjacent to the residential area to the north.
