Should the Mayor and City Commissioners approve the Final Subdivision Plan for Adair
Pointe Subdivision?
BACKGROUND:
The Adair Pointe property includes 11 lots on about 3.52 acres of land. The property is
located on the east side of Adair Street approximately 1,400 feet north of Wurst Road,
between Vignetti Park and Sorenson Field. The subject property is currently
undeveloped and is covered with trees.
The surrounding land to the north is developed with garden apartments, zoned R-3; to
the south is the Glad Tidings Church, zoned R-2; to the east are the ball fields of
Sorensen Park, zoned R-1; to the west are single-family residential units, zoned R-1.
DISCUSSION:
In the Annexation Agreement, the property owner agreed to provide additional road
right-of-way for Adair Street. Sheet C-3 of the Final Subdivision Plan shows the 25 feet
of additional right-of-way dedicated by the Applicant to the City.
This subdivision will not be gated. There will be a 6 -foot brick wall with appropriate
landscaping on both sides of the entrance with the wall extending northward along Adair
Street to the north boundary of the subdivision. Water and wastewater will be provided
by the City.
The developer was granted one waiver from the normal Code requirement of one (1)
recreational amenity for a subdivision with 10- 50 lots.

The justification listed in the waiver table on Sheet C-3 for not having any recreational
amenity located within subdivision is that the developer would pay fees in lieu of
installing recreational facilities inside the subdivision.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee met on March 23, 2004 and reviewed the Adair
Pointe Final Subdivision Plan. There was discussion of the various comments by the
City Attorney, which were the only outstanding comments. The DRC voted unanimously
to recommend approval of the Final Subdivision Plan subject to the comments of the
City Attorney being incorporated into a revised Final Subdivision Plan prior to the
Planning and Zoning Commission meeting. Staff has reviewed the revised Final
Subdivision Plan, date-stamped April 7, 2004, and finds that all of the City Attorney's
comments have been addressed.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
On April 13, 2004, the Planning and Zoning Commission considered the proposed Final
Subdivision Plan for Adair Pointe. The City Staff and the Developer's Engineer
answered questions about recreation amenities, as well as about existing trees on the
site and tree protection. The idea of requiring more trees to be planted to replace the
large number of trees being removed, or requiring larger trees to be planted was
discussed. There seemed to be a consensus that the City should consider requiring
developers to replace trees that must be removed to accommodate new development.
When the discussion was finished, the Planning and Zoning Commission voted
unanimously to recommend approval of the proposed Final Subdivision Plan for
Adair Pointe, per the Staff recommendation, with five (5) trees [4" DBH] to be
planted along the north side of the retention pond, instead of two (2) trees as
currently shown on the plan.
STAFF RECOMMENDATION:
Based on the recommendations of the Development Review Committee and the
Planning and Zoning Commission, the Staff recommends that the Mayor and City
Commissioners approve the Final Subdivision Plan for Adair Pointe Subdivision
to the City Commission, as date stamped received by the City on April 7, 2004,
with five (5) trees [4" DBH] to be planted along the north side of the retention
pond, instead of two (2) trees as currently shown on the plan.

CONDITIONS OF APPROVAL
1. THE CITY OF OCOEE IS SUBJECT TO THE TERMS, PROVISIONS AND RESTRICTIONS OF FLORIDA
STATUES CHAPTER 163 CONCERNING MORATORIA ON THE ISSUANCE OF BUILDING PERMITS UNDER

2. STORMWATER MANAGEMENT SHALL BE PROVIDED CONSISTENT WITH THE REQUIREMENTS OF THE OCOEE
LAND DEVELOPMENT CODE AND THE ST. JOHNS RIVER WATER MANAGEMENT DISTRICT.
3. ALL FINISHED FLOOR ELEVATIONS SHALL EXCEED THE 100 YEAR FLOOD ELEVATION BY A MINIMUM
OF ONE FOOT.
4. ALL ONSITE UTILITIES INCLUDING ELECTRICAL, CABLE TV AND TELEPHONE SHALL BE PLACED
BELOW GROUND.
5. UNLESS OTHERWISE NOTED, A 5' UTILITY AND DRAINAGE EASEMENT WILL BE PLATTED ALONG ALL

10. THE DEVELOPER SHALL CONSTRUCT APPROPRIATE CURB CUTS TO ENABLE CONSTRUCTION OF RAMPS
AT ALL RIGHT-OF-WAY INTERSECTIONS (AND OTHER AREAS AS REASONABLY REQUIRED) IN ORDER
TO ACCOMMODATE ACCESS TO SIDEWALKS AND STREETS FOR PERSONS WHO ARE IN WHEELCHAIRS
AND OTHER PERSONS WHO ARE PHYSICALLY CHALLENGED. SIDEWALKS ABUTTING EACH PLATTED
LOT SHALL BE CONSTRUCTED AT THE TIME A HOUSE IS CONSTRUCTED ON THE LOT. WHEN
SIDEWALKS ARE CONSTRUCTED ON CORNER LOTS AT CERTAIN LOCATIONS, THE SIDEWALKS
WILL BE EXTENDED TO THE CURB AND THE APPROPRIATE RAMPS WILL THEN BE CONSTRUCTED.
11. ALL UNDERGROUND UTILITIES SHALL COMPLY WITH ORDINANCE NO. 95-17, WHICH REQUIRES
PEDESTAL - MOUNTED UTILITY BOXES TO BE PLACED BACK OFF THE STREET, NO MORE THAN
5 FEET FORWARD OF THE FRONT BUILDING SETBACK LINE,ON ALL RESIDENTIAL LOTS WHICH
ARE LESS THAN 70 FEET IN WIDTH WHERE THE LOT ABUTS THE STREET RIGHT-OF-WAY LINE.
12. NO PERSON SHALL UNDERTAKE LAND CLEARING OR THE REMOVAL OF ANY PROTECTED TREE
WITHOUT FIRST OBTAINING A PERMIT FROM THE BUILDING DEPARTMENT. THE REMOVAL OF
PROTECTED TREES SHALL BE MINIMIZE TO THE MAXIMUM EXTENT POSSIBLE AND NO
AUTHORIZATION SHALL BE GRANTED TO REMOVE A TREE IF THE DEVELOPER HAS FAILED
TO TAKE REASONABLE MEASURES TO PRESERVE SPECIMEN AND HISTORIC TREES.
13. EXISTING TREES 8" OR LARGER (OTHER THAN CITRUS TREES OR "TRASH" TREES) LOCATED
ALONG PROPOSED LOCATIONS OF BUFFER WALLS OR ROAD RIGHT-OF-WAY LINES WILL BE
PRESERVES IF AT ALL POSSIBLE. THE BUFFER WALLS AND ROADS WILL BE DESIGNED
AROUND THOSE TREES TO INCORPORATE THEM INTO REQUIRED LANDSCAPE BUFFERS AND AS
STREET TREES.
14. THE EXISTING GRADES ON INDIVIDUAL LOTS CONTAINING PROTECTED TREES
WILL BE MAINTAINED AS MUCH AS POSSIBLE TO PRESERVE EXISTING PROTECTED TREES.
FOR LOTS CONTAINING PROTECTED TREES, THERE. WILL BE NO GRADING OR OTHER
CONSTRUCTION ON INDIVIDUAL LOTS, EXCEPT AS SPECIFIED IN THE FINAL
SUBDIVISION PLAN, UNTIL BUILDING PERMITS ARE ISSUED FOR THOSE LOTS.
15. IN ORDER TO ENSURE THAT AS MANY EXISTING TREES AS POSSIBLE WILL BE PRESERVED, ALL
ROAD RIGHT-OF-WAYS AND RETENTION AREAS WILL: BE FLAGGED FOR REVIEW BY THE CITY AND
THE ENGINEER PRIOR TO ANY TREE REMOVAL. NO CLEARING PERMITS WILL BE ISSUED FOR
SITE WORK OR BUILDING CONSTRUCTION UNTIL ALL TREES TO BE PRESERVED HAVE BEEN
CLEARLY MARKED WITH TREE PROTECTION BARRIERS.
16. REMOVAL OF EXISTING PROTECTED TREES WILL BE LIMITED TO CLEARING RIGHT-OF-WAY AND
RETENTION AREAS AS DETAILED IN FINAL SUBDIVISION PLAN. ALL EXISTING PROTECTED
TREES ON INDIVIDUAL LOTS WILL BE EVALUATED AT THE TIME A BUILDING PERMIT IS
ISSUED FOR THAT LOT, TO DETERMINE WHETHER OR NOT EACH TREE NEEDS TO BE REMOVED.
17. RETENTION POND TRACTS "A" & "B" TO BE OWNED AND MAINTAINED BY THE HOMEOWNERS ASSOCIATION

19. ALL ACCESS RIGHTS TO ADAIR STREET SHALL BE DEDICATED TO THE CITY, EXCEPT AT THE
APPROVED LOCATION SHOWN ON THIS PLAN.
20. ALL EXISTING STRUCTURES (INCLUDING PAVEMENT, POWER LINES, FENCES, ETC.), AS WELL
AS EXISTING UTILITY EASEMENTS, WILL BE REMOVED AND/OR TERMINATED PRIOR TO OR DURING
CONSTRUCTION OF THE DEVELOPMENT REPLACING THOSE USES.
21. ALL LEGAL INSTRUMENTS, INCLUDING BUT NOT LIMITED TO THE DECLARATION OF EASEMENTS,

TO THE PROJECT, SHALL BE PROMPTLY REPAIRED BY THE DEVELOPER TO THE APPLICABLE
GOVERNMENT STANDARDS AT THE DEVELOPER'S SOLE COST AND EXPENSE.
23. THERE SHALL BE NO ACCESS FROM THE PROPERTY TO ADAIR STREET EXCEPT AT THE APPROVED
LOCATION SHOWN ON THE PLAN.
24. STREETLIGHTS WILL BE INSTALLED BY THE DEVELOPER PRIOR TO CERTIFICATE OF COMPLETION
AT HIS EXPENSE, AND THE COST OF OPERATIONS WILL BE ASSUMED BY THE DEVELOPER

29. PURSUANT TO ORDINANCE #2001-18, ALL SUBDIVISION SIGNAGE MUST BE CONSISTENT WITH THE
LEGALLY ASSIGNED NAME OF THE SUBDIVISION. THE LEGALLY; ASSIGNED NAME OF THE SUBDIVISION
IS "ADAIR POINTE." ANY SUBSEQUENT CHANGE TO THE NAME OF THE SUBDIVISION. MUST BE APPROVED
BY THE CITY COMMISSION.
30. A.) NOTWITHSTANDING THE CONVEYANCE OF THE STORMWATER RETENTION PONDS TO THE
PROPERTY OWNERS ASSOCIATION ("THE ASSOCIATION") OR ANY PROVISIONS TO THE CONTRARY
CONTAINED IN THESE CONDITIONS OF APPROVAL, THE DEVELOPER SHALL REMAIN RESPONSIBLE
FOR THE MAINTENANCE OF THE PROJECT'S STORMWATER MANAGEMENT SYSTEM (SWMS),
INCLUDING ALL STORMWATER RETENTION PONDS, UNTIL SUCH TIME AS :(I) THE ENTIRE SWMS
FOR THE PROJECT IS CONSTRUCTED AND APPROPRIATE CERTIFICATES OF COMPLETION ISSUED BY
BOTH THE CITY AND THE SJRWMD, (II) THE STORMWATER RETENTION PONDS INTENDED TO BE
CONVEYED TO THE ASSOCIATION HAVE IN FACT BEEN CONVEYED TO THE ASSOCIATION,
(III) THE ASSOCIATION IS DESIGNATED AS THE MAINTENANCE ENTITY ON THE RECORDS OF THE
SJRWMD AND ALL TRANSFER RECORDS REQUIRED BY SJRWMD HAVE BEEN EXECUTED AND
ACCEPTED BY SJRWMD, (IV) THE CITY HAS BEEN PROVIDED WITH A COPY OF THE
DEVELOPER'S PROPOSED MAINTENANCE PLAN WITH RESPECT TO THE SWMS, AND (V) THE
CITY HAS BEEN PROVIDED WITH A WRITTEN STATEMENT FROM THE ASSOCIATION
ACKNOWLEDGING RECEIPT OF THE DEVELOPER'S PROPOSED MAINTENANCE PLAN WITH RESPECT
TO THE SWMS AND THAT THE ASSOCIATION IS RESPONSIBLE FOR THE MAINTENANCE OF THE
SWMS.
B.) ALL DECLARATION OF COVENANTS AND RESTRICTIONS AFFECTING THE PROPERTY SHALL
INCLUDE THE FOLLOWING PROVISIONS:

MAINTAIN/REPAIR THE SWMS AND OBTAIN REIMBURSEMENT FROM THE
ASSOCIATION, OR FROM THE DEVELOPER IF (1) TURNOVER OF CONTROL TO THE
MEMBERS HAS NOT OCCURRED, OR (II) IF THE DEVELOPER IS STILL RESPONSIBLE FOR
MAINTENANCE OF THE SWMS.
III. PROVISIONS PROVIDING THAT THE SWMS WILL BE TRANSFERRED TO A
RESPONSIBLE OPERATION/MAINTENANCE ENTITY ACCEPTABLE TO THE CITY IN THE
EVENT OF DISSOLUTION AND THAT IF DISSOLUTION OCCURS WITHOUT SUCH APPROVAL

LIENS WITH RESPECT THERETO NOTWITHSTANDING THE DISSOLUTION OF THE
ASSOCIATION.
IV. PROVISIONS THAT THE ASSOCIATION SHALL AT ALL TIMES BE IN GOOD STANDINGS
WITH THE FLORIDA SECRETARY OF STATE.
V. PROVISIONS THAT AT THE TIME OF TURNOVER OF CONTROL OF THE ASSOCIATION
TO THE MEMBERS, THE DECLARANT SHALL (DELIVER TO THE NEW BOARD OF DIRECTORS
THE MAINTENANCE PLAN FOR THE SWMS ACCOMPANIED BY THE ENGINEER'S
CERTIFICATION THAT THE SWMS IS FUNCTIONING IN ACCORDANCE WITH ALL
APPROVED PLANS AND PERMITS. TO THE EXTENT THAT ANY SUCH ENGINEER'S REPORT
INDICATES ANY CORRECTIVE ACTION IS REQUIRED THE DECLARANT'S SHALL BE REQUIRED
TO DILIGENTLY UNDERTAKE SUCH CORRECTIVE ACTION AT THE DECLARANT'S EXPENSE
AND TO POST A CASH BOND WITH THE ASSOCIATION FOR THE ESTIMATED COSTS OF
SUCH CORRECTIVE ACTION.
VI. PROVISIONS THAT NO PROPERTY OWNED BY THE CITY OR ANY OTHER
GOVERNMENTAL ENTITY SHALL BE SUBJECT TO ASSESSMENTS LEVIED BY THE
ASSOCIATION.
VII. PROVISIONS THAT ANY AMENDMENT TO ANY PROVISION AFFECTING THE CITY
REQUIRES THE CONSENT OF THE CITY IN AN INSTRUMENT RECORDED WITH THE
AMENDMENT.
Vill. THE ARTICLES OF INCORPORATION AND BYLAWS OF THE ASSOCIATION SHALL
BE CONSISTENT WITH THE FOREGOING PROVISIONS.
31. THE LANDSCAPE BUFFER/EASEMENT ALONG ADAIR STREET SHALL HAVE
SHADE TREES PLANTED EVERY 30 FEET AND SHRUBS PLANTED ALONG
AT LEAST 25 % OF THE LENGTH OF THE WALL. THE WALL SHALL BE
CONSTRUCTED AT' LEAST 5 FEET BACK FROM THE ROAD RIGHT-OF-WAY
LINE.
32. ALL SCREEN WALLS, LANDSCAPE BUFFERS, ENTRY AND CORNER
LANDSCAPE IMPROVEMENTS, AND SIDEWALKS ALONG ADAIR
STREET AND ADJACENT TO COMMON AREAS ALONG THE ENTRANCE
ROAD SHALL BE COMPLETED PRIOR TO ISSUANCE OF THE
CERTIFICATE OF COMPLETION FOR THE SUBDIVISION IMPROVEMENTS.
33. A STREET TREE SHALL BE PROVIDED BY THE HOME BUILDER AT
THE FRONT OF EACH LOT PRIOR TO ISSUANCE OF A CERTIFICATE
OF OCCUPANCY FOR THE HOUSE CONSTRUCTED ON THAT LOT. EACH
TREE SHALL BE A SHADE TREE AND SHALL BE A MINIMUM OF 2" DBH
AND 10' TALL AT THE TIME OF PLANTING.
34. THE PLAN SHOWS AVAILABLE PAD SIZE FOR REFERENCE ONLY. FOR
EACH INDIVIDUAL LOT, THE BUILDINGS SHALL NOT EXCEED 40%
LOT COVERAGE AND THE TOTAL OF ALL IMPERVIOUS SURFACES
SHALL NOT EXCEED 50 % LOT COVERAGE.
35. ALL UTILITIES TO BE PLACED WITHIN THE 10' EASEMENT ALONG

GENERAL NOTES
1. These inlets are suitable for bicycle and pedestrian areas and are to be used in ditches,
medians and other areas subject to infrequent traffic loadings but are not to be placed
in areas subject to any heavy wheel loads.
2. Inlets subject to minimal debris should be constructed without slots. Where debris Is a
problem inlets should be constructed with slots. Slotted Inlets located within roadway
clear zones and In areas accessible to pedestrians shall have traversable slots. The
traversable slot modification /s not adaptable to inlet Type H. Slots may be constructed
at either or both ends as shown on plans.

J. Steel grates are to be used on all inlets where bicycle traffic /s anticipated. Steel grates
are to be used on al/ Inlets with traversable slots. Either cast Iron or steel grates may be
used on inlets without slots where bicycle traffic is not anticipated. Either cast Iron or
steel grates coy be used on all inlets with non -traversable slots. Subject to the selection
described above, when Alternate G grate Is specified in the plans, either the steel grate,
hot dipped galvanized after fabrication, or the cast iron grate may be used, unless the
plans stipulate the particular type.
4. Recommended maximum pipe sizes shown are for concrete pipe. Pipe sizes larger than
8" those recommended must be checked for fit.
5. All exposed corners and edges of concrete are to be chamfered 10

6. Pavement to be used on inlets without slots and inlets with non -traversable slots only
when called for In the plans: but required on all traversable slot inlets. Cost to be
included in contract unit price for inlets. Quantities shown are for information only.
7. Traversable slots constructed in existing inlets shall be paid for as inlets partial,

C ENERAL LANDSCAPE NOTES
I. ALL PLANTS TO BE FLORIDA NO. I, OR BETTER AS OUTLINED UNDER '&RAVES AND
STANDARDS FOR NURSERY PLANTS, PART I, 1963 AND PART 11, STATE OF FLORIDA
DEPARTMENT OF ASRICULTURE, TALLAHASSEE, FLORIDA, AND ANY AMENDMENTS THERETO.
2. ALL TREES AND PLANT MATERIAL SHALL BE PLANTED IN AGGORDANCE WITH THE
SPECIFICATIONS DESCRIBED IN THEN STATE DEPARTMENT OF AGRICULTURE AND CONSUMER
SERVICES, DIVISION OF FORESTRY, "TREE PROTECTION MANUAL FOR BUILDERS AND
DEVELOPERS", OCTOBER, 1980.
3. THE LANDSCAPE CONTRACTOR (CONTRACTED BY OWNER, N.I.G)
SHALL BE RESPONSIBLE FOR ALL MATERIALS AND ALL WORK AS GALLED FOR ON THE
LANDSCAPE PLANS. THE LIST OF PLANT QUANTITIES ACCOMPANYINS THE PLANS SHALL
BE USED AS A GUIDE ONLY. IF A VARIATION OCCURS BETWEEN THE PLANS AND THE
PLANT LIST, THE PLANS SHALL CONTROL.
4. ALL TREES, SHRUBS AND &ROUND COVERS SHALL BE PLANTED USING A SOIL MIXTURE
PREPARED ACCORDINGLY (2/3 EXISTINS SOIL, 1/5 PEAT).
5. THE LANDSCAPE CONTRACTOR SHALL INSURE ADEQUATE VERTICAL DRAINA&E IN ALL
PLANT BEDS AND PLANTERS. VERTICAL DRILLING THROUGH ANY COMPACTED FILL TO
NATIVE SOIL SHALL BE AGGOMIOLISHW TO AID DRAINASE.
6. ALL PLANT BEDS AND TREE WATERING BASINS SHALL BE TOP DRESSED WITH THREE
INCHES (3") OF SHREDDED CYPRESS MULCH.
1. NO TREES SHALL BE PLANTED CLOSER THAN 5 FEET (39 FROM THE EDGE OP PAVEMENT
TO ALLOW ADEQUATE TREE TRUNK PROTECTION .
6. LANDSCAPE CONTRACTOR SHALL BE WHOLLY RESPONSIBLE FOR STABILITY AND PLUMB
CONDITION OP ALL TREES AND SHALL BE LESALLY LIABLE POR ANY DAMA&E CAUSED
BY THE INSTABILITY OF ANY PLANT MATERIAL.
9. ALL LAWN AREAS TO RECEIVE SOD SHALL BE DISKED FOUR(4) TO SIX(6) INCHES AND
DRA66E0 TO ESTABLISH A LEVEL FINISH GRADE. ALL DEBRIS TO BE REMOVED FROM
THE SITE.
10. SOD SHALL BE FREE OF WEEDS AND PESTS. IT SHALL BE LAID EVENLY AND ROLLED,
WITH TIGHT FITTING JOINTS. THE SOD SHALL CONTAIN MOIST SOIL WHICH DOES NOT FALL
APART OR TEAR WHEN LIFTED. ALL AREAS NOT PAVED OR OTHERWISE LANDSCAPED
SHALL BE SODDED. SOD SHALL BE ARGENTINE BAHIA OR EQUAL.
II. ALL LANDSCAPE AREAS TO BE IRRIGATED WITH AN AUTOMATIC UNDERGROUND SYSTEM,
WITH 100% COVERASE,BACKFLOW PREVENTOR, 4 RAIN SENSOR DEVICE.
DIRECT SPRAY HEADS AWAY FROM ANY NATURAL AREAS AND PAVED SURFACES.
12. THE TREE CALIPER OF ALL TREES SPECIFIED ON THE PLANT LIST SHALL BE AT LEAST
TWO (2) INCHES IN DIAMETER WHEN MEASURED AT FIFTY POUR (64) INCHES ABOVE &RADE.
