BACKGROUND/DISCUSSION Subsection C-20 of the City Charter states in part: "...The Mayor shall sign all deeds, contracts. agreements, bonds, notes, obligations and other legal documents of the city..." Documents that fall in this category are put on an agenda for Commission approval with a staff report explaining their purpose and the cost involved. Upon approval by the Commission,the City Attorney signs as to form and legality prior to the Mayor's signing of the document. 'Ihis procedure was put in place to ensure the Commission would be informed of all instances that the City is obligated to expend funds and/or staff time. Occasionally, however, agreements are presented requiring a signature that do not necessarily require Commission action, since there is no expenditure of funds involved. A case in point is the agreement with West Oaks Mall for the Fire Department to present an educational program on Fire Awareness, which is a puppet show. There is no rental fee, but the West Oaks Mall has certain procedures in place and a certificate of insurance coverage is necessary. This part can be handled by staff as a routine matter and there is no additional cost to the City. RECOMMENDATION I recommend the Honorable Mayor and City Commission approve a general authorization for the Mayor to sign agreements for the use of facilities, including West Oaks Mall, when there is no rental cost to the City.
