ISSUE Should the Mayor and City Commissioners approve the Addendum to the Agreement for Consulting Engineering Services with Professional Engineering Consultants, Inc. (PEC). The addendum is for the re-design of the relocation of the water main on Old Winter Garden Road in the vicinity of the Citrus Medical Plaza development. BACKGROUND/DISCUSSION PEC has completed its desi n of the improvements for the Old Winter Garden Road project fisting underground utilities. The water main in the vicinity of _. ealth Central needed to be relocated because of conflicts with proposed stormwater facilities. The Citrus Medical Plaza development is planned to be located on the vacant property across Old Winter Garden Road from Health Central. As part of the approval of the development, they agreed to reimburse the City for the re-design of the water main to allow for their sewage force main to be located in the road right-of-way. The developer also agreed to pay for certain improvements included in the roadway improvements project as opposed to having them torn out and replaced when the project was under construction. PEC has performed the re-design of the water main in the subject area and included that re- design in the roadway plans. The water main re-design has also been permitted through FDEP. PEC's cost to the City is $3,552.00 for the re-design. Attached is a copy of the proposal from PEC. This cost plus the cost for items included in the roadway construction will be passed onto Mr. Berry Walker representing Assisted Care Living at Forest Cove, Ltd. The total cost of the re-design fees and the construction elements is $22, 589.00. RECOMMENDATION Staff recommends that the City Commission approve Addendum 03-04 to the Agreement for Consulting Engineering Services with Professional Engineering Consultants, Inc. for the re- design of the water main to accommodate the Citrus Medical Plaza in the amount of$3,552.00 and authorize the Mayor and City Clerk to execute the addendum. ADDENDUM NO. 03-04 TO AGREEMENT FOR CONSULTING ENGINEERING SERVICES INCLUDING ENGINEERING SERVICES FOR CONSTRUCTION ADMINISTRATION/INSPECTION SERVICES FOR CITY OF OCOEE OLD WINTER GARDEN ROAD/PROFESSIONAL PARKWAY WATER MAIN RE-DESIGN This Addendum No. 03-04 hereinafter called the Addendum, as of this day of 2003,shall constitute an Addendum to the Agreement for Consulting Engineering Services between the City of Ocoee,Florida(the CITY)and Professional Engineering Consultants, Inc., 200 East Robinson Street, Suite 1560, Lake Eola Centre, Orlando, Florida (the CONSULTANT),dated the 21st day of August, 1984,hereinafter referred to as the AGREEMENT. WHEREAS, the CITY and CONSULTANT entered into an AGREEMENT whereby the CITY retained the CONSULTANT to provide professional engineering services as required from time to time, and WHEREAS the CONSULTANT will perform consulting engineering services for the CITY as herein defined. NOW THEREFORE, in consideration of the mutual covenants and promises hereinafter set forth on the part of both parties to be kept and performed, the parties do mutually agree as follows: Section 1 - Services of the Consultant 1.1 The CONSULTANT shall perform the Engineering Services as outlined in the attached proposal(P-3182) dated June 24,2003 relative to the provision of design phase services and construction administration services to the CITY. Section 2 - Compensation 2.1 Compensation by CITY for engineering services for the Reclaimed Water Booster Pumping Facility and Construction Administration/Inspection Services is provided under this K:\ENV\DOCUMENT\OE\OCOEE\2003ADN\03-04ADN.wpd I Addendum shall be computed under Paragraph 6.1.2.3 of the Agreement,utilizing the Lump Sum Method of Compensation with the compensation for this authorization not-to-exceed $3,552 as outlined in the attached proposal(P-3182) and manhour fee. Section 3 - Time of Completion 3.1 The CONSULTANT shall provide the construction administration services within a 365 calendar day period(12 months) from the notice-to-proceed for construction as outlined in the attached proposal. The water main re-design was required due to a proposed permitted 4-inch force main which was scheduled to be constructed(by others)in the same corridor as our proposed 12-inch water main. The 12-inch water main re-design extend along Professional Parkway from Blackwood Avenue to Division Avenue. We performed the engineering re-design services described herein for $3,552. Enclosed for your review is the engineering design man-hour cost estimate shown in Attachment A. We appreciate the opportunity to provide our services for this assignment.
