Parker, District 4 1 STAFF REPORT TO: The Honorable Mayor and City Commissioners FROM: Thomas Grimms, AICP, Senior Planner THRU: Russ Wagner, AICP, Community Development Director DATE: June 10, 2003 RE: Glad Tidings Church Waiver Requests (4) SS-2003-001 Small Scale Site Plan ISSUE: Should the Mayor and City Commissioners grant four (4) waiver requests to Glad Tidings Church related to the church's small scale site plan. BACKGROUND: The subject property is located approximately 700 feet east of the intersection of Ocoee-Apopka Road and Fullers Cross Road on the north side of Fullers Cross Road (see attached location map). The parcel is vacant, pasture land with a few trees. The property adjacent to the east has a residential structure. The property on the south is vacant pasture land and the property to the west is vacant and wooded. The applicant is proposing to build a church on the 9.20 acre parcel. The subject property is designated Low Density Residential (<4 DU/acre) on the Future Land Use Map. The applicant was granted an Ocoee zoning classification of R-1-A, Single-Family Dwelling District when the property was annexed last year. The R-1-A zoning district permits the Church and its ancillary uses upon approval of a Special Exception, which was also approved last year. The initial phase of construction will include a church building of approximately 12,000 sq. ft. with 325 seats. DISCUSSION: The Applicant has completed the site plan review process except for approval of four (4) requested waivers from certain Code requirements as described below. The City Commission has sole discretion to approve waiver requests. Waiver # 1: The 1st waiver request is to delay the construction of a sidewalk leading from the main building to Fullers Cross Road until Phase 2. This request is based on the fact that the surrounding land does not have any development at this time, hence there will be minimum pedestrian traffic. City of Ocoee • ISO N Lakeshore Drive•Ocoee, Florida 34761 phone: 1407)905-3100• fax: (407)656-8504•www.ci.ocoee.tl.us The Honorable Mayor and City Commissioners June 10, 2003 Page 2 of 2 Waiver# 2: Similarly, the 2nd waiver request is to delay the construction of a sidewalk along the width of the property fronting on Fullers Cross Road until Phase 2, because there are no other sidewalks along the adjacent properties and no other buildings in the area to walk to. Waiver # 3: The 3'd waiver request involves a release from the requirement of installing shade trees that are 3.5 inches at DBH (diameter at breast height) and being allowed to install trees that are 2.5 inches DBH instead. The Applicant's justification suggests that these smaller trees will grow to a size that is larger than 3.5 inches by the time Phase 2 is constructed. This affects 24 shade trees to be provided with the first phase. Waiver # 4: The 4th waiver request involves a release from the requirement of having a traffic impact analysis performed at the initial phase of development. The Applicant proposes instead to do the traffic analysis with Phase 2 development and to do any turn lane construction that is recommended by the traffic analysis along with Phase 2 construction. RECOMMENDATION: Staff supports Waivers #1 and # 2 related to the sidewalk requirements, since the surrounding area is vacant land with no sidewalks presently. Staff does not support Waiver # 3 related to the tree size since there is no technical justification for this waiver. Regarding Waiver # 4, the attached letter from the City's traffic consultant, Renaissance Planning Group (see attached letter dated April 29, 2003), emphasizes the need for right and left turn lanes into the site from Fullers Cross Road, but it does not state that these improvements need to be done with the initial phase of development. However, any traffic analysis that is done for Phase 2 will likely require that both left and right turn lanes be provided. The City Commission has sole discretion to approve any proposed waivers from Code requirements. It must be noted, however, that prior to obtaining a building permit for this site, the legal documents conveying 20 feet of road right-of-way and a joint driveway cross access easement for the adjacent property must be executed and recorded, to comply with the Special Exception Conditions of Approval. Based on our recent conversations with City staff and our understanding of the nature of recent Ciry staff correspondence/meetings with the applicant, we generally concur with the applicant's April 17, 2003 responses to our previous review comments. In doing so, we continue to emphasize the need for provision of an eastbound left turn lane and westbound right turn lane on Fullers Cross Road to safely accommodate turning movements into the project site while maintaining adequate traffic flow on Fuller Cross Road. These improvements are predicated as much on safety concerns as on capacity/operational concern- and any traffic study analysis of these improvements by the applicant should fully address all of these issues, It should also be noted that, provided both improve menrs are constructed as part of Phase If of the project, a separate traffic study would not be required. Finally, as noted previously, a map and/or table will need to be provided showing the distribution/assignment of daily project trips onto all functionallyclassified roadways within a one- mile radius of the project site for concurrency database tracking purposes.
