ISSUE Should the Mayor and City Commissioners approve the Addendum to the Agreement for Consulting Engineering Services with Professional Engineering Consultants, Inc. (PEC). The addendum is for the design and construction services for the reuse main on Old Winter Garden Road and Professional Parkway from Maguire Road to Blackwood Avenue. BACKGROUND/DISCUSSION As part of the expansion of the reuse system within the Ocoee service area, the Old Winter Garden Road and Professional Parkway area falls within the guidelines for the expansion. The area is a growing commercial corridor that uses lots of potable water for irrigation and the entire right-of-way will be torn up during the roadway improvements project. The timing could not be better to extend the backbone of the Ocoee reuse system. The reuse project will include the installation of a 16 inch pipeline within the right-of-way and stubouts to all the existing customers and proposed developments along the corridor. The extension of the reuse pipeline from Maguire Road towards Clarke Road allows for the ultimate connection of those two pipelines that make up backbone of Ocoee's reuse system at this time. PEC has performed the design of the reuse water main in the subject area and included that design in the roadway plans. PEC's cost to the City is $17,950 for the design and $8,704 for the construction services. Attached is a copy of the proposal from PEC. This cost plus the construction of the pipeline will be paid for by the 2003 Utility Bond Fund. The total cost of the addendum is $26,654.00. RECOMMENDATION Staff recommends that the City Commission approve Addendum 03-03 to the Agreement for Consulting Engineering Services with Professional Engineering Consultants, Inc. for the design and construction services for the reuse water main along Professional Parkway and Old Winter Garden Road from Maguire Road to Blackwood Avenue in the amount of $26,654.00 and authorize the Mayor and City Clerk to execute the addendum. ADDENDUM NO. 03-03 TO AGREEMENT FOR CONSULTING ENGINEERING SERVICES INCLUDING ENGINEERING SERVICES FOR CONSTRUCTION ADMINISTRATION/INSPECTION SERVICES FOR CITY OF OCOEE RECLAIMED WATER UTILITY DESIGN This Addendum No. 03-03 hereinafter called the Addendum, as of this day of 2003, shall constitute an Addendum to the Agreement for Consulting Engineering Services between the City of Ocoee,Florida(the CITY)and Professional Engineering Consultants, Inc., 200 East Robinson Street, Suite 1560, Lake Eola Centre, Orlando, Florida (the CONSULTANT),dated the 21st day of August, 1984,hereinafter referred to as the AGREEMENT. WHEREAS, the CITY and CONSULTANT entered into an AGREEMENT whereby the CITY retained the CONSULTANT to provide professional engineering services as required from time to time, and WHEREAS the CONSULTANT will perform consulting engineering services for the CITY as herein defined. NOW THEREFORE, in consideration of the mutual covenants and promises hereinafter set forth on the part of both parties to be kept and performed, the parties do mutually agree as follows: Section 1 - Services of the Consultant 1.1 The CONSULTANT shall perform the Engineering Services as outlined in the attached proposal(P-3069R1) dated June 24,2003 relative to the provision of design phase services and construction administration services to the CITY. Section 2 - Compensation 2.1 Compensation by CITY for engineering services for the Reclaimed Water Booster Pumping Facility and Construction Administration/Inspection Services is provided under this K:\ENV\DOCUMENT\OE\OCOEE\2003ADN\03-03ADN.wpd 1 Addendum shall be computed under Paragraph 6.1.2.3 of the Agreement,utilizing the Lump Sum Method of Compensation with the compensation for this authorization not-to-exceed $17,950 (for Design) and authorization not-to-exceed $8,704 (for Construction Administration Services)as outlined in the attached proposal(P-3069R1)and manhour fee. Section 3 - Time of Completion 3.1 The CONSULTANT shall provide the construction administration services within a 365 calendar day period(12 months) from the notice-to-proceed for construction as outlined in the attached proposal. The Engineering Services include design and construction administration services for a reclaimed water main within the Professional Parkway improvement program. The proposed 16-inch reclaimed water main will extend along Professional Parkway from Maguire Road to Blackwood Avenue. The project estimate(including engineering fees)for this segment is $550,000. The proposed reclaimed water main is a primary segment that will allow the future interconnection of the City's reclaimed water system with reclaimed water from the County's Consery II facility. In addition,the City will be able to provide reclaimed water service along the Professional Parkway corridor to Blackwood Avenue. Bidding for this road widening project is scheduled for August,2003. The short lead time for this Old Winter Garden Road/ Professional Parkway Reclaimed Water Utility Project requires an escalated design schedule. We propose to perform the design engineering services described herein based on an hourly not-to-exceed compensation method not-to-exceed $17,950 and the Construction Administration Services not-to-exceed$8,704 without further authorization from the Owner. Enclosed for your review are engineering design man-hour estimates included in Attachment A and a cost estimate shown in Attachment B. Also included are Construction Administration Services man-hour estimates included in Attachment C and a cost estimate shown in Attachment D. P-3069R1 June 24, 2003 OE/MK-04 Page 8 PROPOSAL CONDITIONS 1. PEC shall provide Project Quality Control Consultant services by this proposal. 2. This Construction Administration/Construction Observation services proposal is based on a not-to-exceed 28 calendar day construction period with PEC office staff personnel normal 40 hour work weeks and on-site personal normal 40 hour work weeks. PEC office staff working hours are from 8:00 a.m. to 5:00 p.m. Monday through Friday. 3. The Owner shall provide additional compensation for construction phase services preformed by PEC in connection with contract time extension beyond the stated not-to-exceed 28 calendar day construction period. Said additional services shall be reimbursed by the Owner to PEC on an hourly basis for time worked at the given rates as provided in this proposal and/or by any future amendments and/or modifications thereto. 4. PEC shall not provide construction related surveying services by this proposal. Contractor shall be required to perform referenced construction related surveying services. 5. The Owner shall provide additional compensation for construction phase services preformed by PEC in connection with additional Owner requested services either beyond that estimated by this proposal or not addressed within the scope of this proposal. Said additional services shall be reimbursed by the Owner to PEC on an hourly basis for time worked at the given rates as provided in this proposal and/or by any future amendments and/or modifications thereto. 6. This proposal provides for very limited PEC review of Contractor Proposed Changes and or Contractor Value Engineering Proposals. However, as it is not possible to forecast time required to perform such reviews or the number of possible proposals that may submitted,cost of such review should be covered by the Contractor. PEC recommends that Owner's Specifications address reimbursement cost for Engineer's review of Contractor Proposed Changes and or Contractor Value Engineering Proposals by the Contractor as part of such proposals.
