October 22,2019
I.CALL TO ORDERS
Chairman Lowery called the Code Enforcement Board regular meeting to order at 7:03 p.m. in the Commission
Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida.
A. INVOCATION: Member Lewis initiated the moment of silence.
B. PLEDGE OF ALLEGIANCE: Member Mann led the Board in the Pledge of Allegiance to the U.S.flag.
C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared
a quorum (4) present.
PRESENT: Chairman Lowery& Members:Odom, Lewis, Mirza, Bandur, & Mann.
Also present: Board Attorney Mary Sneed, Assistant Support Services Director Doug Gaines, Code
Enforcement Clerk Justin Mieras,and Code Enforcement Officers Siegrist, Diaz, & Loeffler.
ABSENT: None.
D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code
Enforcement Officers and to anyone intending to speak regarding a case.
II. CONSENT AGENDA
ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT
BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS
UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE
BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY.

III. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS
CASE NO 2018-00174
OFFICER LOEFFLER 808 WURST RD LANDA LORENZO
Violation Cited: §6-4.H.(5)(c) &§115-3.B.
Summary: Disabled vehicles or trailers of any kind or type shall not be parked or stored in any residential zoned
property for more than one (1) month unless in a completely enclosed building or carport.
No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass,
undergrowth or other dead or living plant life.
Observation: Collapsing, mold covered, inoperable junk camping trailer back yard & tall weeds and grass under and
around moldy junk camping trailer.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of October 22, 2019,
the property is still in non-compliance. The City asked for Order of Compliance within 5 days or thereafter to be fined
$50.00 per day, per violation until found in compliance.
Respondent Lorenzo Landa stated he expects to have the violations fixed by this Friday.
Member Bandor, seconded by Member Odom, moved that Case in#2018-00174, the respondent be found in violation as
cited as of September 26, 2019, and be given until October 28,2019, to come into compliance or be fined$50.00 per day,
per violation that remains in non-compliance. Motion carried unanimously.
CASE NO 2019-00375
OFFICER LOEFFLER 2005 ADAIR ST KATIE S WILLETT
Violation Cited: §115-3.A(3)
Summary: No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass,
undergrowth or other dead or living plant life.
Observation:A Dead Tree Risk of Falling on Structures, Pedestrians, Motorists.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of October 22, 2019,
the property is still in non-compliance. The City asked for Order of Compliance within 30 days or thereafter to be fined
$25.00 per day until found in compliance.
Respondent Katie Willet explained the tree is dead and not safe. She has received multiple quotes to have the tree
removed but she has not found someone willing to removed the tree within her price range.
Member Bandor, seconded by Member Mirza, moved that Case in#2019-00375, the respondent be found in violation as
cited as of September 26, 2019, and be given until December 31, 2019, to come into compliance or be fined$25.00 per
day, per violation that remains in non-compliance. Motion carried unanimously.
CASE NO 2019-00808
OFFICER Diaz 702 MALCOM RD YOUNG ARTHUR F JR ESTATE
Violation Cited: §108-22., §108-35., & §115-3.A.(1).
Summary: Every electrical outlet and fixture,all wiring and equipment shall be installed, maintained and connected to
a source of electric power in accordance with the provisions of the Florida Building Code.
When nuisance conditions or hazards degenerate or cumulatively impact on structures,dwellings or other buildings
regulated by the Minimum Standards Codes,to the extent that repair, removal,securing or demolition is necessary for
the public health,safety and welfare,then the Code Enforcement Board is authorized to order the property owner or
City agents to repair, remove, secure,vacate or demolish such structures according to procedures outlined herein.
Defines a nuisance and menace to public health, safety and welfare
Observation: No duke energy service on the property since 2017. September 19, 2019 this property was deemed
"UNSAFE" for occupancy and posted on the front door of the residence. The property which has significant structural
damage to the exterior siding, roofing and interior floor, which was caved in at several locations. (See attached
photos). The property has not had any Electrical service since 2017 and it appears that no water service was
functioning inside the house, although there is service to the property. Miscellaneous junk/debris on property.
Officer Diaz presented the case and gave its history. Officer Diaz further explained that as of October 22, 2019, the
property is still in non-compliance. The City asked for Order of Compliance within 30 days or thereafter to be fined
$25.00 per day, per violation until found in compliance.
Respondent Michelle Leigh Bouch explained she has a vendor lined up to demolish the house but needs to evict the
current occupant first.She has started eviction proceedings but does not have a time frame on how long the process will
take.She is asking for a 60 day compliance period.
Member Odom, seconded by Member Lewis, moved that Case in #2019-00808, the respondent be found in violation as
cited as of September 18, 2019, and be given until December 9, 2019, to come into compliance or be fined$25.00 per
day, per violation that remains in non-compliance. Motion carried unanimously.
CASE NO 2019-00870
OFFICER SIEGRIST 2700 CULLENS CT 2019-1 IH BORROWER L P
Violation Cited: §6-4.H.(6)(a)(b)
Summary:Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it is
located behind the front yard building line and screened with a six-foot high opaque fence with gate.
Observation: Boat/trailer parked on grass completely visible from street.
Officer Siegrist presented the case and gave its history. Officer Siegrist further explained that as of October 22,2019,the
property is still in non-compliance. The City asked for Order of Compliance within 10 days or thereafter to be fined
$50.00 per day, per violation until found in compliance.
Member Odom,seconded by Member Bandor, moved that Case in#2019-00870, the respondent be found in violation as
cited as of September 27, 2019, and be given until November 1, 2019, to come into compliance or be fined$75.00 per
day,per violation that remains in non-compliance. Motion carried unanimously.
CASE NO 2019-00890

OFFICER LOEFFLER 1601 MAUREEN AVE ANDREE VIVANAND

Violation Cited: §108-19.A.
Summary: Every dwelling unit shall contain not less than a kitchen sink, lavatory,tub or shower and a water closet all
in good working condition and properly connected to an approved water and sewer system. During occupancy,there
shall be provided a safe, adequate and constant supply of potable water. Every plumbing fixture and water and waste
pipe shall be properly installed and maintained in good sanitary working condition,free from defects, leaks and
obstructions.
Observation: Waste water pipe from kitchen area broken; disconnected from waste system. Spilling unsanitary water
onto front porch slab
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of October 22, 2019,
the property is still in non-compliance. The City asked for Order of Compliance within 15 days or thereafter to be fined
$25.00 per day until found in compliance.
Member Bandor, seconded by Member Mann, moved that Case in#2019-00890, the respondent be found in violation as
cited as of October 3, 2019, and be given until November 6, 2019, to come into compliance or be fined$25.00 per day,
per violation that remains in non-compliance. Motion carried unanimously.
IV.CASE RESOLUTION
CASE NO 2019-00322
OFFICER LOEFFLER 2831 STONEGATE DR THOMAS JOEL DEWAYNE
Violation Cited: §51-13.
Summary: It shall be a violation to do work related to construction without first obtaining a permit.
Observation: Web Generated Complaint; Fence constructed without permit; verified via contact with Building
Department.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of October 22, 2019,
,the property is in compliance. No further action requested.
CASE NO 2019-00734
OFFICER LOEFFLER 1510 MAUREEN AVE JASON DUFFINA
Violation Cited: §115-3.A(3), §115-3.B., §143-27.A., & §165-3.A.
Summary: No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass,
undergrowth or other dead or living plant life.

At non-pickup times,garbage carts shall be placed in side yards or rear yards and screened from view to the extent
practicable. Except as provided herein,garbage carts shall at no time be placed in the front yard of the premises.
No person shall keep any abandoned or junk vehicle on any public property or any private property.
Observation: Misc. junk and debris deteriorating car port area. Tall weeds and grass front, side, rear yards and under
vehicle. Waste can stored in prohibited location. 2 inoperable, expired tag vehicles on jacks, flat tires etc. Driveway &
prohibited grass area.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of October 22, 2019,
the property is still in non-compliance.The City asked for an Order Imposing Fine.
Member Odom, seconded by Member Lewis, moved that in Case #2019-00734, the Board imposes fines as of October
10, 2019, as previously set by this Board.
CASE NO 2019-00841
OFFICER LOEFFLER 702 MALCOM RD YOUNG ARTHUR F JR ESTATE
Violation Cited: §108-35.
Summary:When nuisance conditions or hazards degenerate or cumulatively impact on structures,dwellings or other
buildings regulated by the Minimum Standards Codes,to the extent that repair, removal, securing or demolition is
necessary for the public health, safety and welfare,then the Code Enforcement Board is authorized to order the
property owner or City agents to repair, remove,secure,vacate or demolish such structures according to procedures
outlined herein.
Observation: Unsanitary unsafe conditions: occupancy of dwelling no connection to electric or water utilities in violation
of related minimum housing standards and creating a health and safety nuisance to the occupants and surrounding
residents.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of October 22, 2019,
the property is still in non-compliance.The City asked for an Order Imposing Fine.
Member Odom, seconded by Member Bandor, moved that in Case#2019-00841, the Board imposes fines as of October
1, 2019, as previously set by this Board.
V. COMMENTS
Member Mirza expressed a concern for the officer's safety when entering homes. Discussion ensued.
Chair Lowery reminded everyone about Founder's Day.
Assistant Support Services Director Doug Gaines asked the Board about expected attendance for the November 26th
meeting, week of Thanksgiving. Member Lewis advised he would be absent. The other members advised they expect to
be at them meeting.
