Background Summary:
Content of Variance Request
The applicant, Nasim Chaudhry, is requesting approval for a minimum required lot width variance from 70 feet
to 65.56 feet in order to meet the City of Ocoee Single Family Dwelling (R-1) zoning requirements.
The subject property was a result of a recent lot split from plots 22, 23, and half of 21 of the Hillcrest Heights
Ocoee Subdivision Plat M. The lot split resulted in two lots, one with a width of 70.03 feet, and the other, the
subject lot, with a width of 65.56 feet. The original zoning of Orange County R-1 allowed a minimum lot width of
50 feet, but upon annexing into the city, the property now requires a minimum lot width of 70 feet to conform to
City of Ocoee Single Family Dwelling (R-1) zoning requirements.
According to Subsection 4-9 A., the variance application/applicant must demonstrate:
(1) That special conditions and circumstances exist which are peculiar to the land, structures, or required
subdivision improvements involved and which are not applicable to other lands, structures, or required subdivision
improvements.
No special conditions and circumstances exist, which are peculiar to the land or existing structure as indicated
on the aerial and location map attach.
(2) That a literal interpretation of the provisions of these regulations would deprive the applicant of rights
commonly enjoyed by other properties with similar conditions.
Prior to annexing into the City of Ocoee, the lot was well above Orange County's minimum lot width
requirement of 50 feet, similar to adjacent properties. Upon annexing into the city, the lot must now meet the
City of Ocoee's R-1 zoning minimum requirements of 70 feet. If a lot width variance is not granted, the
applicant would not meet zoning requirements in order to construct a single-family residence.
(3) That the special conditions and circumstances do not result from the actions of the applicant.

There are no special conditions and/or circumstances that pertains to the property.
(4) That the granting of the variance requested will not confer on the applicant any special privilege that is denied
by these regulations to other lands, structures, or required subdivision improvements under similar conditions.
The surrounding properties are zoned as "R-1" Single-Family Dwelling with some having a lot width of 50 feet.
Granting a 65.56 minimum lot width variance to the applicant will allow for construction of a single-family
dwelling on the property.
Issue:
Should the Honorable Mayor and City Commission approve a variance request by the applicant for a minimum
required lot width from 70 feet to 65.56 feet at 1108 E. Silver Star Rd. Parcel # 17-22-28-3624-01-210?
Development Review Committee Recommendation:
On August 6th, 2019, the DRC met to determine if the requested variance to the lot was consistent with the City's
regulations and intent for the sale of land. The Development Review Committee voted unanimously to
recommend approval of the variance to the minimum required lot width.
Planning and Zoning Committee Recommendation:
The proposed variance request by Nasim Chaudhry was reviewed at a public hearing by the Planning and Zoning
Commission August 13, 2019. The Planning and Zoning Commission voted unanimously to recommend approval
of the variance request.
Recommendations:
Staff respectfully recommends that the Honorable Mayor and City Commission recommend approval of a
variance to the minimum required lot width from 70 feet to 65.56 feet at 1108 E. Silver Star Rd. owned by Nasim
Chaudhry, subject to completion of staff comments.
