Small Scale Site Plan Waiver Requests
ISSUE:
Should the Mayor and City Commissioners approve three waivers as currently requested on the
proposed site plan for Ocoee Commons (Lot 3, Wal-Mart Supercenter— 1.20 acres)?
BACKGROUND:
Ocoee Commons is a proposed multi-tenant retail center (11,078 sf) located on one of the
outparcels in front of the new Wal-Mart Supercenter currently under construction on the south
side of SR 50, just west of Blackwood Avenue. In order to proceed further with the current site
plan, three waivers from Code requirements are being requested by the Developer. The City
Commission has sole discretion to approve waivers from Code requirements based upon four
criteria:
1) If the project is part of an integrated and master planned development;
2) If the project is compatible with surrounding developments;
3) If the project imposes no impacts on City infrastructure greater than that generated by
other uses normally permitted in the underlying zoning district; and/or
4) If the project provides an off-setting public benefit which is technically sound and
measurable.
DISCUSSION:
Since this is a Small Scale Site Plan which is administratively reviewed (less than 25,000 square
feet of building), the City Commission will not be acting on the site plan for approval. The City
Commission will instead be reviewing the waiver requests only. After the City Commission takes
action on the waiver requests, Staff will complete its review process on the site plan, making
sure that it is consistent with all Code requirements except for any waivers that may be approved
• by the City Commission. The current site plan includes a Waiver Table describing the three
waiver requests from Code requirements (a copy of the waiver table is attached to this report).
The Applicant believes that all three waivers are needed to develop the site as POWTI

By way of comparison to past projects, the first two waivers were approved for the West Oak
Square site, located on the south side of SR 50 across from the Mall, just east of Citrus Oaks
Avenue. These are waivers from the 100 foot maximum front building setback and the limit of
one bay of parking between the building and the street. The West Oak Square site had a long
narrow lot facing SR 50 that backed up to a wetland area which feeds into Lake Lotta. Fairly
steep grades and a wetland at the rear of that site, coupled with the long narrow shape of the
site, resulted in unique constraints. In order to soften the appearance of two bays of parking in
front of the building, a 4 foot wide linear landscape island with shrubs and understory trees was
provided between the two bays of parking.
The Ocoee Commons site is slightly narrower than the West Oaks Square site, but it does not
have the grading or wetland problems that the West Oaks Square site had. The linear
landscape island provided between the two bays of parking on the Ocoee Commons site is only
two feet wide with no shrubs or trees. The Planning Department had suggested that a wider
linear landscape island be provided with shrubs and trees to soften the appearance of the large
parking lot. The applicant has chosen not to take that approach, even though it could be
accomplished by modifying a portion of the parking lot.
The third waiver request is from the requirement to provide at least one off-street loading space
on the site (a parking space a minimum of 12' x 25' in size, required for a retail building of this
size). Retail buildings under 10,000 square feet are not required to have an off-street loading
space. Buildings over 10,000 square feet are required to have one or more loading spaces, the
number of loading spaces increasing as the size of the building increases. For the Ocoee
Commons site, one off-street parking space is required.
The City is currently reviewing site plans for the other two outparcels facing SR 50 located on
either side of the Ocoee Commons site. Both of those site plans are anticipated to meet all
Code requirements without any waivers. Both buildings (Chick Fil-A on Lot 2 and La-Z-Boy on
Lot 4) will be located less than 100 feet from the front of the site with one bay of parking. The
Ocoee Commons building, if developed as currently shown, will be about located 143 feet from
the front of the site.
STAFF RECOMMENDATION:
The determination to grant waivers is solely at the discretion of the City Commission.
