Subject: Establishing a Zoning Verification Letter Fee
a) Adoption of Fee Resolution
Background Summary:
Historically, City staff has answered request for zoning and land use verification and at times additional information
pertaining to a parcel through either a zoning verification request or public record request. The frequency of
request has been manageable and has been provided free of charge unless it was a part of a larger public records
request which can have fees assessed based on staff's time to provide documentation. As the economy has
flourished and property transactions have picked up, the frequency of and items requested has reached a point
that staff is recommending assessing fees as provided for in Section 1-14 of the City of Ocoee Code of Ordinances,
which authorizes the imposition of record search fees related to property located within the city.
Staff reviewed the zoning verification fees from surrounding local governments and is suggesting the following
two (2) fees be adopted by resolution:
Standard Zoning Verification letter- $50.00
Detailed research (Certificate of Occupancy, Variances, site plans etc.) zoning verification letter- $125.00
Issue:
Should the Honorable Mayor and City Commission adopt the proposed Rate Resolution to establish fees for
Zoning Verification Letters?
Recommendations:
Staff recommends adoption of the proposed Rate Resolution to establish fees for Zoning Verification Letters.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,
RELATING TO THE PROVISION OF RECORD
SEARCHES; ADOPTING A FEE FOR ZONING
VERIFICATION LETTERS; PROVIDING FOR
SEVERABILITY; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Ocoee adopted Ordinance 2016-006 (The
"Ordinance"), codified at section 1-14 of the City of Ocoee Code of Ordinances, which authorizes
the imposition of record search fees related to property located within the city; and, relating to
property searches not relating to a public records request; and
WHEREAS, the Ordinance provides for the fee imposed for zoning verification request is
to be established by a resolution of the City of Ocoee; and
WHEREAS, the City Commission recognizes the staff time spent answering zoning
verification requests in a timely manner should not be borne by the citizens but should be
reimbursed to the City by the requesting party.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF OCOEE,FLORIDA,AS FOLLOWS:
SECTION 1. Authority. The City Commission of the City of Ocoee has
the authority to adopt this Resolution pursuant to the City of Ocoee Home Rule Charter, Article
VIII, Section 2 of the Constitution of the State of Florida, Chapter 166, Florida Statutes, and
other applicable provisions of law.
SECTION 2. Schedule of Fees.
(A) The standard fee to be charged for only confirmation of Existing Zoning and
Future Land Use Designation is Fifty ($50.00) Dollars.
(B) The standard fee of One Hundred Twenty Five ($125.00) Dollars to be
charged for zoning information additional to the Existing Zoning and Future
Land Use Designation; this fee does not include the fee for Lien searches, as
described in Ordinance 2016-006.
SECTION 3. Severability. If any section, subsection, sentence, clause,
phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court
of competent jurisdiction, such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the remaining portion hereto.
SECTION 4. Effective Date. This Resolution shall become effective
immediately upon passage and adoption.
