BACKGROUND: The Windstone at Ocoee subdivision will include a total of 122 single family residential lots, with 64 lots in Phase 2. The subdivision is located on the south side of Clarcona Ocoee Road, between Clarke Road and Apopka Vineland Road. The southern edge of the subject property abuts the northern boundary of the Sawmill subdivision. Construction on Phase 1 of Windstone at Ocoee began last summer. Except for a few small wood-framed structures in the northern portion of the site, Phase 2 subject property is currently undeveloped and is covered with a large number of trees, consisting of mostly planted pines and numerous oaks of all sizes. The Preliminary Subdivision Plan, known as Clarcona Crossings, was approved in February 2001. DISCUSSION: As shown in the Final Subdivision Plan, Phase 2 of Windstone at Ocoee will have an access point from Clarcona Ocoee Road and a connection to the Orchard Park subdivision to the south, in addition to its two road connections with Phase 1. As with other subdivisions, there will be a 6 foot brick wall with appropriate landscaping along the northern boundary of the subdivision adjacent to Clarcona Ocoee Road. The property has R-1-AA zoning, dictating a minimum lot width of 75 feet (minimum 9,000 sf). A small tract of additional road right-of-way for Clarcona Ocoee Road (Tract 'F'), will be dedicated to the City, in order to accommodate Orange County's current road widening plans for that road. It was shown on the FEMA map at that time as 81.0. A Condition of Approval was placed on the PSP indicating that the project engineer would use his best efforts to pursue a revision to the FEMA 100 year flood elevation prior to approval of the Final Subdivision Plan (FSP) for Phase 2. The City received a notice from FEMA in late September indicating that the 100 year flood elevation had been changed to 71.0, which is reflected on the FSP for Phase 2. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Final Subdivision Plan for Phase 2 of Windstone at Ocoee was reviewed by the Development Review Committee (DRC) on November 19, 2002. There was discussion during the DRC meeting about some outstanding issues which were identified in a DRC staff report. The most significant issues involved grading at the rear of Lots 1 — 5 and Lots 40 -46. The concerns of Staff were explained and the Applicant agreed to comply with Staff recommendations. The Committee voted unanimously to recommend approval of the Phase 2 Final Subdivision Plan, subject to making the revisions to the plans as discussed in the meeting. All of the DRC revisions have now been satisfactorily addressed in the plans received November 26, 2002. PLANNING & ZONING COMMISSION RECOMMENDATION: On December 3, 2002, the Planning and Zoning Commission considered the Final Subdivision Plan for Phase 2 of Windstone at Ocoee. The Applicant's engineer was present to clarify some issues and answer questions. There was a lengthy discussion of cross-connectivity of streets between subdivisions and how it affects traffic flowing through the subdivision. Some of the members felt that connectivity leads to cut through traffic, often at high speeds, resulting in safety problems. Other members disagreed, pointing out that many of those high speed drivers are residents of the community, citing that these same problems occur in gated communities. These members felt that traffic calming devises are needed to solve these problems, not fewer entrances to the subdivision. When the discussion was finished, the Planning and Zoning Commission voted 6 — 2 to recommend approval of the Final Subdivision Plan in accordance with the Staff recommendation. STAFF RECOMMENDATION: Based on the recommendations of the DRC and the Planning and Zoning Commission, Staff respectfully recommends that the Mayor and City Commission approve the Final Subdivision Plan for Phase 2 of Windstone at Ocoee, as date stamped received by the City on November 26, 2002. ADDITIONAL RECOMMENDATION BY THE P & Z COMMISSION: When its discussion was concluded, the Planning and Zoning Commission voted unanimously to have Staff explore the possibility of incorporating more traffic calming devises into the Land Development Code with the revision of the Code currently in progress. The City of Ocoee is subject to the terms, provisions and restrictions of Florida Statutes Chapter 163 concerning moratoria on the issuance of building permits under certain circumstances. The Lift Station shall be constructed with Phase 1. 11. All utility and drainage easements upon individual lots shall be maintained by the lot owner. The land burdened by such easements shall be owned by the individual lot owners. The buffer walls and roads will be designed around those trees to Incorporate them into required landscape buffers and as street trees. 27. The existing grades on individual lots containing protected trees will be maintained as much as possible to preserve existing protected trees. For lots containing protected trees, there will be no grading or other construction on individual lots, except as specified in the Final Subdivision Plan, until building permits are issued for those lots. 28. Homes which are built on lot 40-46 may require an extended ',stemwall foundation to avoid unnecessary filling and preserve asmany protected trees as possible. 29. The developer shall be responsible for constructing the public road connecting the two parcels of property within Phase 1. Construction of the road shall be done in accordance with a Construction Easements Agreement prepared prior to Final Subdivision Plan approval. 30. All utilities to be placed within the 10' easement along the front of each lot will be placed around existing protected trees to be preserved. 31. In order to ensure that as many existing trees as possible will be preserved, all road right-of-ways and retention areas will be flagged for review by the city and the Engineer prior to any tree removal. No clearing permits will be issued for site work or building construction until all trees to be preserved have been clearly marked with tree protection barriers. 32. Removal of existing protected trees will be limited to clearing road right-of-way and retention areas and areas of mass grading as detailed in the Final Subdivision Plan. All existing protected trees on individual lots will be evaluated at the time - a building permit is issued for that lot, to determine whether or not each tree needs to be removed. 33. All existing protected trees located along the Clarcona-Ocoee road wall will be preserved and incorporated into the required landscaping along the wall. The exact location of the Clarcona-Ocoee road wall and all utilities on the site to be located near existing protected trees will be modified as necessary to preserve those existing protected trees. The final design of the Clarcona-Ocoee road wall and the location of new trees and landscaping will be determined when the building permit for the wall is reviewed. 34. Phase 1 final construction can be approved independent from phase 2. 35. The Developer must take such measures as the City attorney may ­require with respect to any potential easements related to the dirt drive along eastern boundary of the property. 36. Prior to or at the time of platting, Tract "D" shall be conveyed to the City by warranty deed in form and substance acceptable to the City free and clear of all liens and encumbrances at the Developer's sole cost and expense. At least twenty (20) days prior to this conveyance, the Developer shall at the Developer's sole cost and expense, submit to the City for review and approval the legal description and sketch of description of Tract "D". The sketch and legal description shall be certified to the City. Contemporaneously with the conveyance of Tract "D", the developer shall provide to the City a current attorneys title commitment to be followed by a title policy. The Developer shall escrow the real property taxes prorated as of the day before the City's acceptance of the conveyance in accordance with the provisions of Section 196.295, Florida Statutes. 37. The entire project will receive water and sewer service from Orange County Public Utilities. However, if the' Water & Sewer Service Agreement between the City of Ocoee and Orange County does' not get approved, lots 90-122 will be provided by City of Ocoee water with individual septic systems, while lots 1-89 will be served by Orange County Public Utilities. 38. The homeowners association shall be responsible for the maintenance and preservation in accordance with good horticultural practices of the tf':es within the easement area. Prior to platting of Phase 2, the subdivision's dec;aration documents shall be ammended to incorporate "a restriction relating to the trees within the easement and setting forth the conditions of maintenance and preservation of the trees and other landscaping within the easement area. The easements in which the temporary cul-de-sacs (hammer heads) are constructed as part of Phase 1 shall terminate at such time as Phase 2 is platted and a Certificate of Completion is issued, for the Phase. 2 infrastructure improvements. 52. The legally assigned name for this subdivision is "Windstone at Ocoee". Pursuant -to ordinance No. 2001-18 all subdivision signage must be consistent with 'the legally assigned name of the subdivision. Any subsequent change to the name of the subdivision must be approved by the City Commission. 53. The grant of easement for Ingress/Egress relating to access over Tract "G" will need to be finalized with the final plat. 54.
