Through the Ocoee Commons PUD Development
ISSUE
Should the Mayor and City Commission approve the designing of the upsizing on the reuse main
and the relocation of the sewer force main through the Ocoee Commons PUD Development and
authorize Public Works Department to employ the services of Design Service Group, Inc. (DSG,
Inc.).
BACKGROUND/DISCUSSION
The Ocoee Commons PUD Development is planned for the area between Blackwood Avenue,
north of SR 50, and the West Orange Professional Center north to the Highlands of Ocoee
subdivision. The development will include commercial, medium density residential, and low
density residential developments and a roadway system that will join SR 50 to Montgomery
Avenue. The development will also be installing water, sewer, and reuse mains for their
development in accordance with City standards.
The City currently has a reuse distribution system along Clarke Road from the Orchard Park
subdivision on the north end to the West Oaks Mall on the south end of Clarke Road. There is
also a reuse distribution system along Maguire Road from Roberson Road north to Professional
Parkway. This southern service area will be expanded during the improvements to Old Winter
Garden Road and Professional Parkway to add the area from Maguire Road east to Blackwood
Avenue. In looking at the map this leaves a missing link between Old Winter Garden Road at
Blackwood Avenue and Clarke Road at White Road.
In designing for the upsizing of the reuse mains through the Ocoee Commons development this
would start to fill in that missing link to connecting Ocoee's two reuse service areas. The
upsizing would only be for the pipeline running from the intersection of Blackwood Avenue and
SR 50 north to where the new development connects to Montgomery Road. Staff proposes to
upsize the pipeline to 16 inch diameter to match the pipelines on Clarke and Maguire Roads.
The project would be bid with both options and the developer would pay for the pipeline
required by their development and the City would pay for the difference from installing the 16
inch pipeline and the 8 inch pipeline needed by the developer. The approval of the construction
dollars will be brought to the City Commission after the project bids are received for separate
approval. This project has been coordinated with the developers, Ustler Fagan, Inc., and they are
all for getting reuse water to their development. DSG Inc. is the engineer of record for Ustler
Fagen on the Ocoee Commons PUD development.
In addition, this development site is in line with where the relocated force main from SR 50
would generally be located. Because of the leaks of the SR 50 force main and the relocation
needed because of the future widening of SR 50, the force main can be relocated to the Maine
Street right-of-way and be upsized at the same time. The new force main would only be
designed where it runs through the Ocoee Commons development at this time.
By performing the design at this time and in using the service of DSG, Inc., it allows the City to
save money on the design because we are using the same engineer and they are using their
survey and background design data. If the City were to perform the design by itself and do all
the work from the start, the design costs would probably be triple what DSG, Inc. is proposing.
In addition if the City waits to perform the design and construction at a later date, after the
development has been built out, the costs would be significantly higher than those expected if we
perform the work while the development is being constructed.
DSG, Inc. proposed fee for design and permitting of the pipeline projects is $9,950 plus
expenses. It is anticipated that those expenses will not exceed $1,000. Therefore the projected
design services will not exceed $10,950. This project will be funded through the Waste Water
Capitol Funds account.
RECOMMENDATION
Staff recommends that the Mayor and City Commission approve the employment of Design
Service Group, Inc. to perform the design of the upsizing of the reuse main and new master force
main through the Ocoee Commons PUD development. In addition, staff recommends that the
Mayor and City Commission approve the award of the design to Design Service Group, Inc. in
the amount not to exceed $10,950 and authorize staff to prepare a contact for execution at a later
date.

Dear Mr. Wheeler:
We appreciate the opportunity to offer our proposal to provide Site Engineering services for the above-
referenced project. We have included an allowance for the time needed to coordinate our efforts with
City staff or other consultants whose services may be required to complete the sanitary force main design.
Our proposal is based on the utilization of geotechnical, environmental engineering, and surveying
services previously performed for and certified to our client, the PUD developer, Ocoee Commons, LLC.
Further, this proposal assumes that the design and specifications for the City sanitary force main will be
provided within the Ocoee PUD Final Subdivision Plans, prepared for Ocoee Commons, LLC, by
modifying and/or adding information or specifications to the final plans as necessary for the City to
review, approve, permit and bid the construction as a separate line item within those plans and
specifications. The intent of these services is to assist the City in the planning and construction of utility
infrastructure concurrently with the installation of Ocoee Commons PUD subdivision improvements.
The limits of our sanitary force main design and route are based on the reduced size, partial subdivision
plan sketch attached herewith. Our proposal assumes that you have obtained permission from Ocoee
Commons, LLC to modify their plans and utilize their subconsultant services. Any increase in our scope
of services or additional subconsultant services (i.e., surveying, geotechnical) will be considered
Additional Services and invoiced separately per our Standard Rate Schedule, Exhibit "A," contained
within the Contract for Engineering Services attached herewith.
We are forwarding herewith two `original" copies of our proposal. Should you find our proposal
acceptable, please sign both copies and return one to our office. We will be able to commence work
immediately upon their receipt.

CONTRACT AND AGREEMENT
This Agreement made and entered into this day of , 2004 by
and between the CITY OF OCOEE, (hereinafter called the CITY), and DESIGN SERVICE
GROUP, INC. (hereinafter called the ENGINEER). WITNESSETH that whereas the CITY
wishes to pursue the design, permitting,and construction of a City of Ocoee Sanitary Force Main
in conjunction with the completion of the Ocoee Commons PUD Subdivision improvements.
BASIC SERVICES
The ENGINEER agrees to perform professional services in connection with the project
as hereinafter stated.
A. The ENGINEER will act as the CITY'S professional engineering representative
for the design and permitting of the project and for the administration of the
construction contracts as hereinafter stated, and will give consultation and advice
to the CITY during the performance of said services.
B. Upon execution of the Contract and Agreement,the ENGINEER will consult with
the CITY to determine the CITY'S requirements for the project and recommend
as to the necessity or advisability of his providing or obtaining services or data
from others, i.e., soil borings, subsurface investigations, laboratory test, prior
engineering data or feasibility analysis, title searches, ownership and
encumbrance reports, surveys,topographic surveys,etc.
II. PLANNING & PRELIMINARY ENGINEERING SERVICES
The ENGINEER agrees to conduct an initial planning and preliminary analysis in
accordance with the following:
A. Prepare a Preliminary Sanitary Force Main Plan within the Ocoee Commons PUD
development limits. The force main ± 2,000 LF route will cross the PUD in an
East-West direction and lie generally within existing or newly platted public road
right-of-ways and/or Utility Easements, based on criteria provided by CITY, in
accordance with the Conceptual Sketch Plan attached herewith. Submit to CITY
for review.
B. Attend Predesign Conference with the City Engineering staff members to review
the Preliminary Plan. Revise per comments received.
C. After the preliminary design is finalized and has received CITY approval, one
copy of the Preliminary Plan shall be signed by the CITY and provided to the
ENGINEER. This plan will be used as the basis for preparation of Final Plans
and shall become Exhibit"B"of this contract.

III. ENGINEERING DESIGN AND PERMITTING SERVICES
The ENGINEER agrees to provide professional engineering design services for sanitary
force main construction as follows:
A. Design up to 2,000 LF sanitary force main improvements by modifying or adding
information or specifications to the Ocoee Commons Final Subdivision Plans.
B. Permitting-The following permits will be applied for:
1) City of Ocoee approval.

System Permit or exemption.
C. Prepare an Engineer's Estimate of Quantities and Costs for the CITY's review
and use in bidding the work.
D.. Forward Site Plans to franchise power, telephone and cablevision companies to
assist in their planning for the routing, layout and advance scheduling of electrical
and telephone distribution systems in coordination with the project's architect.
E. Coordinate with Surveyor on his preparation of any easement descriptions or
Ocoee Commons Plat modifications that may be required by the CITY or utility
companies.
F. The CITY shall be furnished with six (6) copies of the construction plans upon
completion of the permitting process.
G. The ENGINEERS make no representations to the CITY that they are capable of
obtaining permit approvals for any specific force main route or design. The
ENGINEER does represent they will design and permit utility improvements in
accordance with CITY criteria to the extent possible.
IV. PERMITTING ADMINISTRATION
The ENG INFER agrees to provide permitting assistance services to assist the CITY in
obtaining required permit(s) approval. The ENGINEER will act as liaison between the
CITY and governmental agencies in initial permit application and resubmittals in
response to regulatory agency comments. The ENGINEER will prepare and file
applications for permits and will assist the CITY in obtaining necessary permit approvals.

V. CONTRACT A DM IN ISTRATION
The ENGINEER agrees to provide the following services to assist the CITY in the
administration of the construction documents and to assure that the work is performed in
an acceptable manner:
A. Attend a preconstruction conference. if required.
B. Review and approve or reject shop drawings. schedules, samples, tests and other
data which the contractors may be required to submit, to determine ifsuch data is
in accordance with the plans and specifications.
C. Provide two (2) periodic site construction inspections during construction.
Review site contract monthly draw requests on behalf of the CITY if received
prior to inspection.
D. Perform a final inspection of the sanitary force main improvements as required by
the Florida Department of En\ironmental Protection, with respect to design and
construction standards and pro\ide certifications of completion.
The ENGINEER has no duty to control or supervise the contractor's means,
methods. techniques. and sequences of construction or compliance with safety
codes
VI RESPONSIBILITY OF THE CITY
A. The CITY shall furnish and:or pay all costs incident to core boring probing. and
subsurface explorations, en\ironmental assessment, laboratory tests and similar
data which are not provided to the CITY by Ocoee Commons,
B. The CITY shall obtain and furnish to the ENGINEER any such duly executed
performance and:Or warranty bonds, certificates of title, ownership and
encumbrance reports, etc., as may be required by any applicable regulatory
agencies.
C. The CITY shall pay all fees required by any applicable regulator agencies.
D. The CITY shall pay monthly progress payments, based upon percentage of
completion of each design phase. Payment is due fifteen 15 i days after receipt of'
each request for payment. All late payments are subject to a 1.5% sell ice charge
per month.
E. Upon acceptance of this Agreement, the CITY agrees to pay a Zero Dollar
(SO.00) retainer. The retainer shall be refunded to the CITY throughout execution
of the contract based upon percentage of'completion.

VII TERMINATION OF ACREEMI':NT
This Agreement is subject to termination by the CITY or the ENGINEER upon seven (7)
days written notice In the event of any termination, the E:NOINEER will be paid tier all
services rendered to the date of termination. Upon written request by the CITY, the
ENGINEER will supply one (1) copy of all reports. plans. specifications and other
documents related to the project. The plans and specifications shall remain the property
of the ENGINEER.
XIII. NOT INCLUDED
The L:NGINh :R has not accounted for in this proposal the following: attendance of
hearings with respect to Variances, Special Exceptions, Rezoning, Annexation,
Courtroom Hearings and Testimony, or changes to Gmernmental'Utility Regulations or
Policies that affect the project. The ENGINEER makes no representation with respect to
Concurrency or the ability of existing utility infrastructure to support the «ori. as
proposed. Structural design of walls or any structure not related to sanitary force main
improvements is not included. Design of oft'-site utilities (i e , sewer mains, area lift
stations, water distribution systems. storm sewer, etc.) is not included unless specified
herein,
IX, ADDITIONAL, CONDITIONS
A. The only warranty or guarantee made by ENGINEER in connection with the
services performed hereunder is that ue will use that degree of care and skill
ordinarily exercised under similar conditions b. reputable members of our
profession practicing in the same or similar locality. No other warranty.
expressed or implied, is made or intended by our proposal for consulting services,
by our furnishing oral or written reports, or by furnishing drawings and
specifications
B. The Cl'Il' understands the predesign survey limitations. The location of existing,
underground utilities shown on the design plans will be determined based upon
the best information available, without benefit of physically excavating to obtain
exact locations. The aboveground predesign survey, local municipality utility
records, and available as-built surveys will he used for a basis-of-design,
