BACKGROUND: Parcel Identification Number: 05-22-28-0000-00-013 Property Size: 20.482 +1-acres General Location: The property is located at 5824 Ingram Road and bordered on the west by the Forest Lake Golf Course. The property is also west and northwest of the intersection of Ingram Road and Clarcona-Ocoee Road. Actual land use, proposed land use, unique features, and plan consistency of the subject property: The property has been used as a horse training area with a barn; there are no other unique features on the property. The property is designated as Low Density Residential on the Ocoee Comprehensive Plan's Future Land Use Map (FLUM) and the Joint Planning Area (JPA) Land Use Map. The applicant's proposed use is for a single-family residential subdivision. The requested rezoning to R-1-AA Single Family Dwelling is consistent with the FLUM and the JPA Land Use Map designations. Both of these zoning classifications are for single- family dwellings; however, there are differences in the criteria for the two classifications: CLASS: CRITERIA: Min.Lot Min. Min.Side Min. Min. The rezoning is also consistent and compatible with the City's surrounding zoning classifications. Subdivisions within the City to the east and northeast are R-1-AA while subdivisions further north on Ingram Road and to the west are R-1-A. When the subject property was zoned R-1-AAA, the Mayor& City Commissioners intent was to bring larger and more expensive homes to increase the tax base for the City. However, since this initial zoning, land values have increased dramatically and, as a result, these larger and more expensive homes are now being built on smaller size lots. With the smaller lot size, more homes can be built in a smaller area increasing tax base over the previous larger lot zoning. Additionally, the added number of lots should not appreciably affect the character of the development in this area. It will also permit the City to negotiate with the developer to ensure the paving of Ingram Road along the front of the property to Clarcona-Ocoee Road. Ingram-Heidrich Rezoning RZ-0403-17 Page 3 of 4 PLANNING &ZONING COMMISSION: On May 11, 2004, the Planning & Zoning Commission held a public hearing concerning the subject property. Staff was questioned after their presentation and clarified the following issues: • The unincorporated area northeast is an Orange County enclave that was created prior to this requested action; • Clarcona-Ocoee Road is scheduled to be 4 laned in 2007 and the dangerous intersection at Ingram & Clarcona-Ocoee Roads is being realigned since it is considered a dangerous intersection with a blind curve and the West Orange Trail crossing; and • Ingram Road in front of this development will have to be improved to meet City road standards and compliment the developer-funded roadway improvements to the north of this project; • The Orange County Public Schools have already purchased a site for a middle school on the west side of Ingram north of this project and are searching for an elementary school site in the area; and • The amenities for this subdivision will be adequate since Staff is anticipating higher end homes on this site. The P&Z Commission then opened the public hearing for comments. The Charles Madden of Madden Engineering, the representative for Centex Homes (the applicant) spoke on behalf of the project. He indicated the rezoning from R-1-AAA to R-1-AA would allow an additional 7 to 8 homes in the subdivision for a total of 55 homes. The square footage of these homes would be 1,900 square feet and the price would be approximately $250,000. He indicated that during the preliminary site plan review and negotiations, he would work with Staff to resolve issues such as improvements to Ingram Road, providing a temporary fix for the intersection at Ingram and Clarcona-Ocoee Roads, and resolve any issues with buffering between the project and the West Orange Trail west of the site. Mary Grier of 5811 Ingram Road (from the unincorporated enclave northeast across Ingram) spoke expressing her concerns over the project. She indicated that homes in this enclave were 2,000 square feet and did not feel this development was compatible with the lifestyle in the neighborhood to the east. Additionally, she also expressed her concern over increased traffic, speeding along Ingram and Clarcona-Ocoee Roads, and the dangerous that intersection particularly when considering the West Orange Trail crossing there. Staff reiterated the roadway improvements are scheduled for 2007 and at that time this intersection would be realigned to improve safety. Staff also indicated that due to the increase in development in that area, these roadway improvements might come faster than the current schedule. Since there were no other oral or written comments for the public hearing, the hearing was closed. After some additional, minor clarifications and questions, the Planning & Zoning Commission, recommended approval of the rezoning for the subject property from R-1-AAA: Single Family Dwelling to R-1-AA: Single Family Dwelling. Ingram-Heidrich Rezoning RZ-04-03-17 Page 4 of 4 STAFF RECOMMENDATION: Based on the P&Z Commission recommendation, Staff recommends that the Mayor & City Commissioners adopt Ordinance 2004-10 to approve the rezoning of the subject parcel located at 5824 Ingram Road from R-1-AAA: Single Family Dwelling to R-1-AA: Single Family Dwelling. RZ-04-03-17: Ingram-Heidrich Rezoning AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, CHANGING THE ZONING CLASSIFICATION FROM OCOEE R-1AAA, SINGLE FAMILY DWELLING DISTRICT, TO OCOEE R-1AA, SINGLE FAMILY DWELLING DISTRICT, ON CERTAIN REAL PROPERTY CONTAINING APPROXIMATELY 20.482 ACRES LOCATED AT THE NORTHWEST CORNER OF THE CLARCONA OCOEE ROAD AND INGRAM ROAD INTERSECTION PURSUANT TO THE APPLICATION SUBMITTED BY THE PROPERTY OWNERS; FINDING SUCH ZONING TO BE CONSISTENT WITH THE OCOEE COMPREHENSIVE PLAN; PROVIDING FOR AND AUTHORIZING THE REVISION OF THE OFFICIAL CITY ZONING MAP; REPEALING INCONSISTENT ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the owner or owners (the "Applicant") of certain real property located within the corporate limits of the City of Ocoee, Florida, as hereinafter described, have submitted an application to the City Commission of the City of Ocoee, Florida (the "Ocoee City Commission") to rezone said real property (the "Rezoning"); and WHEREAS, the Applicant seeks to rezone certain real property containing approximately 20.482 acres, more particularly described in Exhibit "A" attached hereto and by this reference made a part hereof, from Ocoee R-1AAA, Single Family Dwelling District, to Ocoee R-1AA, Single-Family Dwelling District; and WHEREAS, pursuant to Section 5-9(B) of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida (the "Ocoee City Code"), the Director of Planning has reviewed said Rezoning application and determined that the Rezoning requested by the Applicant is consistent with the 1991 City of Ocoee Comprehensive Plan as set forth in Ordinance #91-28, adopted September 18, 1991, as amended (the "Ocoee Comprehensive Plan"); and WHEREAS, said Rezoning application was scheduled for study and recommendation by the Planning and Zoning Commission of the City of Ocoee, Florida (the "Planning and Zoning Commission"); and WHEREAS, on May 11, 2004 the Planning and Zoning Commission held a public hearing and reviewed said Rezoning application for consistency with the Ocoee Comprehensive Plan and determined that the Rezoning requested by the Applicant is consistent with the Ocoee Comprehensive Plan and is in the best interest of the City and recommended to the Ocoee City ORDINANCE NO.2004-10 Commission that the zoning classification of said real property be rezoned as requested by the Applicant, and that the Ocoee City Commission find that the Rezoning requested by the Applicant is consistent with the Ocoee Comprehensive Plan; and WHEREAS, on June 15, 2004 the Ocoee City Commission held a de novo advertised public hearing with respect to the proposed Rezoning of said real property and determined that the Rezoning is consistent with the Ocoee Comprehensive Plan; and WHEREAS, this Ordinance has been considered by the Ocoee City Commission in accordance with the procedures set forth in Section 166.041 (3)(a), Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. AUTHORITY. The Ocoee City Commission has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters 163 and 166, Florida Statutes. SECTION 2. REZONING. The zoning classification, as defined in the Ocoee City Code, of the Property described in Exhibit "A" containing approximately 20.482 acres located within the corporate limits of the City of Ocoee, Florida, is hereby changed from Ocoee R-1AAA, Single Family Dwelling District, To Ocoee R-1AA, Single Family Dwelling District. A map of said land herein described which clearly shows the area of Rezoning is attached hereto as Exhibit "B" and by this reference is made a part hereof. SECTION 3. COMPREHENSIVE PLAN. The City Commission hereby fmds the Rezoning of the lands described in this Ordinance to be consistent with the Ocoee Comprehensive Plan. SECTION 4. ZONING MAP. The City Clerk is hereby authorized and directed to revise the Official Zoning Map of the City of Ocoee in order to incorporate the Rezoning enacted by this Ordinance and the Mayor and City Clerk are hereby authorized to execute said revised Official Zoning Map in accordance with the provisions of Section 5-1(G) of Article V of Chapter 180 of the Ocoee City Code. SECTION 5. CONFLICTING ORDINANCES. All ordinances or parts of ordinances in conflict herewith are hereby repealed and rescinded. SECTION 6. SEVERABILITY. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto.
