Planner Hinespresented a brief overview of this proposed annexation and rezoning for 8807
Hackney Prairie Road, which is located on the north side of Hackney Prairie Road approximately
2,683 feet east of N. Clarke Road.The Parcel ID Numbers are 03-22-28-0000-00-052 & 03-22-
28-0000-00-101.Theparcels total approximately 2.13 acres,and one parcel has one (1) existing
single-family home.The subject property is considered contiguous to the City of Ocoee since it
is bordered by property located within the City limits on the north, east, and south.The proposed
annexation is a logical extension of the City limits, urban services can be provided, and the
annexation meets state and local regulations.Theparcels arecurrently zoned Orange County
Rural/Agricultural (A-1), and the proposed rezoning is City of Ocoee Low Density Residential
(R-1A).The applicant is annexing into the city limits as a condition to receive acity potable
water connection.Once the parcels are annexed, the City will receive approximately $3,500 per
year from property tax.
Development Review Committee (DRC) Recommendation:
On October 1, 2019, the DRC met to determine if the proposed annexation and rezoning was
consistent with the City’s regulations and policies. When the discussion was finished, the DRC
voted unanimously to recommend approval of the annexation and rezoning for the Daka
Property.
Staff Recommendation:
Based on the above analysis and the subsequent DRC recommendation, Staff recommends that
the Planning & Zoning Commission, acting as the Local Planning Agency, recommend approval
of the annexation and rezoning from “Orange County” A-1 (Rural / Agricultural) to “City of
Ocoee” R-1A (Single Family) of the property known as the Daka Property.
Discussion:
The applicant wasnot present for questions.
The Board had no questions or comments.
Chair Kelleropened the public hearing and asked if there wasanyone present who wishedto
speak on this proposed project. As no one wished to speak, the public hearing was closed.
Chair Kellerquestioned the location of the 6-inch water main, which indicates “West Avenue”
on the Annexation Feasibility Analysis form. Development Services DirectorRumerindicated
that is a scrivener’s error and explained the water main is just west of this property.

B.Land Development Code (LDC) Amendment to Article VI and Article VIIISignage
Standards.(Advertised in the West Orange Times on Thursday, September 26, 2019)

Development Services DirectorRumer presented a brief PowerPoint on this proposed Land
Development Code (LDC) Amendment, which entails moving the Commercial and Industrial
signage fromLDCArticle VI, Section 6-14into LDC Article VIII,Section 8-4solely for
signage. Staff is also adding new signage criteria in Article VIII to facilitate signage for urban
developmentswithin the downtown overlay.He advised the Board these proposed LDC
amendments are currently fluid, adaptive and evolving works in progress.
Development Review Committee (DRC) Recommendation:
The Development Review Committee (DRC) met on Tuesday, October 1, 2019 and reviewed the
proposed amendment. The DRC voted to recommend approval of the language as proposed.
Staff Recommendation:
Staff recommends that the Planning and Zoning Commission recommend approval of the
proposed amendments to the Land Development Code to provide for regulations of signage.
Discussion:
Vice-ChairWilliamssaid she understands why this code is being moved, but is concerned that
creating flexibilitywithin the codemay generateuncertainty. Development Services Director
Rumerunderstood her concernand explainedexamples of different types of wall signage; and
further, indicated limitingarchitecturaldetailto fit a sign would be inappropriate.Vice-Chair
Williamsinquired about changes taking place withinthe CRA,and whether that includes this
particular LDC signage. Development Services Director Rumeranswered the CRA isnot
implementingany changes with the LDC. Their projects utilize the CRA tax increment funds to
better the CRA.

Member Mellenmentioned under Section 8-4 “Prohibited Signs” ismentioned twice.
Development Services Director Rumerclarified this is currently work in progress,and
“Prohibited Signs”has not been worked out as of yet. Member Mellensaidhe hasconcerns
about voting on something that is not in its final form.
Chair Kellerwent through the recommendations and announced several scrivener’s errorsto
which Development Services Director Rumerclarifiedwhy there are scrivener’s errors; and
stated again,the LDC amendments are a fluid, evolving works in progress.Member Lomneck
asked if this item should be tabled until the next meeting to give staff time to finalize it.
Discussion ensued regarding recommendations from the Board of different types of signage.
Chair Kelleropened the public hearing and asked if there wasanyone present who wishedto

C.Land Development Code (LDC) Amendment to Article V, Section 5-4 and
Section 5-4.1, Residential Fencing.(Advertised in the West Orange Times on Thursday,
September 26, 2019) (Zoning Manager Gajadhar)(6:39pm)
Zoning Manager Gajadhar presented a PowerPoint explainingthis proposed amendment to the
LDC. Currentlythe requirements for residential fencing is listed in both Ocoee Land
Development Code Article V, Section 5-4,Open Space Requirements of Zoning Districts, as
well as Article V, Section 5-4.1,Fences.This has created some confusion with residents
regarding what fencing requirements need to be met in residential areas. Staff is proposing that
all references to fencing be moved from Article V, Section 5-4to Article V, Section 5-4.1,which
specifically addresses fences.Two additions to the LDC are being proposed; 1) Requirement for
all fences four (4) feet in height and under be no more than 50% opaque, and 2) All fences
within residential areas must have up to a two-inch variable setback from adjacent property lines
to avoid encroachment on neighboring properties.
Development Review Committee (DRC) Recommendation:
On October 1, 2019, the DRC met to determine if the requested changes were consistent with
the city’s process for amending the Land Development Code. The Development Review
Committee voted unanimously to recommend approval of the amendments.
Staff Recommendation:
Staff respectfully recommends that the Planning and Zoning Commission recommend approval
of the amendments to the Ocoee Land Development Code in Article V, Section 5-4 as well as
Article V, Section 5-4.1 for residential fencing.

Discussion:
Member Wunderlichasked if there will be provisions for an owner to seek an exemption or
modificationto which Zoning Manager Gajadharresponded in the affirmative.
Vice-Chair Williamshadconcerns regarding the two-inch variable setback where one property
owner may feelas if they are losing two inches of property while the other owner gains; and
further, if both neighbors each have a fence,there will be a four-inch void in betweenfences.
Zoning Manager Gajadharexplainedbecause of the different variations in fencing, each fence
will be taken on a case-by-case basis.
Member Mellenasked whether this would affect shared fencing. Development Services
DirectorRumerexplained there are a lot of variations with fencing,along with different ways
to installthem. This variable is being proposed in order to keep the fence from hanging over the
other neighbor’s property. However, ifsomeonewantedto tie into their neighbor’s fence, they
couldfill out a Joint Fence Permit.
Chair Kellerraised concernsregarding back-to-back fencingwith a four-inch void where a lawn
mower cannot reachwhich would contribute to the problem of long grass, snakes and mice. He
suggestedto make this proposed variable greater in order to mow and clean up in between the
fencing.Development Services DirectorRumerunderstood his concerns, but said he believes
any larger variation will create access issues.He advised the Board these proposed LDC
amendments are currently fluid and evolvingworksin progress.

D.Land Development Code (LDC) Amendment to Article III, Subsection A of
Section 3-2, Alternate Board Member. (Advertised in the West Orange Times on Thursday,
September 26, 2019) (Development Services Director Rumer)(7:15pm)
Development Services Director Rumer presented a PowerPoint explainingthis proposed
amendment to Article III, Subsection A of Section 3-2proposing to appoint six (6) members to
comprise the Planning and Zoning Commission, including one (1) alternate member appointed
by the City Commission, and one (1) nonvoting member appointed by the School Board of
Orange County.This proposal of an alternate member will requirethemto attend meetings,
allowfeedback,and join in the discussions. If there is a full quorum, they will not be able to
vote; however, if a regular member has a conflict or is absent, they will then be able to vote.

Development Review Committee (DRC) Recommendation:
The Development Review Committee (DRC) met on Tuesday, October 1, 2019 and reviewed the
proposed amendment. The DRC voted to recommend approval of the language as proposed.
Staff Recommendation:
Staff recommends that the Planning and Zoning Commission recommend approval of the
proposed amendments to the Land Development Code to add a provision to Article III,
Subsection A of Section 3-2 of the Planning and Zoning Commission to add one (1) alternate
appointed member by the City Commission, and one (1) additional member appointed by the
School Board of Orange County as a non-voting member.
Discussion:
Member Wunderlichasked whowill make the determination of who will be the alternate out of
the six nominees.Development Services Director Rumerclarified that currently the members
are voted on by the City Commission. Chair Kellerindicated he believes the language needs to
be revised. Discussion ensued regarding the language within the ordinance.
Assistant City Attorney Crosby-Collierclarified that the City Commission will be appointing
the newly-appointed member as the alternate.
Discussionensued regardingappointments, resignations and term limits with regards to this
board.The language within the proposed ordinance was discussed.
Assistant City Attorney Crosby-Collierproposed to revise the language within the ordinance
to read “The highest ranked six (6) nominees will comprise the five (5) member Planning and
Zoning Commission,and one (1) will be appointed as the alternate member.”
Chair Kellerresponded either that languageor “The highest ranked five (5) nominees will
th
comprise the five (5) member Planning and Zoning commissionand the sixth (6) highest will
be the alternate member.”
Vice-Chair Williamsasked about term limits to which Assistant City Attorney Crosby-
Collierexpounded on how the term limits are laid out with this existing board.Vice-Chair
Williamsasked when her term ends, can she come back as an alternate member. Assistant City
Attorney Crosby-Colliersaid she would be termed out and has to sit outfor a complete term
before she can apply again.
Chair Kelleropened the public hearing and asked if there wasanyone present who wishedto
speak on this proposed project. As no one wished to speak, the public hearing was closed.
Chair Keller passedthe gavel to Vice-Chair Williams.

V.MISCELLANEOUS
A.Project Status Report
Development Services DirectorRumerupdated the Board with the following:
The City recently hosted the Orlando Economic Partnership whom recruits
businesses to the area. The City gavea presentation and abus tour of sites within
Ocoee that are shovel-ready for Class A Office.
There is a new buildout on the north side of Highway50next to the SunTrust
Bank. It is a three-unit retail building with upgradedarchitecture. The first tenant
is a Huey Magoo’s. ADickey’s BarbequePit has gone in.This trend to the east is
very good news for Ocoee,and the City is very excited.
Arden Park is breaking ground on more phases.
The City Commission adopted the 8815 Hackney Prairie Road annexation,and
directed staff to work with the neighbors adjacent to the west to grant them an
access easement.
Development Services DirectorRumerasked the Board if they have any questions.
Member Lomneckasked if any new plans have come in for the buildings at
Highway 50 and Maguire. Development Services Director Rumerresponded
Vitality Bowls Superfood Cafe,adentist,and TijuanaFlats.
Member Lomneckinquired about the buildouts on Clarke Road across from the
mall. Development Services Director Rumerindicated that there will be a
dance studio and a doctor’soffice. He advised the developer is installing
awnings, and the landscaping is currently being upgraded.

ISSUE:
Should the Planning & Zoning Commission recommend approval of amendments to the Land
Development Code (LDC) relative to Article VI, Section 6-14 Commercialand Industrial Signage,
and Article VIIISigns?
BACKGROUND:
The City is in the process of reviewing the Land Development Code for clarification and is
proposing to move Commercial and Industrial signage from ArticleVI, Section 6-14into Article
VIIIwhich is solelyfor signage. Also, as the City trends toward more urban development which
is required in the many overlay districts,signage criteria,appropriate for an urban usage is
needed. City Staff is proposing to add new signage criteria in Article VIIIto facilitate signage
for these urban developments.

Please see the document containing the strikethrough and underline for discussion. The
language with the strikethroughis intended to be removed and language with an underline is
proposed.

C.Private Property Regulations.
(5)Signage Design Standards.
All signs shall be designed and selected to provide a logical, consistent, and attractive
pattern of advertising that relates to the human-scale, attractively identifies businesses, and
conveys an understandable message when viewed in conjunction with adjacent signs and
landscaping. Certain minimum sign standards have been set to promote quality signs of a
design, size, and orientation that enhances the community. Other sign regulations shall be
as set forth in Article VIII of the Land Development Code unless otherwise specified below.
Notwithstandingany provision in the Land Development Code to the contrary, all
interpretations regarding the conformity of signs located within professional office, service,
commercial, and industrial areas shall be made by the Director of Planning or his designee
whoseadministrative interpretations may be appealed to the Development Review
Committee. In the event a person disagrees with an interpretation or decision made by the
Director of Planning, then they may request a meeting of the Development Review
Committee which will be held within 7 working days from the date of receipt of a written
request. All such appeals shall be filed with the Director of Planning. The Development
Review Committee may overrule or modify the interpretation or decision made by the
Director of Planning.
(a)Prohibited Signs.
i.Roof top signs, electronic/ message board signs, flashing signs and moving signs
are prohibited.
ii.Banners, streamers, pennants, scintillating lights, strobe lights, and revolving signs
are prohibited.
iii.No neon lighting or mini-lights shall be permitted as an adornment on any building,
except as part of an approved sign.
iv.No portable signs, trailer signs, signs painted on vehicles parked adjoining public
streets, sandwich board signs, or signs painted uponbenches are permitted.
b.Permitted Signs.
Only free-standing ground, wall, arcade, projecting, shopping center and business
center signs are permitted in accordance with the provisions set forth below. All other
signs, including non-verbal signs that do not qualify as public art, shall not be
permitted.
c.Free-standing Ground Signs.
i.Free-standing ground signs shall only be monument signs or dual pole signs and
shall not exceed 12 feet in height. Only one free-standing ground sign shall be
permitted per stand-alone business situated on an outparcel lot or individual parcel.
ii.Free-standing ground signs shall be limited to a maximum allowable copy area of
36 square feet, except that multiple-user signs may be permitted at shared
entrances up to 70 square feet in total size in lieu of individual signs for two
outparcel uses and 100 square feet in total size in lieu of individual signs for three
outparcel uses. Permitted sign areas are allowed on both sides of a double-faced
signs.
iii.No part of any free-standing ground sign shall be located closer than 10 feet away
from public right-of-way orcloser than 3 feet away from all sidewalks. Signs shall
not be placed within safe-sight triangles at entry locations.
iv.No free-standing ground signs shall be placed closer than 100 feet from each other
unless planned as a decorative sign cluster.
v.All free-standing ground signs shall be located a minimum of 10 feet outside the
planned right-of-way of secondary or primary roadways.
d.Wall Signs.
i. The maximum allowable area of wall signs for individual businesses shall not
exceed the following standards regardless of building frontage:

Subject to the maximum allowable standards specified in d.(i) above, the allowable
ii.
area of wall signs permitted on the main facade of any stand-alone business
structure located on an outparcel or separate tract shall not exceed 1 s.f.per lineal
foot of building frontage facing the primary street. On corner buildings, an additional
1 s.f. per lineal foot of building frontage facing the secondary street may be
permitted. Sign area shall not be combined between building frontages.
iii.Subject to the maximum allowable standards specified in d. (i) above, the maximum
allowable area of wall signs for individual businesses located within shopping
centers shall be computed based upon the building frontage of each store front that
has an outside public entrance that faces a public street or public parking area.
Sign area shall not be combined between individual businesses within the complex.
iv.All stand-alone buildings located on individual out-parcels or separate tracts may
install one additional wall identification sign not exceeding a size of 2 feet high by
12 feet in length on a building facade adjoining an entry driveway or public parking
area.
v.No wall sign or supporting structure shall project more that 12 inches from the wall
of the building.
vi.No part of any wall sign shall extend above the roofline of the building.
vii.Backlit awning signs may be permitted although all portions of the canopy will
constitute sign area.
(e)Arcade Signs. Signs are permitted to be located under a canopy or awning when
mounted perpendicular to the entryways of individual stores entering from a shopping
center, arcade provided such signs shall not exceed 6 inches in height or extend more
than 60% of the width of the awning or canopy.
(f)Projecting Signs. Projectingsigns, which are mounted with the sign faces
perpendicular to the wall of the building, shall only be located on mixed-and multiple-
use buildings or buildings with corner entrances fronting on two streets. The maximum
area of such signs, when permitted,shall be 36 square feet subtracted from total
allowable sign area of the building to which it is affixed.
(g)Shopping Center Signs.Shopping center signs are free-standing
identification/directory ground signs located at the entryways to a shopping center site
containing more than three individual businesses and limited to the name of the center
and/or various occupants of the center.
i.The allowable sign area along primary street frontages shall be in addition to the
sign area allowed for individual occupants and shall be based upon gross building
area of the entire center in accordance with the table below. Shopping centers with
entryways on adjoining secondary streets may provide additional signs meeting
these regulations, but only at a rate that is half the allowable sign area permitted for
primary street entry signs.

ii.Shopping center signs shall not exceed 15 feet in height.
iii.Shopping center signs may be located at each entryway along public rights-of-way,
except that the total combined sign area shall not exceed the maximum sign area
permitted along individual street frontages. In no case shall shopping center signs
be placed closer than 100 feet to a free-standing outparcel sign or within 200 feet
of another shopping center sign.
(h)Commercial / Industrial Business Center Signs. All identification/ directory signs
for commercial/ industrial business center projects containing interior buildings or lots
which do not front on primary or secondary streets shall be free-standing ground signs.
The sign copy shall be limited to the name of the project and/or the names of the
occupants within the project. No other signs shall be located on this sign structure,
and only one directory sign will be permitted at each public street entryway leading to
interior buildings or lots.
i.Where each individual user within the center will have its own free-standingground
sign, the identification/directory sign may have up to 50 square feet on each sign
face. In this case, the individual usernameson the directory sign shall be of uniform
shape and size. The overall height of the signshall be limited to a maximum of 12
feet.
ii.Where each individual user within the center will not have its own free-standing
ground sign, the identification/directory sign may have up to 100 square feet on
each sign face. In this case, there will be no restrictions on relative shape and size
of the usernameson the directory signs. The overall height of the sign shall be
limited to a maximum of 12 feet.
iii.Business center signs shall be located at the entrance to a project within a platted
easement with documentation acceptable to the City Attorney which identifies long-
term ownership and maintenance responsibilities for the sign.
(i)Sign Form and Color.Each sign shall complement the building architecture to which
it relates and shall be located ina manner which relates proportionately to the building
and its surroundings. Sign color and lighting shall be consistent with surrounding
patterns of development.
(j)Menu Board Signs. Information signs which identify food items offered with
corresponding pricing may be located along the drive-through lane of drive-in
restaurants. Said signs shall not exceed 32 sq. ft. in total area and shall be no greater
than 8 feet in height. Menu board signs shall not be counted as part of free-standing
ground signarea or wall sign area of the business as long as no general advertising
is depicted on the menu board that can be legible from adjoining public roadways or
off-site public parking areas.

ARTICLE VIII -SIGNS
8-2. -ADMINISTRATION.
The following provisions shall govern the administration of this Section:
A.Building permit required.
No person shall erect, alter, repair or relocate any sign without first obtaining a building
permit for such work from the Building and ZoningOfficial of the City of Ocoee. No
permit shall be issued until the Building and ZoningOfficial determines that such work
is in accordance with the requirements contained in this Section.
B.Drawing.
Every application shall be accompanied by a drawing of the proposed sign showing the
location, height, size, and distance from property lines andfrom other signs where
applicable. The length of the principal building shall also be furnished in order to
determine the size of the sign.
C.Exception, changeable copy sign.
The changing of advertising copy or message on approved signs which are specifically
designed for the use of replaceable copy shall not require a building permit.
8-3. -GENERAL REQUIREMENTS FOR ALL SIGNS.
A.Illumination of signs.
Light from an illuminated sign shall be shaded, shielded, or directed so that the light shall
notadversely affect the safe vision of operators of vehicles moving on public or private
roads, highways or parking areas. Light shall not shine directly on or into residential
structures.
B.Exposed sign structure.
No structure or framework may be exposed by removal of sign faces or advertising copy
for a period in excess of 30 days.
C.Unsafe signs.
Should any sign become insecure or in danger of falling or otherwise unsafe in the
opinion of the Building and ZoningOfficial, the owner, or the person or firm maintaining
the sign, shall upon written notice from the City, secure the sign in a manner to be
approved by the Building and ZoningOfficial in conformity with the provisions of this
Code, or remove the sign. If such notice is not complied with in eight (8)ten (10) business
days, the Building and ZoningOfficial shall remove the sign at the expense of the owner.
D.Maintenance.
All signs, together with their parts, supports, braces, guys and anchors shall be
maintained, treated and/or painted.
E.Location restriction.
Signs shall not be erected, constructed or maintained so as to obstruct any fire escape
window, or door or opening used as a means of egress. A sign shall not be attached in
any form, shape or manner to a fire escape, nor be placed in such manner as to
interfere with any opening required for ventilation.
F.Compliance with other regulations.
All signs as defined by this Section shall be erected, altered and maintained in
accordance with the provisions of this Section and shall be designed and installed in
compliance with the requirements of the Building and Electrical Codes of the City of
Ocoee.
G.Enforcement.
The Building and ZoningOfficial is hereby authorized and directed to enforce all
provisions of this Section.
H.Interpretation.
Where there is any ambiguity or dispute concerning the interpretation of this Section,
the decision of the Building and Zoning OfficialDevelopment Services Director or his/her
designeeshall prevail, subject to appeal as provided in Chapter II, Section 4 of the
Zoning Ordinance.
I.Conflict with other regulations.
Where the provisions of this Section are in conflict with any other ordinance or code or
parts of ordinances or codes, the most stringent provision shall govern.
8-4.GENERAL STANDARDS.
The following sign standards shall apply in the applicable zoning districts established on the
Official Zoning Map. Signs as described herein shall be permitted and erected upon improved
property located in A-1, A-2, P-S, C-1, C-2, C-3, I-1, and I-2 zoningdistricts, except as provided for
in Section 8-5 of this Chapter. In the instance of PUD signs, there may be special limitations above
and beyond those required by this Article.
A.
Maximum allowable copy area.
Unless otherwise specified, a total sign area of two square feet shall be allowed for each
linear foot of building frontage along the primary street frontage of the building. If
the building has frontage on more than one street, additional sign area shall be
allowed, based on one square foot for each linear foot of building frontage along
the secondary street frontage of the building site.
(1)Measurement of building frontage.
For purposes of sign area computation, the building frontage shall be that
part of the building where lines perpendicular to a straight line connecting the
corners of the building site intersect the building, as shown in the illustrations
below.

2)Sign shape and area computation.
In computing sign area in square feet, standard mathematical forms for
known common shapes will be used. Common shapes shall include squares,
rectangles, cones, spheres, trapezoids, triangles, circles, ovals, cylinders
and other simple forms for which surface area formulas are established. At
the discretion of the Building and Zoning Official, complex forms may be
broken down into component simple forms; however, all area within the
perimeter of the sign shall be included. All words and components of a sign
or related message shall be included as one sign.
Individual words or components may be considered separate signs only if
they express a complete independent message and are separated so as to
be obviously disassociated from other messages or components.
(a)When signs are enclosed in a border or highlighted by background
graphics, the perimeter of such border or background will be used to
compute area.
(b)The Building and Zoning Official shall have the discretion to make
minor adjustments and/or deviations from the principles stated herein
in order to assure that the reasonable intent of this Section is fulfilled,
that equality is achieved in the computation, and that reasonable
advertising exposure is allowed.
(3)Multi-faced signs.
On any sign with more than one face, the maximum number of advertising
surfaces visible from any location will be counted; provided, however, that all
advertising surfaces of a multi-faced sign shall be equal in size and height
and contained within a common perimeter.
B.Types and locations of allowed signs.
Only the following types of signs constructed in the following manner shall be permitted:
(1)Awning sign.
An awning sign built in accordance with the Standard Building Code and so
as not to interfere with safe vehicle traffic flow shall be permitted butshall
count in allowable signage for the building.
(2)Ground or pole signs.
Aground or pole sign shall only be permitted when the lot upon which it is to
be placed has a minimum of 40 linear feet of frontage. No ground or pole
sign shall be erected closer than 40 feet to any other ground or pole sign,
except where the locations of existing ground or pole signs on adjacent lots
would make this requirement impossible to meet. No part of any sign shall
extend beyond any right-of-way line nor shall any part of any sign project
beyond any building restriction line. Ground and pole signs are not permitted
in agricultural districts A-1 or A-2. The following is the maximum height
allowed for ground or pole signs:

(3)Marquee signs.
Signs may be placed on the vertical faces or on top of a marquee but no
such sign shall project more than 24 inches above the marquee's upper edge
nor extend beyond the marquee's perimeter, nor shall any part of such sign,
except those on awnings, projectbelow the bottom of the vertical face of the
marquee. One sign, not more than three square feet in area and limited to
the name of the business, may be attached to the bottom of a marquee at a
business entrance and shall be excluded from the allowable copy area;
provided, however, that such sign may exceed three square feet in area and
that this additional area shall be included as part of the allowable sign area
for the building.
(4)Projecting signs.
No projecting sign or supporting structure shall extend above the top of a
parapet wall, nor shall any such sign extend more than 20 feet above ground
level to the top of the sign.
(5)Roof signs.
No part of any roof sign or roof sign structure shall project beyond the
building wall. Roof signs shall extend no more than 25 feet above ground
level to the top of the sign.
(6)Wall sign.
No wall sign or supporting structure shall project more than 12 inches from
the wall of a building. Where an exterior parapet wall projects above the roof
line, such signs may extend to the top of such wall. However, no wall sign
shall extend more than 25 feet above ground level to the top of the sign, nor
above the roof line.
(7)Window signs, attached.
Signs which are physically attached to any surface of a window are not
permitted.
(8)Window signs, unattached.
Signs located on the interior of a business, but visible from the exterior of the
building, are permitted and are not charged against the maximum allowable
signage area if such signs are not physically attached to the window.
Recommendationsfor LDC Article VIII –Signs
Article 8, Section 8-4
The following sign standards shall apply in the applicable zoning districts established on the Official
Zoning Map. Signs as described herein shall be permitted and erected upon improved property
located in A-1, A-2, P-S, C-1, C-2, C-3, I-1, and I-2 zoningdistricts, except as provided for in Section
8-5 of this Chapter. In the instance of PUD signs, there may be special limitations above and
beyond those required by this Article. Notwithstanding any provision in the Land Development
Code to the contrary, all interpretations regarding the conformity of signs located within
professional office, service, commercial, and industrial areas shall be made by the Director of
Planning or his/herdesignee whose administrative interpretations may be appealed by the
variance process.
Sign Variances
1.The City of Ocoee reserves the right to grant variance for signage permits when deemed
appropriate. Circumstances deemed appropriate include but are not limited to: Fitting
architectural context, strictcode adherencewould cause alack of architectural scale
relationship, threats to health, safety and welfare to the general public, or cause
unreasonable strain on an establishment’s ability to conduct and attract business.
(a)Prohibited Signs.
i.Roof top signs, electronic/ message board signs, flashing signs and moving signs
are prohibited.
ii.Banners, streamers, pennants, scintillating lights, strobe lights, and revolving
signs are prohibited.
iii.No neon lighting or mini-lights shall be permitted as an adornment on any building,
except as part of an approved sign.
iv.No portable signs, trailer signs, signs painted on vehicles parked adjoining public
streets, sandwich board signs, or signs painted upon benches are permitted.
v.Pole Signs.
vi.Signs may not be painted directly on thewall of the building and business it
serves.
vii.Signs with graphical depictions of cigarette type visuals, marijuana or hemp
leaves, and
viii.Signs using the words "stop," "danger" or any other word, phrase, symbol
or character in a manner that might reasonably mislead, confuse or distract a
vehicle driver.
(b)Permitted Signs.
Only free-standing ground, wall, arcade, projecting, shopping center and business
center signs are permitted in accordance with the provisions set forth below. All other
signs, including non-verbal signs that do not qualify as public art, shall not be
permitted.
“Open” signs may be located on the interior of windows, provided they do not exceed
2 sq. ft. “Open” signs shall not be counted towards the overall sign number
requirement, nor window sign requirements.
c.Free-standing Ground Signs.
i.Free-standing ground signs shall only be monument signs or dual pole signs and
shall not exceed 12 feet in height. Only one free-standing ground sign shall be
permitted per stand-alone business situated on an outparcel lot or individual
parcel.
ii.Free-standing ground signs shall be limited to a maximum allowable copy area of
36 square feet, except that multiple-user signs may be permitted at shared
entrances up to 70 square feet in total size in lieu of individual signs for two
outparcel uses and 100 square feet in total size in lieu of individual signs for three
outparcel uses. Permitted sign areas are allowed on both sides of a double-faced
signs.
iii.No part of any free-standing ground sign shall be located closer than 10 feet away
from public right-of-way or closer than 3 feetaway from all sidewalks. Signs shall
not be placed within safe-sight triangles at entry locations.
iv.No free-standing ground signs shall be placed closer than 100 feet from each
other unless planned as a decorative sign cluster.
v.All free-standing ground signs shall be located a minimum of 10 feet outside the
planned right-of-way of secondary or primary roadways.
d.Wall Signs.
a.General Provisions
i.Only individual letters or logos may be backlit. Illuminated cabinets are
prohibited.
ii.Wall sign may not conceal windows or architectural details.
b.
Dimensions
i.Copy area of sign may not exceed one (1) square foot per one (1) linear
foot of building façade.
ii.Must be located:
1.At least 6” above the ground-story windows and awnings
2.At least 6” below the top of the roof line, parapet, or bottom of the
lower eave if the building is one-story in height, and at least 6”
below the window sill of the second story if the building is more
than one-story in height.
i. The maximum allowablearea of wall signs for individual businesses shall not

ii.Subject to the maximum allowable standards specified in d.(i) above, the
allowable area of wall signs permitted on the main facade of any stand-alone
business structure located on an outparcel or separate tract shall not exceed 1
s.f. per lineal foot of building frontage facing the primary street. On corner
buildings, an additional 1 s.f. per lineal foot of building frontage facing the
secondary street may be permitted. Sign area shall not be combined between
building frontages.
iii.Subject to the maximum allowable standards specified in d. (i) above, the
maximum allowable area of wall signs for individual businesses located within
shopping centers shall be computed based upon the building frontage of each
store front that has an outside public entrance that faces a public street or public
parking area. Sign area shall not be combined between individual businesses
within the complex.
iv.All stand-alone buildings located on individual out-parcels or separate tracts may
install one additional wall identification sign not exceeding a size of 2 feet high by
12 feet in length on a building facade adjoining an entry driveway or public parking
area.
v.No wall sign or supporting structure shall project more that 12 inches from the
wall of the building.
vi.No part of any wall sign shall extend above the roofline of the building.
vii.Backlit awning signs may be permitted although all portions of the canopy will
constitute sign area.
(e)Arcade Signs. Signs are permitted to be located under a canopy or awning when
mounted perpendicular to the entryways of individual stores entering from a shopping
center, arcade provided such signs shall not exceed 6 inches in height or extend more
than 60% of the width of the awning or canopy.
(f)Projecting Signs. Projecting signs, which are mounted with the sign faces
perpendicular to the wall of the building, shall only be located on mixed-and multiple-
use buildings or buildings with corner entrances fronting on two streets. The maximum
area of such signs, when permitted, shall be 36 square feet subtracted from total
allowable sign area of the building to which it is affixed.
Intentionally Blank
(g)Shopping Center Signs. Shopping center signs are free-standing
identification/directory ground signs located at the entryways to a shopping center site
containing more than three individual businesses and limited to the name of the center
and/or various occupants of the center.
i.The allowable sign area along primary street frontages shall be in addition to the
sign area allowed for individual occupants and shall be based upon gross building
area of the entire center in accordance with the table below. Shopping centers
with entryways on adjoining secondary streets may provide additional signs
meeting these regulations, but only at a rate that is half the allowable sign area
permitted for primary streetentry signs.

easement with documentation acceptable to the City Attorney which identifies
long-term ownership and maintenance responsibilities for the sign.
(i)Sidewalk Signs
Description
a.General Provisions
i.Refer to Sign Copy Area Matrix for canopy sign copy area dimensions.
ii.Sidewalk signs may only be placed outdoors, and within 10’ of the front
entrance of the building during business hours. The sign must be stored
indoors at all other times.
iii.The sign must not interfere with pedestrian circulation in the sidewalk
right-of-way, and pedestrian circulation to and from the building
entrance.
iv.Sidewalk sign must not exceed 3’, and shall not exceed 2’ in width.
v.Sidewalk sign shall be and foldable, “Sandwich-Style” sign that stands
on its own.
vi.Sidewalk sign shall not be illuminated
vii.Sidwalkssign shall be removed from its outdoors location to inside
storage in events of high wind and precipitation.
viii.Use of plastic sidewalk signs are prohibited.
b.Placement
i.The sidewalk sign must be placed at least 5’ from the back-of-curb, or
front of sidewalk where planting areas occur. The must be at least 5’ of
sidewalk clearance for pedestrian circulation.
(j)Window Signs
a.Description
b.General Provisions
i.Window signs shall not be counted towards the overall sign number
requirement. One (1) window sign is permitted per business.
ii.Window signs shall be located on the first floor, or the floor where
pedestrian access is present from the outside of the building. Businesses
located above the ground floor, and only have access through the ground
floor, may have a window sign on the ground floor entrance.
c.Placement
i.Windows signs shall not exceed 20% of the window area along street
frontage. Window signs are only permitted along window areas along
street frontage.
(k)Sign Form and Color. Each sign shall complement the building architecture to which
it relates and shall be located in a manner which relates proportionately to the building
and its surroundings. Sign color and lighting shall be consistent with surrounding
patterns of development.
(l)Menu Board Signs. Information signs which identify food items offered with
corresponding pricing may be located along the drive-through lane of drive-in

1.General
a.In the Downtown Overlay, signs shall be illuminated by a shielded spotlight.
Internal illumination is prohibited.
b.In the Character Area Overlays, individual letters or logos may be backlit.
Illuminated cabinets are prohibited.
c.Use of plastic sign faces isprohibited.
2.Wall Sign
a.Description
b.General Provisions
i.Wall sign may not conceal windows or architectural details.
ii.Not permitted for residences with three (3) or fewer units.
c.Dimensions
i.Copy area of sign may not exceed one (1) square feet per one (1) linear
feet of building façadewith a 10% maximum of façade area
ii.Height may not exceed 2’6”.
iii.Raceway may not exceed 20% of the height of the sign letters
iv.Graphic Logos may not exceed a rectangular square of eight square feet.
v.Must be located:
1.At least 6” above the ground-story windows and awnings
2.At least 6”below the top of theroof line, parapet, or bottom of the
lower eaveif the building is one-story in height, and at least 6”
below the windowsillof the second story if the building is more

3.Blade Sign

multi-story building with no definable stories, the bottom edge of the sign
must not be located any higher than 12’ above the sidewalk or ground
plane.
iv.Theremust be at least 15’ between each blade sign.
4.Hanging Sign

i.Hanging signs may only be placed underneath galleries, arcades, and
awnings and near the front entrance of the building.
ii.There shall be a height clearance of at least 7.5’ above the sidewalk or

5.Awning Sign

ii.Awnings shall fit only over the opening it covers, and not the entire façade
of a building or business.

ground plane.

iv.Canopy sign must not encroach within 2’ of the buildingfaçade edge on

8.Sklyline Sign

BACKGROUND:
Content of Variance Request
The applicants,Telesis Services,arerequesting approval for a minimum required lot width
variance from 85 feet to 79.69 feet in order to meet the City of Ocoee Single-Family Dwelling
(R-1AAA) zoning requirements.
The subject property is part of a proposedlot split,which will resultin three (3) lots, one with a
width of 100.3 feet, 85 feet, and the other, the subject lot, with a width of 79.69 feet. The lot split
will be approvedbased on a commitment by the owners to deed a portion of the property to the
city as a dedicated right-of-way. Parcels to the south and west of the subject property are of 75
feet width on average. The subject property also well exceeds the 10,000square feetminimum
lot size for R-1AAAzoning with approximately 24,827 square feetof space.
According to Subsection 4-9 A., the variance application/applicant must demonstrate:
(1)That special conditions and circumstances exist which are peculiar to the land, structures, or
required subdivision improvements involved and which are not applicable to other lands,
structures, or required subdivision improvements.
No special conditions and circumstances exist, which are peculiar to the land or existing
structure,as indicated on the aerial and location map attached.
(2)That a literal interpretation of the provisions of these regulations would deprive the applicant
of rights commonly enjoyed by other properties with similar conditions.

DEVELOPMENT REVIEW COMMITTEE (DRC) RECOMMENDATION:
On November 6th, 2019, the DRC met to determine if the requested varianceto the lot was
consistent with the City’s regulations and intent for the sale of land.The Development Review
Committee voted unanimously to recommend approval of thevariance to the minimum required
lot width.
STAFF RECOMMENDATION:
Staff respectfully recommends that the Planning & Zoning Commission recommend approval of
