(Contractor) was awarded the Contract for the ITB #19-006 Downtown Lift Station #66 Construction Project by City Commission on June 4, 2019. Changes to the scope of work are as follows: • The Utilities Department originally designed the Control Building as a basic structure with the understanding that the exterior will be modified to match adjacent City facilities by others. Since the Lakeshore Center has been remodeled and is directly east of the proposed Control Building, the Utilities Department has requested that the Contractor perform additional work to the exterior of the Control Building to more closely resemble the Lakeshore Center. [Please see the attached revised plans BDR1-BDR4.] • In order to minimize the labor to maintain valves in the City's Lift Station Valve Vaults, the Utilities Department revised the City's Details to incorporate a spherical coupler. This will allow City staff to remove and repair or replace valves in a more efficient manner. [Please see the attached revised City Details UT301-UT302.] City staff sought proposals from the Contractor for the work described above. The Contractor submitted two proposals in the amount of $21,603.04 and $3,470.00 respectively (See proposals attached). Additional work had to be performed on-site due to the Contractor uncovering an existing broken 8-inch Plug Valves where the plans showed a 6-inch Plug Valve. The Contractor agreed to remove the broken valve, install a new 6-inch Plug Valve provided by the Utilities Department, and install an 8-inch by 6- inch Reducer to connect the proposed 6-inch Force Main to the existing 8-inch Force Main. The Contractor also submitted a proposal for the additional work in the amount of $2,568.01 (See proposal attached). Additional contract quantities were needed due to additional soil for compaction, excess loads of unsuitable soil, and additional lineal feet of Gravity Sewer Main in the amount of$25,038.00 (Please see Summary of Quantities attached). Staff is recommending the approval of Change Order No. 1 which includes the changes in scope of work, additional work to connect the proposed Force Main to the existing Force Main, and additional quantities. Funding is available in the project budget. The Utilities Department shall be available for questions. Issue: Should the Mayor and City Commission approve Change Order No. 1 for ITB#19-006 Downtown Lift Station #66 Construction Project? Recommendations: Motion for Mayor and City Commission to authorize City Mayor to approve Change Order No.1 with L7 Construction, Inc. in the amount of $52,679.05 and authorize City Manager to approve each change orders for this project up to the limit of his purchasing authority and up to the budgeted amount for this project. JUSTIFICATION No. 5 The Utilities Department originally designed the Control Building as a basic structure with the understanding that the exterior will be modified to match adjacent City facilities by others. Since the Lakeshore Center has been remodeled and is directly east of the proposed Control Building, the Utilities Department has requested that the Contractor perform additional work to the exterior of the Control Building to more closely resemble the Lakeshore Center. No. 6 Due to the limited space on the work site, the Contractor could not reuse clean excavated soil and had to use additional cubic yards of clean import fill for compaction around the Wet Well, Receiving Manhole, and Sanitary Sewer Line. No. 7 Due to the limited space on the work site and an excess of unsuitable soil, the Contractor had to dispose of all excavated soil which involved more truck loads than were quantified on the bid. Downtown Lift Station#66 Construction Project Bid ITB19-006 No. 13 Additional lineal feet of 8-inch PVC Gravity Sewer Main was needed to connect the Manhole on N Bluford Ave. to the Receiving Manhole. No. 15 In order to minimize the labor to maintain valves in the City's Lift Station Valve Vaults, the Utilities Department revised the City's Details to incorporate a spherical coupler. This will allow City staff to remove and repair or replace valves in a more efficient manner. CO1.01 While working to connect the proposed 6-inch Force Main, the Contractor uncovered a broken 8-inch Plug Valve that the City's plans showed to be a 6- inch Plug Valve. The Contractor had to do additional work to connect the proposed 6-inch Force Main to the existing 8-inch Force Main. This involved removing the existing broken 8-inch plug valve and installing a 6-inch Plug Valve and 8-inch by 6-inch Reducer. III. NARRATIVE OF NEGOTIATIONS The Contractor has agreed to construct the control building similar to the Lakeshore Center theme which matches the Ocoee's Downtown Master Plan and add components to the Lift Station based on the Utilities Departments redesign. The Contractor and the Utilities Department agreed for the Contractor to install the 6-inch Plug Valve provided by the Utilities Department. IV. PAYMENT The total expenses for the additional work in conjunction with Change Order No. 1 shall be $52,679.05. Funding for Change Order No. 1 in the amount of$52,679.05 shall come from 417—Utility Bond Fund.The Downtown Lift Station#66 Construction Project had a budgeted amount of$640,000.00 in the 417—Utility Bond Fund. Based on the Contract amount of$472,297.00 and with additional expenses form Change Order No. 1, Geotechnical Engineering,and Electrical Services,the project will have an unencumbered balance of$109,272.95. V. APPROVAL AND CHANGE AUTHORIZATION The original project and funding allocation was established by issuance of a CITY purchase order, subject to the terms and conditions contained in the CITY's solicitation, Project Manual, Drawings, Specifications, and/or the CONTRACTOR's service and price proposal, which collectively form the terms of an agreement between the CITY and the CONTRACTOR for the performance of the Work. This proposed change to the agreement requires approval by the City Commission under the CITY's Purchasing Rules and Regulations and is consistent with any prior action by the City Commission to award the Work to the CONTRACTOR. It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original agreement other than matters expressly provided herein. Downtown Lift Station#66 Construction Project Bid ITB19-006 CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments in contract price and time shown hereon constitute full and complete compensation and satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other claim for increased costs of performance or modifications of time will be granted by the CITY for the Work covered by this Change Order. The CONTRACTOR hereby waives and releases any further claims for cost or time against the CITY arising from or relating to the matters or Work set forth or contemplated by this Change Order.
