Background Summary:
Greens at Forest Lake PUD is located on the north side of West Rd., west side of S.R. 429 and east of the West
Orange Trail. The subject site is currently made up of four parcels identified as parcel ID numbers 05-22-28-0000-
00-016, 05-22-28-0000-00-017, 05-22-28-0000-00-043, and 05-22-28-0000-00-041 respectively. The total area
for the four subject properties is approximately 29.17 acres.
The Greens at Forest Lake Phase 1 Plat is required in order to create 128 townhome lots on 20.39 acres along
with the associated right-of-way's for public streets, on-street parking, tracts for open space, stormwater retention,
and recreation. The plat also includes easements for sidewalks, emergency services, drainage, public utilities. Of
special note, the plat dedicates a 30-foot right-of-way tract located at the east end of West Road in order to provide
future public access. Once the adjacent parcels develop, the remaining right-of-way will be dedicated for an
additional public access.
The Greens at Forest Lake Phase 1 subdivision is platting prior to receiving a Certificate of Completion; therefore,
the developer is required to provide a Surety covering the outstanding proposed improvements as approved in
the Preliminary/Final Subdivision Plans for Greens at Forest Lake Phase 1. The Developer, Meritage Homes of
Florida, Inc has provided the City with a Letter of Credit (Regions Bank Irrevocable Stand-By Letter of Credit
Number 55109349) in the amount of$2,636,551.40.
Issue:
Should the City approve and sign the Greens at Forest Lake Phase 1 Subdivision Plat?
Recommendations:
The Development Services Department recommends the City Commission approve the Plat for the Greens at
Forest Lake Phase 1 Subdivision and authorize the Mayor and City Clerk to sign the plat.

PARTY'S FAILURE TO HAVE PROPERLY PERFORMED SITE WORK AND LANDSCAPING
IMPROVEMENTS FOR GREENS AT FOREST LAKE, PHASE 1 (HEREINAFTER, THE
"IMPROVEMENTS") AND MAINTAIN SAID IMPROVEMENTS FOR A ONE (1) YEAR PERIOD
FOLLOWING ISSUANCE OF A CERTIFICATE OF COMPLETION FOR SUCH IMPROVEMENTS.
SPECIFICALLY, THE STATEMENT SHALL BE TO THE EFFECT THAT: "THE MATERIALS,
WORKMANSHIP, STRUCTURAL INTEGRITY, FUNCTIONING, AND/OR MAINTENANCE
(MAINTENANCE REQUIRED TO ENSURE PROPER OPERATION) OF THE IMPROVEMENTS
HAS BEEN DETERMINED TO BE UNACCEPTABLE, AND SUCH CONDITION(S) HAS NOT
BEEN CORRECTED DESPITE NOTIFICATION TO THE DEVELOPER, " AND FURTHER
STATING THE SUMS DUE AS A RESULT OF SUCH DEFAULT TO DEFRAY THE ESTIMATED
COST OF REPAIRS TO THE IMPROVEMENTS.
A SUM NOT TO EXCEED $2, 636, 551.40 (TWO MILLION SIX HUNDRED THIRTY-SIX
THOUSAND FIVE HUNDRED FIFTY-ONE AND 40/100 U.S. DOLLARS) SHALL BE
AVAILABLE FOR PARTIAL OR FULL DRAW BY PRESENTATION OF YOUR DEMAND AT
SIGHT IF ACCOMPANIED BY A WRITTEN STATEMENT AS DESCRIBED IN THE
PRECEDING PARAGRAPHS.
THIS LETTER OF CREDIT SHALL BE IN FULL FORCE AND EFFECT UNTIL JANUARY
31ST, 2021 AND WILL BE AUTOMATICALLY EXTENDED WITHOUT AMENDMENT FOR ONE
NINETY (90) DAY PERIOD, UNLESS WE PROVIDE THE BENEFICIARY WITH WRITTEN
NOTICE OF OUR INTENT TO TERMINATE THE CREDIT HEREIN EXTENDED, WHICH
NOTICE MUST BE PROVIDED AT LEAST THIRTY (30) DAYS PRIOR TO THE
EXPIRATION DATE OF THE ORIGINAL TERM HEREOF OR ANY EXTENDED TERM.
