Rosenthal, City Attorney DATE: January 13, 2003 RE: 7u' Avenue—Nutt Property Timelines for possible condemnation Set forth below is a timeline for a possible condemnation action: 1. Identification of property needed, preparation of 30 days sketch and legal description, and survey. 2. Preparation of an appraisal report. 30 days 3. Offer to property owner based on appraisal—open 30 days 30 days pursuant to Florida law. 4. Filing of quick take eminent domain suit and scheduling of 60-90 days Order of Taking hearing. or Filing of slow take eminent domain suit and entry of final 9-12 months judgment. As you can see from the schedule above, al a minimum, I anticipate five to six months to acquire title to property. The cost associated with the pre-condemnation work would he the engineering, survey, and appraisal work which 1 estimate to he $10,000.00. It would be possible to shorten up this phase of the acquisition process. It would require, however, the payment of additional costs to the consultants to expedite the process, possibly as much as 50% 006281951.1 FOLEY& LARDNER FOLEY : LARDNER more. The cost of the acquisition itself would include the land value and the payment of experts' fees and costs incurred on behalf of the property owner. Based on some recent appraisal work I have seen in and around the Ocoee area of residential subdivision land, I would bracket the land value between $20,000.00 and $30,000.00 per acre.
