RE: Christmas Holiday for 2004
ISSUE
City staff is in the process of developing the 2004 Community Calendar. Staff needs direction
on the days that the City will be closed for the Christmas holiday.
BACKGROUND/DISCUSSION
Section 8 of the Personnel Rules and Regulations relates to holidays. (Please see attached
Section 8.01.) It states that when a holiday falls on Saturday or Sunday, the Friday preceding or
the Monday following shall be designated a substitute holiday and observed as the official
holiday.
Specifically with regard to the Christmas holiday, Section 8 states that the City will observe the
day before or the day after Christmas day, to be determined by the City Commission.
Christmas day falls on a Saturday in 2004. (Please see attached calendar.) The federal
government will observe Friday, December 24, 2004 as its official Christmas holiday. Because
the City of Ocoee is closed for typical business functions on two days during the Christmas
holiday, staff needs to know whether the City Commission wants to designate Thursday and
Friday(December 23rd and 24th)as the two days, or whether the Commission prefers to
designate Friday and Monday(December 24th and 27t).
RECOMMENDATION
Staff respectfully requests that the City Commission choose either December 23rd and 24th or
December 24th and 27th, as the days City Hall will be closed for the Christmas holiday in 2004.

2004 Federal Holidays
Federal law(5 U.S.C. 6103)establishes the following public holidays for
Federal employees. Please note that most Federal employees work on a
Monday through Friday schedule. For these employees, when a holiday
falls on a nonworkday— Saturday or Sunday —the holiday usually is
observed on Monday(if the holiday falls on Sunday)or Friday (if the
holiday falls on Saturday).

Note: Friday,December 31,2004 will be treated as a holiday for most Federal employees since
January 1, 2005 falls on a Saturday. See holiday schedule for 2005.
*Independence Day,July 4, 2004,falls on Sunday. For most Federal employees,Monday,July 5, 2004,
will be treated as a holiday for pay and leave purposes.
This holiday is designated as "Washington's Birthday"in section 6103(a)of title 5 of the United States
Code, which is the law that specifies holidays for Federal employees. Though other institutions such as
state and local governments and private businesses may use other names, it is our policy to always refer
to holidays by the names designated in the law.
**December 25, 2004, (the legal public holiday for Christmas Day)falls on a Saturday. For most
Federal employees, Friday, December 24, will be treated as a holiday for pay and leave purposes. (See
5 U.S.C. 6103(b).)

SECTION 8
HOLIDAYS
8.01 Days Observed
A. When a holiday falls on Saturday or Sunday, the Friday preceding or Monday
following shall be designated a substitute holiday and observed as the official
holiday.
B. The observed holidays are:
January 1 New Year's Day
January - Third Monday Martin Luther King, Jr. Day
May - Last Monday Memorial Day
July 4 Independence Day
September- First Monday Labor Day
November- Fourth Thursday Thanksgiving Day
November- Fourth Friday Day after Thanksgiving
December Day Before or After Christmas Day,
as Determined by City Commission
December 25 Christmas Day
Two (2) Personal Days (Floating Holidays)/
One (1) Shift for Fire Department Section 7(k) Schedule Employees
C. The City Manager will determine which departments or operations will be closed
in observance of the holiday.
8.02 Eligibility for Holiday Pay
A. All holidays earned must be taken as time off or paid on the same day that it is
earned.
B. An employee must be on an approved leave for or work the normal schedule of
hours, on the regularly scheduled working day immediately prior to and
immediately following a holiday, in order to qualify for the holiday time or pay.
Absences not approved in advance, including sick call in's may not be approved
depending on whether the employee's excuse and verification of the reason for the
absence are acceptable to management, which, may at its option, require a
doctor's excuse as well as any other evidence it deems necessary.
C. Holiday Pay
1. Full-time non-exempt employees, except those on a 24/48 schedule in the
Fire Department shall be eight(8) hours at their straight time hourly rate.
