Parker, District 4 STAFF REPORT TO: The Honorable Mayor and City Commissioners FROM: Janet Shira, Assistant to the City Manager DATE: November 18, 2003 RE: Proposed Amendment to the Education Commission membership ISSUE Should the City Commission amend the membership criteria for the Education Commission? BACKGROUND/DISCUSSION The Education Commission has asked to be placed on the December 2nd Commission agenda. At their November meeting, the Education Commission voted to recommend to the City Commission that their board membership be amended to allow for a maximum of three members who do not need to be Ocoee residents. The only parameters the Education Commission wants on those members is that they be either parents of students who attend schools where Ocoee children also attend, or staff members at those schools where Ocoee students may attend. Education Commission Chairman David Morris will be at the December 2"d City Commission meeting on behalf of the Education Commission to answer any questions that the City Commission may have. RECOMMENDATION The Education Commission voted at their November 3rd meeting to recommend to the City Commission to request this change. Cc: David Morris, Education Commission Chairman RESOLUTION NO. 2003- 3q A RESOLUTION OF THE CITY OF OCOEE, FLORIDA RELATING TO THE CITY OF OCOEE EDUCATION COMMISSION; AMENDING ITS MEMBERSHIP REQUIREMENTS; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, on May 19, 1998, the City Commission of the City of Ocoee, Florida (the "City Commission") adopted Resolution 98-07 establishing an advisory body for the general purpose of improving the quality of education for Ocoee students (the "City of Ocoee Education Commission"); and WHEREAS, the City Commission desires to amend the membership requirements of Resolution 98-07. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION ONE. Authority, The City Commission of the City of Ocoee has the authority to adopt this Resolution pursuant Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION TWO. Membership Requirements. Section 5 of Resolution No. 98-07 is hereby amended to read as follows (with additions double-underlined and deletions stricken): Membership. a. The Education Commission shall consist of no less than seven (7) and no more than fifteen (15) members not including a member of the City Commission to be appointed by the City Commission and the City Manager or the City Manager's designee both of whom will serve as ex officio non-voting members. 006.316277.1 b. All members will be appointed by the City Commission from a list of interested persons that have completed the application form for membership on City boards and committees. c. Of the initial members of the Education Commission, one-half of the members (or one more than one-half if the initial Education Commission has an odd number of members) shall be appointed to serve a one (1) year term. The remaining initial members shall serve a term of two (2) years. Thereafter, all members shall serve two (2) year terms and may be reappointed, irrespective of the number of terms previously served. d. All members must reside within the City of Ocoee. Notwithstanding the foregoing, up to three (3) non-residents of Ocoee may be appointed as members if such non-residents meet one the following requirements: i. The non-resident is a parent or guardian of a student and that student attends a school in which other Ocoee students attend; or ii. The non-resident is staff member at a school in which Ocoee students attend. e. Each public school within the City of Ocoee shall have at least one representative member. To qualify as a representative for a particular school, the member shall reside within that school's district and shall be an immediate family member or guardian of at least one student attending that particular school at the beginning of the member's current term. f. All members serve at the pleasure of the City Commission and may be removed for cause at any time. In no event will the Education Commission have the authority to remove any member. 006.316277.1 SECTION THREE. Except as set forth in this resolution, Resolution 98-07 shall remain in full force and effect. Nothing contained in this Resolution shall affect the terms or membership of members serving at the time of adoption of this Resolution. SECTION FOUR. Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION FIVE. Effective Date. This Resolution shall become effective immediately upon passage and adoption. PASSED AND ADOPTED this day of , 2003.
