Parker, District 4 MEMORANDUM DATE: December 4, 2002 TO: Honorable Mayor and City Commissioners FROM: Thomas Grimms, AICP, Senior Plalmel THROUGH: Russ Wagner, AICP, Community Development Director SUBJECT: Annexation and Rezoning Petition from Ricardo and Carmen Caballero Case Number AR-01-07-01 Ordinances#2003-03 & #2003-04 ISSUE: Should the City of Ocoee annex and initially zone the above referenced property by adopting Ordinance of annexation 2003-03 & Ordinance of initial rezoning 2003-04? BACKGROUND: The subject property is located approximately 350 feet east of the intersection of Ocoee- Apopka Road and Silver Star Road on the north side of Silver Star Road. The 1.77 acre parcel is vacant and partially tree-covered. The subject property is designated "Commercial" on the Ocoee Future Land Use Map. The applicant has requested an Ocoee zoning classification of C-2, Community Commercial District. The requested zoning would be consistent with the above referenced land use designation. CONSISTENCY WITH STATE AND LOCAL REGULATIONS: With respect to State annexation criteria, Chapter 171.044 of the Florida Statutes grants municipalities the authority to annex contiguous, compact, non-circuitous territory so long as it does not create an enclave. The requested annexation is an enclave. The Legislature recognizes that enclaves can create significant problems in planning, growth management, and service delivery, and therefore declares that it is the policy of the state to eliminate enclaves. The state encourages municipalities to annex an enclave by interlocal agreement with the county having jurisdiction of the enclave. A Joint Planning Area Agreement between Orange County and the City of Ocoee was executed in 1994, which allows for the annexation of enclaves without challenge by the County per Section 6.D. of the Agreement. The subject property is located within the Ocoee-Orange County City of Ocoee• 150 N Lakeshore Drive• Ocoee, Florida 34761 phone: (407)905-3100• fax: (407)656-8504•www.ci.ocoee.[l.as Joint Planning Area (JPA) and is an enclave enclosed within an area bounded on all sides by a single municipality [per 171.031(13)(a) F.S.]. Since the property is an enclave, the property is being considered for annexation as outlined in the JPA Agreement. Thus, the requested annexation is consistent with the JPA Agreement, State annexation criteria, and the standards established by the City. Orange County has been notified of this petition and we have received no comments. DISCUSSION: Staff has completed the attached Annexation Feasibility & Public Facilities Analysis based upon the projected impacts of the proposed commercial retail use. We have determined that the City can adequately provide a range of urban services to the subject property. Should the property owners choose to develop the property in the future, they may be required to make certain improvements. Along the subject property, Silver Star Road is a 40-foot right-of-way. The Ocoee Transportation Master Plan indicates that Silver Star Road is scheduled for widening to 4 lanes between Dillard Street to Clarke Road (Table E-3). The applicants will be required to dedicate 30 feet of frontage for future road widening of Silver Star Road. Applicants have indicated to staff they have no objection and will dedicate such in an Annexation Agreement. The subject property has a Future Land Use designation of "Commercial" on the Joint Planning Area Land Use Map. The properties adjacent on the west, north and south sides are also designated "Commercial" on the Future Land Use Map in the City's Comprehensive Plan (Figure 2). The applicant has petitioned the City to give an initial zoning designation to the subject property of C-2 "Community Commercial District". This requested zoning designation is compatible with the Future Land Use designation. The subject property is adjacent to property zoned C-2 both on the west and north sides, R- T-1 on the east side, C-land R-1 on the south side of Silver Star Road The 2002 assessed value of the subject property is $110,381.00. The applicant stated they intend to develop the property for commercial retail purposes. Staff considers annexation of this property feasible based upon the above considerations. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on November 27, 2002 to review the request for annexation and initial zoning for the property located approximately 350 feet east of the intersection of Ocoee-Apopka Road and Silver Star Road on the north side of Silver Star Road and voted unanimously to recommend approval, subject to execution of an Annexation Agreement, involving dedication of 30 feet frontage for future road widening and reservation of a 30-foot utility easement on the property, as needed. PLANNING & ZONING COMMISSION RECOMMENDATION: The Planning & Zoning Commission met on December 3, 2002 and held a public hearing to review the request by Ricardo & Carmen Caballero for annexation and initial zoning of their property. No one from the public spoke on this issue. There was a discussion on the widening of Silver Star Road in terms of the amount dedication needed from adjacent properties. Staff said that the right-of-way, which is 40 feet wide, will need to be widened to 100 feet to accommodate four lanes between Dillard Street to Clarke Road, as indicated in the Ocoee Transportation Master Plan (ref. Table E-3). There was also discussion concerning which commercial zoning designation would be more appropriate, C-1 or C-2. Staff pointed out that C 1 is quite restrictive in the uses allowed and that C-2 would be more appropriate in this area. The Planning & Zoning Commission voted unanimously to recommend annexation and an initial zoning designation of C-2, conditioned on the execution of an Annexation Agreement involving dedication of 30 feet frontage for future road widening and reservation of a 30foot utility easement on the property, as needed. STAFF RECOMMENDATION: Based on the recommendation of the Development Review Committee and the Planning & Zoning Commission, Staff recommends that the Mayor and City Commission adopt Ordinance 2003-03 & Ordinance 2003-04 to annex and Initially zone the 1.77 acre tract C-2 "Community Commercial District", pending execution of an Annexation Agreement involving dedication of 30 feet frontage for future road widening and reservation of a 36 foot utility easement across the property, as needed. PRELIMINARY CONCURRENCY EVALUATION Thomas Grimms, AICP A. Transportation: At the time of the analysis, daily traffic volumes on the section of SR 438 (Silver Star Road) between Ocoee-Apopka Road and Bluford Avenue were approaching the roadway's adopted daily capacity. This condition may change and will be subject to an official concurrency evaluation during the site plan approval process. The 2002 total daily capacity of this section of SR 438 is 16,600 trips, and the daily traffic volume is 14,563. This figure includes 384 vested trips for which capacity has been reserved through prior development approvals. Accordingly, the roadway is operating at 88 percent of capacity. The entire length of SR 438 through the City of Ocoee (from Dillard Street in Winter Garden to Clarke Road) is currently undergoing a Congestion Management Study and Project Development and Environment Re-evaluation by the Florida Department of Transportation (FDOT) to identify improvements to reduce congestion and enhance the roadway's operation. The four-laning of SR 438 is identified as the ultimate long-term improvement in the City's new 2020 Comprehensive Plan and in the City's 2020 Transportation Master Plan. However, no funding is currently available to construct roadway improvements along the subject section of SR 438 by the City, County, or FDOT. The subject property is located in Neighborhood Service Area 5, which is well- B. Parks & served by existing parks. The subject property is situated between Vignetti Recreation: Park and Sorenson Field, and approximately 1 mile west of Beech Recreation Center. This area has access to Lake Meadow and three City Parks, which are listed above. Together the three City Parks comprise approximately 43 acres. According to the Parks and Open Space Master Plan completed in September, 2001, the projected population for the area is 9,945 which would require 39.75 acres of parkland to meet the adopted Level of Service standard. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. The Ocoee City Commission has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida, Chapters 166 and 171, Florida Statutes, and Section 7 of Article I of the Charter of the City of Ocoee, Florida. SECTION 2. The Ocoee City Commission hereby finds that the petition to annex certain lands, as hereinafter described, into the corporate limits of the City of Ocoee, Florida, bears the signatures of the duly authorized representatives of the City of Ocoee pertaining to the real property proposed to be annexed into the corporate limits of the City of Ocoee, Florida. SECTION 3. SECTION 10. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 11. This Ordinance shall take effect upon passage and adoption. Thereafter the City Clerk is hereby directed to file a certified copy of this Ordinance with the clerk of the circuit court and the chief administrative officer of Orange County, Florida and with the Florida Department of State within seven (7) days from the date of adoption. WHEREAS, the owners (the "Applicant") of certain real property located within the corporate limits of the City of Ocoee, Florida, as hereinafter described, have submitted an application to the City Commission to rezone said real property of Ocoee, from Orange County C-1 "Retail Commercial District" to City of Ocoee C-2 "Community Commercial District"; and WHEREAS, on February 11, 1994, Orange County and the City of Ocoee entered into a Joint Planning Area Agreement (the "JPA Agreement") which affects the future land use of the real property hereinafter described and in turn the zoning designation of the subject property; and WHEREAS, the City and County have mutually agreed to a Future Land Use designation of "Commercial" for the subject property via the 3" Amendment to the Ocoee-Orange County Joint Planning Area Agreement adopted November 2, 1999; and WHEREAS, pursuant to Section 5-9(B) of Article V of Chapter 180 of the Code of Ordinances of the City of Ocoee (the "Ocoee City Code"), the Community Development Department Director has reviewed said application and determined that the zoning requested by the Applicant is consistent with the 1991 City of Ocoee Comprehensive Plan as set forth in Ordinance No. 91-28, adopted September 18, 1991, as amended (the "Ocoee Comprehensive Plan"); and WHEREAS, said zoning application was scheduled for review and recommendation by the Planning and Zoning Commission of the City of Ocoee, Florida (the "Planning and Zoning Commission"); and WHEREAS, the Planning and Zoning Commission has held a public hearing and reviewed said zoning application for consistency with the Ocoee Comprehensive Plan and the JPA Agreement and has determined that the re-zoning requested by the Applicant, and is consistent with the Ocoee Comprehensive Plan and the JPA Agreement and is in the best interest of the City and has recommended to the Ocoee City Commission that the zoning classification of said real property be C-3 "General Commercial District", as requested by the Applicant, and that the Ocoee City Commission find that the re-zoning requested by the Applicant is consistent with the Ocoee Comprehensive Plan and the JPA Agreement; and WHEREAS, the Ocoee City Commission has held a de novo public hearing with official notice thereof and with respect to the proposed rezoning of said real property; and WHEREAS, this Ordinance has been considered by the Ocoee City Commission in accordance with the procedures set forth in Section 166.041 (3)(a), Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. AUTHORITY. The Ocoee City Commission has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida, and Chapters 163 and 166, Florida Statutes. SECTION 2. RE-ZONING. The zoning classification, as defined in the Ocoee City Code, of the following described parcel of land containing approximately 1.79 acres located within the corporate limits of the City of Ocoee, Florida, is hereby changed from Orange County C-1 "Retail Commercial District" to City of Ocoee C-2 "Community Commercial District"; SEE EXHIBIT "A" (METES AND BOUNDS LEGAL DESCRIPTION) ATTACHED HERETO AND BY THIS REFERENCE MADE A PART HEREOF. SECTION 3. MAP. A map of said land herein described which clearly shows the area of rezoning is attached hereto as EXHIBIT "B" and by this reference is made a part hereof. SECTION 4. COMPREHENSIVE PLAN AND JPA CONSISTENCY. The Ocoee City Commission hereby finds the rezoning of the land described in this Ordinance to be consistent with the Ocoee Comprehensive Plan and the JPA Agreement. SECTION 5. OFFICIAL ZONING MAP. The City Clerk is hereby authorized and directed to revise the Official Zoning Map of the City of Ocoee in order to incorporate the rezoning amendment enacted by this Ordinance and the Mayor and City Clerk are hereby authorized to execute said revised Official Zoning Map in accordance with the provisions of Section 5-1(G) of Article V of Chapter 180 of the Ocoee City Code. SECTION 6. INCONSISTENT ORDINANCES. All ordinances or parts of ordinances in conflict herewith are hereby repealed and rescinded. SECTION 7. SEVERABILITY. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto.
