Background Summary:
The City purchased the property at 8815 Hackney Prairie Road on May 7, 2019 in order to provide a
solution to a drainage issue due to a City pond encroaching on a portion of the property. The City Public
Works Department investigated options to enlarge the capacity within the foot print of the existing land
locked pond and conservatively estimated the costs would be from $500,000 to $750,000. While
working on a solution to the flooding, the property owners offered to sell the property. The City
Commission approved the property purchase on May 7, 2019, for the City appraised value of$490,000.
The City received a Letter of Intent (LOI) on December 16, 2019, to purchase the property for
$360,000.00, minus up to one (1) acre for the area needed for drainage. City Staff has reviewed the
LOI and finds the offer acceptable.
The City has initiated a boundary and topographic survey with Southeastern Surveying to designate the
area needed for the drainage issue. The area will be lessed out of the existing legal description and
used for the sale contract and deed. Staff anticipates the area being less than one (1) acre as the LOI
provides.
The Development Services Department has reviewed the property and determined the remaining house
and land will meet the standards of the R-1A zoning district and will remain a conforming lot.
Issue:
Request the City Commission to approve selling the property at 8815 Hackney Prairie Road per the
Letter of Intent with a reduction of land (+1- 40,000 Sq. ft.) used for mitigating a drainage issue.
Recommendations:
Recommend the City Commission approve the sale of the property at 8815 Hackney Prairie Road,
Ocoee, FL 34761 based on the Letter of Intent received and approve the City Attorney to draft a Sales
Contract to be approved by the City Manager and executed by the Mayor; and approve Mayor and
City Clerk to execute all documents associated with the closing on this property.

Financial Impact:

This letter is to express the buyer's sincere interest in purchasing the above-mentioned property under the following
terms and conditions:
Purchase Price: $360,000.00
Terms: Cash
Down Payment: $5,000.00
Balance Payable: $355,000.00
Due Diligence: 30 Days
Closing date: Within 15 days following the expiration of the due diligence period.
Buyer will deposit $5,000.00 earnest money within 3 days of the executed sales contract and the balance of the
purchase price is due upon closing of the transaction.
Sales Conditions:
• Seller is granting 20 feet ingress and egress easement to the property located at 8829 Hackney Prairie Rd.,
• The northern part of the property be reduced by up to 1 acre
