Ocoee, FL 34761 Commission District#3 — Richard Firstner Background Summary: Content of the Variance Request The applicants, Salima Jassani and Ghulam Hyder, are requesting approval for a maximum allowed impervious coverage area variance from 50% to 54.8% for an 884 square foot screen enclosed patio with brick pavers. Impervious surface coverage is referred to as the percentage of the lot land area that is covered with impervious materials such as buildings, swimming pool decks, decks, patios, driveways, etc. The subject property is Lot 98 of the Windsor Landing Subdivision Plat 54, and is within the City of Ocoee Single- Family Dwelling (R-1AA)zoning. Its Orange County Parcel Identification Number(PIN) is 32-22-28-9285-00-980. According to Article IV, Section 4-9A of the Ocoee Land Development Code, the variance application/applicant must demonstrate: (1) That special conditions and circumstances exist which are peculiar to the land, structures, or required subdivision improvements involved and which are not applicable to other lands, structures, or required subdivision improvements. The property is part of Phase 2 of the Windsor Landing Subdivision, a planned neighborhood development consisting of 214 single family homes. It was approved for construction by the city in February 2000. No special conditions and circumstances exist, which are peculiar to the land or existing structure as indicated on the aerial and location map attached. (2) That a literal interpretation of the provisions of these regulations would deprive the applicant of rights commonly enjoyed by other properties with similar conditions. The applicant is subject to the same regulations and rights as other properties with similar conditions under the existing zoning designation and Land Developmental Code (LDC). The applicant can construct a screen enclosed patio in the rear of the property while still meeting the 50% maximum impervious coverage requirement by reducing its size. (3) That the special conditions and circumstances do not result from the actions of the applicant. 1 As a planned neighborhood consisting of 214 single family homes, all special conditions and circumstances were resolved prior to the city granting final site approval. There are no special conditions and/or circumstances pertaining to the property. (4) That the granting of the variance requested will not confer on the applicant any special privilege that is denied by these regulations to other lands, structures, or required subdivision improvements under similar conditions. The surrounding properties are zoned as "R-1AA" Single-Family Dwelling with a 50% maximum allowed impervious surface area. Granting a variance to the applicant will allow for other properties to apply for relief of the required 50% maximum impervious surface area. The granting of this variance will confer special privileges to the applicant that are not currently granted to other lands, structures, or required subdivision improvements under similar conditions as shown on the zoning map attached. As indicated on the Impervious Area Calculation Sheet, the proposed patio would result in 54.8% impervious area for the parcel, which is 4.8% above the allowed amount for the R-1AA zoning. This requirement was established at the inception of the site/subdivision to provide for proper stormwater drainage of the properties within the subdivision. Ocoee Land Development Code (LDC)Article V, Section 5-4J states that an open porch may extend into the rear yard in residential districts provided that it does not increase the maximum impervious surface of the lot to be greater than fifty (50) percent. Furthermore, the applicant does not satisfy the four criteria contained in Article IV, Section 4-9A of the LDC. Issue: Should the Honorable Mayor and City Commission approve a variance request by the applicant to increase the property's maximum allowed impervious coverage area from 50% to 54.8%? Planning and Zoning Committee Recommendation: The proposed variance request by Salima Jassani and Ghulam Hyder was reviewed at a public hearing by the Planning and Zoning Commission on September 10, 2019. The Planning and Zoning Commission voted 4-1 to recommend approval of the variance request. Recommendations: Based on the findings stated above, staff does not find the variance requested by the applicants as supportable. Staff recommends that any decision be conditioned on factual interpretation of code requirements and public testimony related to such provisions, should the Honorable Mayor and City Commission recommend making a finding consistent to staff.
