RE: Signature on release of lien documents
ISSUE
Should the Honorable Mayor and City Commission consider amending the existing policy to
allow the Mayor or Mayor Pro-tern to sign release of lien documents when the established Code
Enforcement Board fines and costs,or weed code violations are paid in full?
BACKGROUND/DISCUSSION
Code Enforcement Board orders that establish fines and/or costs and weed code violations that
are recorded in the public records of Orange County become a lien that runs in favor of the City
of Ocoee. To release such a lien requires a representative of the City of Ocoee, usually the
Mayor,to sign the documents.
In the event there is a request to reduce the fine and/or cost, such issue must be considered by the
Mayor and City Commission and such action usually includes the direction for signature.
RECOMMENDATION
Staff respectfully recommends that the existing policy be amended to allow the Mayor or Mayor
Pro-tern to sign any release of lien when all monies due the city have been paid in full.
The city has a duty to release a lien upon payment of all monies and should be accomplished as
soon as possible. Providing for the Mayor or Mayor Pro-tern to sign without being considered by
the entire commission will reduce staff time and allow an expedient release of lien.
