Background Summary:
Content of Variance Request
The applicant, Angelo, and Donna Rotondo are requesting approval for a minimum required lot width variance
from 85 feet to 79.69 feet in order to meet the City of Ocoee Single-Family Dwelling (R-1AAA) zoning
requirements.
The subject property is part of a proposed lot split, which will result in three (3) lots, one with a width of 101.2 feet,
the second with a width of 85 feet, and the subject lot, with a width of 79.69 feet. The lot split will be approved
based on a commitment by the owners to deed a portion of the property to the city as a dedicated right-of-way.
Parcels to the south and west of the subject property are of 75 feet width on average. The subject property also
well exceeds the 10,000 square feet minimum lot size for R-1AAA zoning, with approximately 18,958 square feet
of space.
According to Subsection 4-9 A., the variance application/applicant must demonstrate:
(1) That special conditions and circumstances exist which are peculiar to the land, structures, or required
subdivision improvements involved and which are not applicable to other lands, structures, or required subdivision
improvements.
No special conditions and circumstances exist, which are peculiar to the land or existing structure, as indicated
on the aerial and location map attached.
(2) That a literal interpretation of the provisions of these regulations would deprive the applicant of rights
commonly enjoyed by other properties with similar conditions.
If a lot width variance is not granted, the applicant will not meet zoning requirements in order to build a
single-family residence, thus, leaving the parcel undeveloped while all surrounding parcels consist of a
single-family residence.

(3) That the special conditions and circumstances do not result from the actions of the applicant.
There are no special conditions and/or circumstances that pertain to the property.
(4) That the granting of the variance requested will not confer on the applicant any special privilege that is denied
by these regulations to other lands, structures, or required subdivision improvements under similar conditions.
The surrounding properties are zoned as "R-1A, R-1AA, and R-1AAA" Single-Family Dwellings, with some
having a lot width of 75 feet. Granting a 79.69 feet minimum lot width variance to the applicant will allow for
construction of a single-family dwelling on the property.
Issue:
Should the Honorable Mayor and City Commission recommend granting approval of a variance request by the
applicant for a minimum required lot width from 85 feet to 79.69 feet at 101 E. Orlando Ave. Parcel #20-22-28-
0000-00-006?
Recommendations:
Development Review Committee:
On November 6th, 2019, the DRC met to determine if the requested variance to the lot was consistent with the
City's regulations and intent for the sale of land. The Development Review Committee voted unanimously to
recommend approval of the variance to the minimum required lot width.
Planning and Zoning Commission:
On December 10th, 2019, the proposed variance requested by Angelo and Donna Rotondo was reviewed at a
public hearing by the Planning and Zoning Commission. The Planning and Zoning Commission voted
unanimously to recommend approval of the variance request.
Staff:
Staff respectfully recommends that the Honorable Mayor and City Commission approve a variance to the
minimum required lot width from 85 feet to 79.69 feet at 101 E. Orlando Ave. owned by Angelo and Donna
Rotondo.

NOTICE IS HEREBY GIVEN,that the OCOEE CITY COMMISSION will hold
aPUBLIC REARING on TUESDAY,JANUARY?,2020,at 6:15 P.M.oras soon
thereafter as possible,at the Ocoee City Commission Chambers,150 N Lakeshore
Drive,Ocoee,Florida,in order to consider the petition of Angelo and Donna Ro-
tondo for a variance according to the provisions of Article N,Subsection 4-9 of the
City of Ocoee Land Development Code.The parcel is located at 101 East Orlando
Avenue,and is identified as parcel number 20-22-28-0000-00-006.The applicant
is requesting a variance for a minimum lot width from 85 feet to 79.69 feet.
Interested parties may appear at the cited meeting and be heard with respect to
the proposed variance.This notice is given pursuant to Article IV Subsection 4-9 B.
(1),and page 180.4.43 of the City of Ocoee Land Development Code.A copy(lithe
application and the City of Ocoee Staff Report maybe examined at the Planning Di-
vision located in City Hall at the address indicated above,between the hours of 8:00
a.m.and 5:00 p.m.,Monday-Friday,except legal holidays.The City Commission
may continue the public hearing to other dates and times,as they deem necessary.
Any interested party shall be advised that the dates,times,and places of continua-
tion of these or continued public hearings shall be announced during the bearing
and that no further notices regarding these matters will be published.Yon are ad-
vised that any person who desires to appeal any decision made at the public bearings
will need a record of the proceedings and for this purpose may need to ensure that
a verbatim record of the proceedings is made which includes the testimony and ev-
idetaoe upon which the appeal is based.Persons with disabilities needing assistance
