ISSUE # 1:
Should the Mayor and City Commissioners approve a change to the Future Land Use
Map for the subject property from "Low Density Residential" to "Professional Offices &
Services"? (see attached legal description)
BACKGROUND:
The subject property is located on the south side of Old Winter Garden Road (S.R. 526)
across from the Health Central Hospital, between Blackwood Ave. and Matador Drive.
The property comprises 5.81 acres and is proposed to be developed as an office park
complex, if the small scale comprehensive plan amendment (SSCPA) is approved. The
surrounding Future Land Use designations within 300 feet are "Low Density Residential"
on the east, south, and west side, and "Public Facilities/Institutional" on the northside
and "Professional Offices & Services" to the northeast. Beyond this dstance in the
general area of the subject property. there are FLUM designations to the east and south
(unincorporated) of "Low Density Residential", and "Medium Density Residential"
reflecting a continuation of the existing older modest residential structures. To the west
are FLUM designations of"High Density Residential" covering the site of the Oak Forest
Apartment complex and "Commercial" covering the site of the Wal-Mart Supercenter".
This area can be viewed as an area in transition from vacant land and existing
residential land use to an area increasingly undergoing pressures for commercial and
office development because of the near proximity to the East-West Expressway, S.R. 50
major urban arterial. A market demand has been created for office development,

especially for medical offices due to the location of the Health Central Hospital.
Professional offices by their nature are a low intensity land use. Although the proposed
land use differs from the adjacent residential land use on the east, sodh and west, a
protective buffer consisting of a six (6) foot high masonry wall around the perimeter of
the subject property will be constructed with the subdivision improvements along with a
50-foot setback from the property line to the rear edge of the office buildings. In
addition, all roof mounted equipment will be screened from view from all adjacent
property lines. As a result, there should be no negative impacts on the adjacent
residential areas.
DISCUSSION:
The subject property is currently designated "Low Density Residential (less than 4 DU
per acre) on the City's Future Land Use Map. However, the City and the County have
mutually agreed to a future land use designation of 'Professional Offices & Services' for
the subject property via the 3rd Amendment to the Ocoee-Orange County Joint Planning
Area Agreement adopted November 2. 1999. The applicant has requested a SSCPA to
change the Future Land Use Map designation from `Low Density Residential" to
"Professional Offices & Services". This proposed small scale comprehensive plan
amendment (SSCPA) will make the adopted Future Land Use Map consistent with the
Ocoee-Orange County Joint Planning Area Agreement.
The SSCPA will be processed concurrently with a Rezoning Petition and a Preliminary
and Final Subdivision Plan for the subject property. If the SSCPA is approved, the
requested "PUD" zoning would be consistent with the "Professional Offices & Services"
Future Land Use designation requested in the SSCPA.
Considering the location of the subject property, City staff had discussed with the
applicant the desirability of PUD zoning. This would allow more flexibility and control in
design of the site, whereby potential nuisances can be kept to a minimum.
Staff has determined that the requested SSCPA is consistent with: (1) the Ocoee-
Orange County Joint Planning Area Agreement; (2) Ocoee's Comprehensive Plan; (3)
Ocoee's Land Development Code. and (4) surrounding land uses and zoning
classifications. More specifically, the request is consistent and compatible with the
Future Land Use Element of the Comprehensive Plan: (a) Goal 1; (b) Objective 1; (c)
Policy 1.1; (d) Policy 1.3; (e) Policy 1.6. (f) Objective 2; and (g) Policy 2.4
PLANNING & ZONING COMMISSION RECOMMENDATION:
At its August 13, 2002 meeting, the Planning & Zoning Commission, acting as the Local
Planning Agency, held a public hearing to review the proposed small scale
comprehensive plan amendment. There was one local resident who spoke at the public
hearing who asked for clarification of several issues. After due consideration, the
Planning & Zoning Commission voted unanimously to recommend approval of the
proposed Citrus Medical and Executive Park Small Scale Comprehensive Plan
Amendment (Case No. SS-CPA-1-002) to the City Commission_

STAFF RECOMMENDATION:
Based on the recommendation of the Planning & Zoning Commission, Staff respectfully
recommends that the Mayor and City Commissioners approve the proposed Citrus
Medical and Executive Park Small Scale Comprehensive Plan Amendment (Case No.
SS-CPA-1-002).
ISSUE # 2:
Should the Mayor and City Commissioners approve a change to the Zoning Map for the
subject property from A-1 "General Agricultural District" to PUD "Planned Unit
Development"?
DISCUSSION:
Related to the rezoning, the Applicant has requested first that the subject property be
designated "Low Density Residential (less than 4 DU per acre) on the City's Future Land
Use Map. If the SSCPA is approved, the requested PUD "Planned Unit Development"
zoning would be consistent with the `Professional Offices & Services' Future Land Use
designation.
The Land Development Code indicates that the PUD "Planned Unit Development
(zoning) District" is consistent with the "Professional Offices & Services" Future Land
Use Map designation and that a planned office commercial center is a permitted use.
The use of the PUD zoning designation will provide flexibility and control in design of the
site by setting specific conditions and restrictions; whereby potential nuisances can be
kept to a minimum regarding site design features and uses.
Staff has determined that, subject to the SSCPA becoming effective, the proposed PUD
zoning classification is consistent with: (1) the Ocoee-Orange County Joint Planning
Area Agreement; (2) Ocoee's Comprehensive Plan; (3) Ocoee's Land Development
Code and (4) surrounding land uses and zoning classifications. More specifically, the
request is consistent and compatible with the Future Land Use Element of the
Comprehensive Plan (a) Goal 1; (b) Objective 1; (c) Policy 1.1; (d) Policy 1.3; (e) Policy
1.6; (f) Objective 2; and (g) Policy 2.4
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee (DRC), at its meeting on July 29, 2002, reviewed
the proposed rezoning. The Asst. City Attorney mentioned that with PUD zoning there is
always a Development Agreement. In this case the Development Agreement
incorporates the Conditions of Approval indicated on the Preliminary/Final Plans. The
DRC unanimously recommended approval, finding the rezoning request and the PUD
Land Use Plan consistent with (1) the Comprehensive Plan; (2) the Future Land Use
Map; (3) the Land Development Code; (4) the Ocoee-Orange County Joint Planning

Area Agreement with Orange County; and (5) the surrounding land uses and zoning
classifications.
PLANNING &ZONING COMMISSION RECOMMENDATION:
At its August 13, 2002 meeting, the Planning & Zoning Commission held a public

with (1) the Comprehensive Plan; (2) the Future Land Use Map; (3) the Land
Development Code; (4) the Ocoee-Orange County Joint Planning Area Agreement; and
(5) the surrounding land uses and zoning classifications. The Planning & Zoning
Commission unanimously recommended approval of the proposed rezoning of the
subject property from A-1 "General Agricultural District" to PUD "Planned Unit
Development", subject to the PUD Land Use Plan (Case No. LS-99-014), and
conditioned on the site plan being viewed as a purely conceptual representation only
and subject to review and separate approval of each lot at the time of site plan
submission.
STAFF RECOMMENDATION:
Based on the recommendation of the DRC and the Planning & Zoning Commission,
Staff respectfully recommends that the Mayor and City Commissioners approve the
rezoning, with consideration that the site plan be viewed as a purely conceptual
representation only and subject to review and separate approval of each lot at the time
of site plan submission.
ISSUE # 3:
Should the Mayor and City Commissioners approve the Preliminary & Final Subdivision
Plans for the subject property.
DISCUSSION:
Before this subdivision could be approved it required a Utility Service Agreement with
Orange County and a comprehensive plan amendment to ,:gange the subject property's
Future Land Use Map designation. The Utility Service Agreement was approved on
September 11, 2001 with the City providing sewer and water service. The plans indicate
that there will be three(3) lots with a total of five (5) buildings along with a retention pond
and a 420-foot cul-de-sac private road. The Staff has reviewed the preliminary and final
subdivision plans and finds that they conform to the City's land development regulations
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee, at its July 29, 2002, meeting reviewed the
Preliminary & Final Subdivision Plans and discussed the provision of sewer and water
services. The Engineering Department indicated that sewer and water service would be
provided by the City through a force main connection to a gravity system and through
connection to an existing water main on Old Winter Garder. Road. Also discussed were

the arrangements for road widening and turn lanes at the entrance to the subdivision.
The Engineering Dept. indicated that the developer would pay for the improvements for
road widening and the turn lanes. The DRC unanimously recommended approval of the
Preliminary & Final Subdivision Plans.
PLANNING & ZONING COMMISSION RECOMMENDATION:
At its August 13, 2002 meeting, the Planning & Zoning Commission held a public
hearing to review the proposed Preliminary & Final Subdivision Plans and discussed the
wall around the perimeter of the property and removal of existing trees. The Planning &
Zoning Commission unanimously recommended approval of the Preliminary & Final
Subdivision Plans, conditioned on the wall being changed from a solid material to
wrought iron or some open style fence and that the ouilder make every effort to
incorporate existing trees into the parking lot islands and driveway areas.
STAFF RECOMMENDATION:
Based on the recommendation of the DRC, and the Planning & Zoning Commission, the
Staff respectfully recommends that the City Commission approve the Preliminary and
the Final Subdivision Plans of the subject property, with consideration that the wall be
changed from a solid material to wrought iron or some xpen style fence and that the
builder make every effort to incorporate existing trees into the parking lot islands and
driveway areas.

Objective 1
By 1992, the development of land shall be regulated to ensure that
newly developed property and redeveloped property is compatible (
meaning, not in direct conflict with uses with regards to specific
zoning categories, density and intensity) with adjacent uses and
natural features and resources including topography, vegetation, and
soil conditions .
Policy 1. 1
The City shall review, through the development review processs, all
plans for development and redevelopment to ensure their compatibility
with adjacent uses .
Policy 1.3
The City shall mitigate impacts by using regulations related to landscaping, setbacks,
wall/fences, on-site parking, on-site trat o flow, lighting, signs, pedestrian access,
vehicular access and other factors which will mitigate off-site impacts and enhance
the health, safety, welfaree and appearance of the built environment while providing
an effective buffer between uses. Development regulations will be updated by 1992.
Policy 1.6
The City shall control strip commercial development through access limitations by
restricting commercial land uses to the intersections of arterial and non-residential
collector roads, along designated arterial and collector roads and within Planned
Unit Developments. This shall be accomplished through the land development
regulations.
Objective 2
To provide adequate services and facilities to newly developed or
redeveloped property and to protect the ability of those services and
facilities to function properly. These services and facilities shall
be provided in an economic=ally feasible manner, as outlined in the
infrastructure Element Subele.eants, and shall be provided in a manner
to discourage urban sprawl .

By 1992, the City shall allow only land use patterns and development
that can be efficiently provided with necessary public services . This
shall be regulated through the Concurrency Management System as
described in the Capital Improvements Element of this Comprehensive
Plan.
