Rosenthal, Esq., City Attorney DATE: August 26, 2003 RE: Ocoee Crown Point: Conveyance of High School Site to School Board ISSUE: Should the City Commission authorize the conveyance of the high school site to The School Board of Orange County pursuant to the Ocoee Crown Point Master Plan? DISCUSSION: At the time of acquisition of the "Coca Cola Property" the School Board contributed monies towards the purchase to pay for lands to be conveyed to the School Board following approval of the Master Plan. The provisions of Paragragh 6(D) of the Interlocal Agreement requires that following completion of the Master Plan and the surveys of the parcels to be conveyed to the School Board, the City will convey to the School Board marketable fee simple title to the School Board Land for no additional compensation. The First Amendment to the Interlocal Agreement requires that the conveyance of the High School Site occur on September 3, 2003. Conveyance of additional portions of the School Board Land will occur as surveys are finalized. The City and School Board have obtained a survey of the High School Site. The High School Site is identified as Tract 5 on the Master Plan. Various easements are also needed by the School Board in connection with the development of the site, including but not limited to drainage easements need for the site to develop as part of a master stormwater drainage system and temporary access easements needed for construction purposes. . Conveyance of title to the land FOLEY&LARDNER 006.307304.1 FOLEY : LARDNER ATTORNEYS AT LAW and the granting of these easements are required prior to the School Board being in a position to commence construction of the high school RECOMMENDATION: It respectfully is recommended that the City Commission approve the conveyance of Tract 5 as shown on the Ocoee Crown Point Master Plan to The School Board of Orange County and authorize the Mayor and City Clerk to execute all documents necessary to accomplish the foregoing, including but not limited to the execution of deeds, easements and other documents related thereto as may be determined by the City Attorney,. 2 006.307304.1
