HomeMy WebLinkAboutIII (A) Approval and Acceptance of Minutes of City Commission Regular Meeting of December 10, 2002 Agenda 12-17-2002 Lf-DpnApir Item III MINUTES OF THE OCOEE CITY COMMISSION REGULAR MEETING HELD DECEMBER 10,2002 CALL TO ORDER Mayor Vandergrift called the regular meeting to order at 7:15 p.m. in the Commission Chambers. David Hartbarger, Minister of the Ocoee Church of Christ, led in prayer. Mrs. Frances Watts led the Pledge of Allegiance to the Flag. City Clerk Grafton called the roll and announced a quorum to be present. PRESENT: Mayor Vandergrift, Commissioners Anderson, Howell, Johnson, and Parker. Also present were City Manager Gleason, City Attorney Rosenthal, City Clerk Grafton, Assistant to the City Manager Shira, Parks/Recreation Director Farmer, Police Chief Goclon, and Customer Service Supervisor Sills. PRESENTATIONS AND PROCLAMATIONS Award Plaque of Recognition to Edwin H. "Doc" Pounds Commissioner Johnson read the biographical article about Doc Pounds which was published in last week's West Orange Times and then presented a proclamation/plaque signed by all the members of the City Commission expressing their appreciation for his service to the citizens of Ocoee in many different ways over the past years. Doc Pounds had also served as Grand Marshal of the Lions Club Christmas Parade. Award Trophies for Annual Christmas Parade Mayor Vandergrift introduced the coordinator for the Lions Club Christmas Parade, Cathy Sills, who then distributed the trophies and awards for the first, second, third and honorable mention winners in the various categories. Presentation by Founders' Day Committee to the City Commission - Chairman Michael Miller Mr. Miller expressed appreciation for the support given to the Founders' Day Committee by the City and the community for the last Founders' Day celebration. He listed the names of volunteers and introduced several who were present. Mr. Miller presented to the Commission a large frame containing an autographed shirt and pictures of Aaron Tippin, the featured singer of the event. Mayor Vandergrift accepted the presentation, thanking the Committee for an outstanding job. Approval and Acceptance of Minutes of City Commission Regular Meeting of November 19, 2002.(City Clerk Grafton) DV Ocoee City Commission Regular Meeting December 10,2002 B. Approval and Authorization for Reappointments to Boards. (City Clerk Grafton) 1. Reappointment of Four Members to CACOPD. The three year terms of Thomas Hendrix, Joel Keller,Robert McKey, and Mark Scalzo end January 1,2003. Each of these volunteers has indicated an interest in being reappointed for another term. Approval of this item will extend these terms to January I, 2006. 2. Reappointment of Pat Cornell to General Employees' Retirement Trust Fund Board for term to end September 30,2004. The General Employees' Retirement Trust Fund Board is made up of two members appointed by this Commission and two members elected by the employees. Those four choose a fifth member to serve and this Commission confirms the appointment as a ministerial act. In regular meeting held November 19, 2002,the Trustees chose Pat Cornell to serve again as the fifth trustee. COMMENTS FROM CITIZENS/PUBLIC Mrs. Frances Watts, 43 Shell Key Court, speaking as the president of the Seniors, thanked those who helped to make the senior citizens comfortable in this area, the City,her family, certain employees, and she listed specific leaders. COMMISSIONERS ANNOUNCEMENTS/CORRESPONDENCE Commissioner Parker 1) Reported she had received many calls regarding trash pickup and the vendor must be advised that will not do. 2) Said she has an appointment with Orange County Commissioner Jacobs and certain Animal Control employees to discuss the issue of animal control service to the City of Ocoee, and she will report back to this Commission. Commissioner Anderson said he went to the National League of Cities Conference in Salt Lake City last week and it was a very fulfilling experience. He suggested the whole commission should attend next year, as there was a great deal to learn. It will be held in Nashville. Mayor Vandergrift 1) Displayed a plaque from the National League of Cities honoring the City of Ocoee for five years of membership and dedicated service. 2) Announced the City Commission's joint meeting with the Parks and Recreation Advisory Board to be held Monday, December 16, at 7:00 p.m. in the Commission Chambers. He invited the public to attend. PUBLIC HEARINGS Second Reading of Ordinance No. 2002-24, Amending Chapter 38 of the Code re the Locational Requirements Governing the Sale of Alcoholic Beverages. (Community Development Director Wagner) (Continued from November 19, 2002, meeting) Page 2 of 5 DnAF Ocoee City Commission Regular Meeting December 10,2002 City Attorney Rosenthal read the title only of the Ordinance. Community Development Director Wagner gave the staff report, noting that, at a prior City Commission meeting, staff had been requested to prepare changes to the requirements governing the sale of alcoholic beverages, as Chapter 38 of the Code of Ordinances of the City of Ocoee imposes certain locational requirements on the sale of alcoholic beverages by the drink within 1,000 feet of an established church or school. This had been accomplished with Ordinance No. 2002-24,which amends Chapter 38,by exempting certain businesses from the 1,000 foot requirement no matter where they are located within the city. The public hearing was opened. Mayor Vandergrift read e-mail statements opposing the adoption of the Ordinance which had been received from Carlos Sarmiento, Pastor of Living Waters Church, Bea Raddick, Admiral Point, Pastor Phillips, VCA Academy, and Eric Green and Deanne Bailey, Glad Tidings Church. Those present in the audience who addressed the Commission speaking against the Ordinance were David Hartbarger, Church of Christ, Jeffrey Cox, 707 Pine Street,Rev. Everette Eastham,Jr., Stark Lake Baptist Church, Michael Miller, 1305 Ridgefield Drive, Pastor Gary Howell, Glad Tidings Church, and Pastor Tom Linowanti, First Baptist Church Ocoee. Carla Baker, representing ChevronTexaco, distributed a paper showing changes to the Ordinance she had proposed to the Planning Department earlier, and she expressed her concerns. After each Commissioner had an opportunity to express an opinion, Commissioner Johnson secondedby Commissiunfr Parker. moved to table this ordinance and form asommittee to study t _ issue 1vlotion 9atned 5-Q. The committee will consist of three developers, three pastors,three citizens at large, one school principal, and one restaurateur. They are Carla Baker, Milton West, Jay Folk, David Hardbarger, Gary Howell, Tom Linowanti, ICC. Cale, Dan Coleman, Terry Reed, Daniel Axtell, and Manfred "Jay" Jenneret. City Attorney Rosenthal advised this committee, as an advisory committee to the City Commission,would be subject to the Sunshine Law, its meetings would be held at City Hall, and minutes would be taken of the proceedings. Commissioner Johnson/Commissioner Anderson moved to refer this ordinance t9 the committee_for study and to authorize City bIarsager_ClZgason,to.rgplac anypftheminted members_who_would not be able to serve, Motion carried 5-0. OTHER BUSINESS Director Prior to the meeting this item was pulled from the agenda by staff. Page 3 of 5 [L L P Ocoee City Commission Regular Meeting December 10,2002 STAFF REPORTS City Manager Gleason distributed information regarding several areas of concern the City Commission may wish to consider in a work session and said he would put setting a date for the work session on the December 17 agenda. COMMENTS FROM COMMISSIONERS Commissioner Parker 1. Said, since Commissioner Anderson came home from Salt Lake City for the Christmas parade, she voted in his place as voting delegate for the City of Ocoee at the National League of Cities Conference. 2. Reported on the many things she had learned at the conference and wants to discuss later: fiscal management, long range planning, spotting problems before they become problems, alternative financing options for cities, collaborative leadership, effective speaking in meetings, developing downtown, product services options, and employee benefit packages. Conunissioner Johnson 1. Proposed looking at a 5 year plan to purchase the Glad Tidings property. City Manager Gleason said he already had a report from Parks/Recreation Director Farmer that will be on the December 17 agenda for consideration. 2. Asked why the police still do not report the dark areas on city streets due to street lights being out. 3. Said the conference was very good, and there was a lot to learn and bring home. Particularly of benefit was the opportunity to sit and talk with representatives from all over the nation. Commissioner Anderson 1. Said he just tried the paperless agenda with hyperlinks on the CD and it was great. 2. Thought this year's parade was the best we have ever had. He thanked the drivers and wished everyone a Merry Christmas and Happy New Year. Mayor Vandergrift 1. Agreed with Commissioner Johnson regarding the police reporting the street lights out. 2. Asked when the Christmas lights will be turned on at the Gazebo. 3. Asked about the status of Freedom Park as he had hoped to have a groundbreaking ceremony. Parks/Recreation Director Farmer said, as the work has already begun, there would be a grand opening instead of groundbreaking. 4. Noted that the lights on the fountain in Starke Lake are not timed with the dawn/dusk and asked that someone change the timer. 5. Thanked Pastor Hartbarger for his help with a 95 year old retired preacher who had a problem with his sidewalk and hedge. He said the chaplains went in and cleaned up and he wants the City to waive the cost of the pickup of the trash. The address is 827 Sabinal.
