Shira, P.E., City Engineer DATE: October 7, 2002 RE: Old Winter Garden Road / Blackwood Avenue Intersection Improvements Design Attached for your review and approval is a proposal from PEC for modification of the design drawings for the Old Winter Garden Road/ Professional Parkway widening project. These proposed modifications arc due to the recent construction of the Super Wal-Mart. During the design of that project, several intersection improvements were noted that were required by the Wal-Mart project. It was also apparent that if Wal-Mart built those improvements in the existing right-of-way, our widening project, built in the soon-to-be-expanded right-of-way, would tear them out again. This made no sense, so an agreement was reached whereby the Wal- Mart improvements were postponed until the road widening, and would be incorporated into that road widening. In the Wal-Mart development agreement, Wal-Mart agreed to pay for the cost of a temporary signal at this intersection and certain intersection improvements (together, the Wal-Mart Offsite Roadway Improvements). Due to right-of-way constraints, it was agreed that Wal-Mart would pay the estimated cost of those improvements to the city and that the city would include the construction of the improvements in the Old Winter Garden Road project. Based on an estimate prepared by PEC in June 2001, we believed the cost of design, construction and administration to be approximately $360,000. Further review of the work resulted in an estimated cost range of$300,000 to $350,000. The engineer for Wal-Mart provided us with a detailed breakdown of the work and an estimate of$342,320 which was within our estimated range. We agreed that the $342,320 figure was acceptable, and in early December 2001 we received a check from Wal-Mart for that amount and the funds were deposited to the city's account. The construction and construction administration phases will be the subject of future proposals. I recommend that the City Commission authorize the Mayor and City Clerk to execute Amendment No. 01 to Addendum No. 99-10 to PEC's continuing contract and authorize PEC to proceed with the survey, design and permitting of the Wal-Mart Offsite Roadway Improvements. Walmart has agreed to pay the City the total cost for design, inspection and construction of the traffic improvements. By having these improvements incorporated into the Old Winter Garden Road/Professional Parkway Roadway Plans, no wasted construction or reconstruction will occur. Principal G lencarmGm+AYTEoococewmcndum‘amendm zv-iw do- Enclosure - trl, i.., . •] . :' bi, '•I,.k 4[i.a1a 9401 AMENDMENT NO. 01 TO ADDENDUM NO. 99-10 TO AGREEMENT FOR CONSULTING ENGINEERING SERVICES INCLUDING ENGINEERING SERVICES FOR CITY OF OCOEE OLD WINTER GARDEN ROAD ADDITIONAL ENGINEERING SERVICES RE: WALMART OFF-SITE ROADWAY IMPROVEMENTS This Amendment No. 1 to Addendum 99-10 hereinafter called the Amendment, as of this day of 2002, shall constitute an Addendum to the Agreement for Consulting Engineering Services between the City of Ocoee, Florida (the CITY) and Professional Engineering Consultants, Inc., 200 East Robinson Street, Suite 1560, Lake Eola Centre, Orlando, Florida (the CONSULTANT), dated the 21st day of August, 1984, hereinafter referred to as the AGREEMENT. WHEREAS, the CITY and CONSULTANT entered into an AGREEMENT whereby the CITY retained the CONSULTANT to provide professional engineering services as required from time to time, and WHEREAS the CONSULTANT will perform consulting engineering services for the CITY as herein defined. NOW THEREFORE, in consideration of the mutual covenants and promises hereinafter set forth on the part of both parties to be kept and performed, the parties do mutually agree as follows: Section 1 - Services of the Consultant 1.1 The CONSULTANT shall perform the Engineering Services as outlined in the attached letter dated June 12, 2001 relative to the provision of construction administration services to the CITY. Section 2 - Compensation 2.1 Compensation by CITY for engineering services for Old Winter Garden Road Additional Engineering Services (Re: Walmart Off-Site Roadway Improvements) is provided under this Addendum shall be computed under Paragraph 6.1.2.3 of the Agreement, utilizing the Lump Sum Method of Compensation with the compensation for this authorization not-to-exceed$30,000.00 as outlined in the attached letter dated June 12, 2001 and manhour fee. Section 3 - Time of Completion 3.1 The CONSULTANT shall provide the design services within a 90 day period (3 months) from the notice-to-proceed. Lakeshore Drive Ocoee, FL 34761 RE: Old Winter Garden Road Project and Wal*mart Project Dear Jim: Following is the revised probable cost estimate for the required Wal*mart improvements along Old Winter Garden Road that will be constructed as part of the City's roadway project consistent with our meeting of June 4, 2001. These improvements consist of: (1) Intersection signalization at Old Winter Garden Road and Blackwood Avenue. (2) Construction of two westbound right turn lanes along Old Winter Garden Road. (3) Construction of the southbound right turn lane at Blackwood Avenue and Old Winter Garden Road intersection. (4) Construction of the Blackwood Avenue improvements south of Old Winter Garden Road. Probable Costs: 1. Construction: $300,000 2. Survey/Design/Permitting: 530,000< 3. Construction Administration: S30,000 • Total $360,000 Wal*mart will still be required to construct the sidewalk along Old Winter Garden Road and for providing the eastbound left turn lanes improvements along Old Winter Garden Road by restriping the existing median areas.
