Rosenthal, Esq., City Attorney A/ ri DATE: September 10, 2002 RE: Freedom Park: Utility Easement with Orange County In connection with the development of Freedom Park, the City has been advised that the Orange County Utilities Department requires an easement around the double detector check valve assembly in accordance with the construction plans for the project. Attached hereto is a proposed Utility Easement which we have prepared in order to respond to this request. Recreation Director.Johnny Farmer has reviewed this matter and recommends approval thereof. RECOMMENDATION It respectfully is recommended that the City Commission approve the Utility Easement in favor of Orange County, Florida in connection with the development of Freedom Park and authorize execution thereof by the Mayor and City Clerk. Lakeshore Drive Ocoee,FL 34761 UTILITY EASEMENT THIS UTILITY EASEMENT is made this day of , 2002, by CITY OF OCOEE, FLORIDA, a municipal corporation duly created and existing under and by virtue of the laws of the State of Florida, whose address is 150 N. Lakeshore Drive, Ocoee, Florida 34761, hereinafter referred to as the "Grantor", in favor of ORANGE COUNTY, FLORIDA, a charter county and political subdivision of the State of Florida, whose address is Post Office Box 1393, Orlando, Florida 32802-1393, hereinafter referred to as "County". Grantor does hereby covenant with the County, that it is lawfully seized and possessed of the real estate above described, that it has a good and lawful right to convey the said easement and that it is free from all liens and encumbrances.
