Zaitooni, P.E., Deputy Director Public Works/City Engineer DATE: May 18, 2004 RE: Right-of-Way Survey-Orlando Avenue Sidewalk ISSUE: Should the Honorable Mayor and City Commissioners approve$3,000 for Southeastern Surveying from the General Fund Contingency to conduct a right-of-way survey for the sidewalk on the north side of Orlando Avenue, from S. Lakewood Avenue to the east entrance to Sleepy Harbour Condominiums? BACKGROUND AND DISCUSSION: The City has received numerous complaints regarding the safety of the sidewalk on the north side of Orlando Avenue, from E. Lakeshore Drive to S. Lakewood Avenue. Temporary safety measures have been enacted to ensure the safety of the school children by providing a guarded crossing at Sleepy Harbour Drive until such time that the sidewalk issue has been addressed. The subject sidewalk is narrow and is located immediately at the back of the Miami curb. In most sections, the proximity of the sidewalk to the roadway can be corrected except for an approximately 900' segment from S. Lakewood Avenue to the Sleepy Harbour Condominiums where the apparent right-of-way is too restrictive and is bound by a chain link fence. In November 1998, Professional Engineering Consultants provided a report to address the feasibility of correcting the problem which required acquiring an additional 5' of right-of-way in this area. A copy of this report is attached. No survey of the right-of-way limits was ever conducted in the referenced area. Therefore, to ensure the validity of the information in support of any future action, staff recommends a formal right-of-way survey of the north section of Orlando Avenue, from S. Lakewood Avenue to east entrance of Sleepy Harbour Condominiums. Funds are available from the general Fund Contingency. The estimated balance of the General Fund Contingency will be$144,790 after assignment for this project. RECOMMENDATION: Staff respectfully requests the Honorable Mayor and City Commission approve$3,000.00 from the General Fund Contingency for this project; and authorize Southeastern Surveying to proceed with the required survey. November 2, 1998 OE-326 1-1.0 Mrs. Janet Shire,AICA Director of Community Relations City of Ocoee 150 North Lakeshore Drive Ocoee,FL 34761 RE: Orlando Avenue/White Road Sidewalk Reconstruction Dear Janet: At your request,we have completed the preliminary analysis and probable construction cost. estimate for the reconstruction of the sidewalk along the north side of Orlando Avenue/White Road from Lakewood Avenue to the western end of the Sleepy Harbour Condominiums(approximately 1250 feet). As part of our analysis, we conducted a field visit and met with the Florida Power Corporation(FPC)representative to discuss the issues concerning the utility poles along this corridor. It is our understanding that the City is currently negotiating with the Orange Grove property owner to obtain an additional 5 feet of right-of-way along his property. Following are our preliminary assessment and conclusions: 1. It appears that the existing FPC utility poles (transmission and distribution) are within an existing utility easement, and therefore, the cost for relocation, if ' necessary, would be the City's cost(estimated at$3,000 to $5,000 per pole). 2. The existing sidewalk is approximately 4'wide and abuts the existing roadway as shown in the attached exhibits. 3. The proposed plan is to relocate the fence 5 feet to the north and reconstruct the sidewalk farther away from the existing roadway travel lanes. 4. The most cost feasible solution would be to reconstruct the sidewalk as far as practical from the existing roadway between the existing utility poles and to"jog" the sidewalk in front of the utility poles, bringing it closer to the existing roadway, where utility poles are in conflict with this proposed sidewalk (see the attached exhibits). We recommend replacing the existing mountable curb(mismi curb)with a more protective non-mountable curb(type"F'curb). This may be necessary due to the proximity of the existing utility poles to the travel lane. Additionally, this would provide increased protection to pedestrians. 6. Slope easements and temporary construction easements will be required beyond the additional 5 feet of right-of-way. 7. The probable construction cost estimate for reconstructing this sidewalk is$77,000. (see attached spreadsheet for cost breakdown). If you have any questions,please contact me.
