ISSUE:
Should the Mayor and City Commissioners approve the Final Subdivision Plan for McElroy
Place?
BACKGROUND:
The McElroy Place subdivision will include a total of 127 single family residential lots, located on
the south side of McCormick Road at the intersection of the future Clarke Road extension. This
proposed subdivision is surrounded almost completely on 3 sides by unincorporated Orange
County. The subject property is currently undeveloped and is primarily planted pines. The
southern edge of the subject property abuts a wetland area and Trout Lake. Most of the
surrounding land is wooded or former citrus groves. The property surrounding the proposed
subdivision has Orange County A-1 and RCE-C zoning (north, open non-wooded area), and City
R-1-AA zoning (southwest—pine trees).
The City Commission reviewed the Preliminary Subdivision Plan for McElroy Place on May 7,
2002. Three people from the public spoke expressing concerns over a pedestrian trail, the
affects of a nearby landing strip, potential environmental impacts and availability of schools.
After some discussion, the Commission voted to approve the Preliminary Plan.
DISCUSSION:
As shown in the Final Subdivision Plan, McElroy Place subdivision will have two points of
access, one from McCormick Road and one from the new section of Clarke Road, just south of
McCormick Road. As with other subdivisions, there will be a 6 foot brick wall with appropriate
landscaping along the northern and western boundaries of the subdivision adjacent to
McCormick Road and Clarke Road respectively. The property has R-1-AA zoning, dictating a
minimum lot width of 75 feet (minimum 9,000 sf).

The Final Subdivision Plan accurately reflects the approved Preliminary Subdivision Plan with only a
few minor changes. It may be noted that previously concern was expressed about the use of the
sinkhole along McCormick Road as a retention pond. One of the changes on the Final Subdivision
Plan was to provide a dry retention pond surrounding the sinkhole to treat storm water runoff before it
goes into the sinkhole, thereby minimizing the possibility of contamination of the underground water
supply.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee (DRC) met on March 12, 2003 and reviewed the Final
Subdivision Plan. It was noted by the Developer that the storm water permit for the project had been
approved by the St. John's River Water Management District. There were only two minor outstanding
issues, one involving landscaping on a steep slope and the other involving a jumper connection to the
reuse water system, which will be in place but not operational until such time that reuse water
becomes available. These issues will be handled administratively. It was also noted that certain fees
are still outstanding which must be paid before final approval. The DRC voted unanimously to
recommend approval of the Final Subdivision Plan.
PLANNING & ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission met on March 26, 2003 and reviewed the proposed Final
Subdivision Plan for McElroy Place. Comments were made by property owners adjacent on the east
and west side of the proposed subdivision as well as by the Developer's attorney and consultants.
The issues raised by the property owners included the alignment Clarke Road possibly affecting
some natural springs in the area and protection of the adjacent wetlands as well as a possible Sand
Hill Crane nesting area. It was noted that the Developer had sent a letter to the Community
Development Director, offering to take steps necessary to protect the springs if they were affected by
construction of Clarke Road related to this project. A few of the Commissioners also voiced concerns
about the trees to be removed throughout the site and around the sinkhole and the retention pond
around the sinkhole.
In response to the neighbor's concerns about the springs, Staff pointed out that since this Developer
will not be constructing the portion of Clarke Road that might affect the springs, these issues are well
beyond the focus of what was before the Planning & Zoning Commission at this time, which is the
review of the Final Subdivision Plan for McElroy Place. The protection of the springs will be
addressed when the alignment of that portion of Clarke Road is finalized, designed and permitted.
There will be a conservation easement over the wetlands and the lake to address the protection of the
wetlands and wildlife habitat. The Engineer indicated that the new retention pond around the sinkhole
was designed to treat all storm water runoff before it enters the sinkhole. The Developer's attorney
pointed out that all the Citys land development requirements have been met for the project. When
the discussion was finished, the Planning and Zoning Commission voted unanimously to recommend
approval of the Final Subdivision Plan, provided that additional trees be planted around the sinkhole
area.
STAFF RECOMMENDATION:
Based on the recommendations of the Development Review Committee and the Planning & Zoning
Commission, Staff respectfully recommends that the Mayor and City Commission approve the Final
Subdivision Plan for McElroy Place, as date stamped received by the City on February 3, 2003, with
the planting of some additional trees around the sinkhole.
