Rosenthal, Esq., City Attorney DATE: August 25, 2003 RE: Ocoee Crown Point PUD Agenda Items for September 2 and September 16, 2003 City Commission Meetings Matters related to the Ocoee Crown Point PUD will be considered by the City Commission at the September 2 and 16 City Commission meetings. The items on the September 2 agenda relate to the approval of the Master Plan and the closing of the high school site with the School Board. A complete presentation by City staff and the City's consultants will be made at the September 2 meeting. The items on the September 16 agenda relate to adoption of the PUD zoning ordinance and approval or preliminary and final subdivision plans. Any Commission and public input received at the September 2 meeting will be incorporated into the final plans for the September 16 meeting. An abbreviated staff presentation will be made at the September 16 meeting. While the City Commission is not obligated to approve the PUD ordinance, PSP and FSP at the September 16 meeting, it is likely that failure to adopt would be inconsistent if any approvals are granted at the September 2 meeting. If any member of the Commission is not inclined to approve the PUD zoning and land use plan, the PSP and the FSP, then I would recommend that such member vote against approval of the Master Plan in order to avoid any inconsistency. In order to assist you in understanding, what will be considered at the September 16 meeting,below is a tentative agenda of the items for that meeting: FOLEY&LARDNER 006.307262.1 FOLEY : LARDNER ATTORNEYS AT LAW 1. Ordinance No. 2003 - adopting Ocoee Crown Point DUD Land Use Plan. (Public Hearing) This Ordinance adopts the Ocoee Crown Point PUD and Land Use Plan, including the Conditions of Approval. 2. Approval of Declaration of Conditions of Approval for Ocoee Crown Point PUD. (Not a Public Hearing) This authorizes the Mayor and City Clerk to sign the Declaration regarding the Conditions of Approval. This document is in lieu of the PUD Developer Agreement. 3. Preliminary Subdivision Plan for Ocoee Crown Point PUD. (Public Hearing) Approves the PSP for the entire Ocoee Crown Point PUD. 4. Final Subdivision Plan for Phase I Infrastructure for Ocoee Crown Point PUD. (Not a Public Hearing) Approves the Phase I infrastructure (roads and ponds) for the Ocoee Crown Point PUD. This will become the construction plans for the project and relates to the costs addressed in the First Amendment to the Interlocal Agreement. 5. Approval of First Amendment to Tri-Party Agreement regarding West Orange Trail between Ocoee,Winter Garden and Orange County. (Not a Public Hearing) (TENTATIVE) This relates to the crossing of the West Orange Trail by roads as part of the project. 2 006.307262.1
