SUBJECT: Florida Auto Auction — Roper Property
Land Development Code Waivers
ISSUE:
Should the Mayor and City Commissioners approve waivers from the procedures and
requirements of the Land Development Code to allow the Florida Auto Auction to use the Roper
Property for parking of inventory on a temporary basis and in connection therewith erect a 6'
chain link security fence around the entire site?
BACKGROUND:
The Master Plan (Preliminary/Final Site Plan) for the Florida Auto Auction was approved by the
City Commission in September 2000, which expanded the acreage occupied by the Auto
Auction and provided for certain improvements. The Master Plan provided for paved parking
surfaces over additional areas that the Auction had acquired, and fencing for security over the
entire site. The Master Plan also set forth various Conditions of Approval associated with the
development of the property. Several waivers from various Code requirements were approved
as part of the Master Plan. In conjunction with the Master Plan, the City and Auto Auction
entered into a Development Agreement which imposed certain requirements and restrictions.
DISCUSSION:
The Florida Auto Auction has advised the City that it entered into a lease agreement to use the
property located at the southeast corner of Maguire Road and Geneva Street (the Roper
Property, about 10.5 acres) for parking of inventory on a temporary basis. The Roper Property is
not part of the land included within the Master Plan previously approved by the City. On March
31, 2003, the Auto Auction submitted a fence permit application in connection with their use of
the Roper Property. City staff could not issue the fence permit because it is not permitted by the
Code. Upon further inquiry it was determined that the Auto Auction intends to provide a 6' chain
link security fence around the entire site and provide a 16' wide compacted surface through the
middle of the site to allow access for emergency vehicles (see attached drawing). The fence
along Maguire Road and Geneva Street will include a green windscreen as well. No other
improvements are proposed for the site to accommodate this use.

The City staff has advised the Auto Auction that they do not have the authority to issue the fence
permit or to approve the use of the Roper Property as proposed without the Auto Auction going
through the normal review procedures as described below. The Florida Auto Auction is
requesting waivers from all Land Development Code procedures and requirements that would
normally apply when a site is developed as a commercial parking lot (i.e. —paved surface, storm
water management, landscaping within the parking area, perimeter landscape buffers, lighting
standards, etc.). They are also requesting that they be allowed to use this site for parking of
vehicles, on a temporary basis, with a 6' chain link fence for security and a 16' wide compacted
surface through the middle of the site to allow access for emergency vehicles, as shown on the
attached drawing.
The normal procedure used to review and approve waivers related to site improvements is to
submit an application for site plan review, pay the applicable fees associated therewith and
submit the appropriate site plan drawings, which would be reviewed for compliance with the
Land Development Code. At this point, the only application that has been submitted related to
this request is a fence permit application. The length of the 'temporary' use has not been
established, and it should be noted that this request, if approved, would not be consistent with
any Land Development Code procedures or design requirements.
The City Attorney has advised that action by the City Commission is required in order for the
Auto Auction to utilize the Roper Property as proposed. Should the City Commission approve
the Auto Auction's request, the City Attorney has advised that he would recommend that a length
of time be established for the temporary use and that consideration be given as to the removal of
the fencing and improvements at the end of the temporary use.
Should the Mayor and City Commission wish to approve this request, a motion would
need to be made to waive all procedural requirements, all site plan application
requirements, all site plan design requirements, all building permit requirements, and any
inconsistencies with the prior Master Plan approval and direct staff to permit the Auto
Auction:
a) To utilize the Roper Property for the temporary parking of vehicles subject to the
provision of a 16' wide compacted surface through the middle of the site, as
shown in the attached drawing, to allow access for emergency vehicles acceptable
to the Ocoee Fire Department;
b) To erect a 6' chain link security fence around the entire site with the fence along
Maguire Road and Geneva Street including a green windscreen; and
c) All being subject to the expiration of this temporary authorization ----(_)
months from the date of this approval.
