Parker, District 4 STAFF REPORT DATE: August 25, 2003 TO: The Honorable Mayor and City Commissioners FROM: Russ Wagner,AICP, Community Development Director 43t) SUBJECT: Ocoee Crown Point PUD Exemption from Requirements to Construct Reclaimed Water Mains ISSUE: Should the Mayor and City Commissioners exempt the Ocoee Crown Point PUD from requirements to install a reclaimed water system? BACKGROUND: Pursuant to Section 174-20.0 of the City Code, upon advise from the City Engineer,the City Commission may find that it is not feasible or not in the best interests of the City to extend reuse transmission lines to a property. Upon said finding, the Commission may exempt the property from the requirement to construct reclaimed water distribution and transmission mains and lines and from the requirement that homes, lots and parcels within such property connect to the City's reuse system. DISCUSSION: The Ocoee Crown Point PUD is located within the Orange County utility service area. The area is, however, within the Ocoee reuse service territory. Unfortunately, reuse transmission mains are not planned to be extended to this property. More importantly, because the property is located at the end of the County's water main line servicing this area, the need to maintain adequate water pressure is critical. Since reuse water is not available to charge the reuse system, potable water will be needed instead. Due to the amount of potable water needed to charge the reuse system, the reuse lines need to be significantly upgraded in size to meet Orange County requirements. Additionally, Orange County would require that a second water meter be purchased from the County with respect to the reuse lines using potable water. This has resulted in a potentially extraordinary cost to install these lines which may make installation economically infeasible. No portion of the reuse lines are being paid for by the Orange County School Board. In order to avoid what could be$150,000—$200,000 in additional costs, Staff is recommending that the City Commission exempt this property from reuse requirements. However, in order to have some flexibility, Staff would include the reuse lines as an Additive/Alternate in the bid package to isolate the cost. Upon receipt of all the bids on the project,the City Commission could then decide to either delete this item or add it back into the project depending on the cost factors involved. The reuse lines are presently induded in the PUD Land Use Plan,the Preliminary Subdivision Plan and the Final Subdivision Plan for Phase 1. If this exemption is not approved, the City Commission would not have the ability to elect to exclude reuse lines at the time of award of the contract since such lines would then be required City of Ocoee• 150 N Lakeshore Drive•Ocoee,Florida 34761 phone: (407)905-3100•fax: (407)656-8504•www.ci.ocoee.fl.us The Honorable Mayor and City Commissioners August 25, 2003 Page 2 of 2 by the Code and the final subdivision plan. if this exemption is approved, the City would have greater flexibility when bidding the project with the final decision being made when the bid is awarded. STAFF RECOMMENDATION: Staff recommends that the City Commission approve the following findings regarding an exemption for the Ocoee Crown Point PUD from the effluent reuse line requirement: Pursuant to Section 174-20.0 of the City Code,the City Commission finds that it is not in the best interests of the City to extend reuse transmission lines to the Ocoee Crown Point property and exempts the Ocoee Crown Point property from the requirement to construct reclaimed water distribution and transmission mains and lines and from the requirement that homes, lots and parcels within such property connect to the City's reuse system; subject to the right of the City as a landowner to, at its option,elect to construct reuse lines as part of the Phase 1 infrastructure for the Ocoee Crown Point PUD in which case this exemption shall no longer be of any force and effect.
