The subject site is approximately 1.73 acres in size and is currently vacant, undeveloped, and sparsely covered on the north side with a mixture of Pines and Oaks. The parcel is identified as parcel number 16-22-28-0000-00-042. The Future Land Use designation for the site is "Commercial". The First Reading for the proposed Ordinance was held on March 3, 2020. Issue: Should the Honorable Mayor and City Commissioners approve the Substantial Amendment to the Planned Unit Development/Land Use Plan (PUD/LUP) for Crystal Investments at 1414 E. Silver Star Rd? Discussion: The Applicant is requesting an amendment to the "Planned Unit Development" (PUD) zoning in order to allow for a two-story professional office and retail building. The Land Use Plan proposes the eventual construction of a two-story building with a total building floor area of 18,000 square feet. The first floor will consist of 9,000 square feet of commercial retail, while the second floor will consist of 9,000 square feet of professional offices. The location's historic zoning classification prior to converting to a PUD for an assisted living facility was Neighborhood Shopping (C-1), which had a maximum permitted building height of 35 feet. The proposed two-story building has a height of 30 feet. As shown on the Land Use Plan, the facility will have access to Silver Star Road and Ridgefield Avenue. The Silver Star Road access is through a shared cross-access provided by the adjacent property to the west. Additionally, the applicant will be dedicating a 20 feet wide tract of land to the City of Ocoee along Silver Star Road. The City requires buffer zones to protect new and established residential areas adjacent to new and established non-residential uses. Buffer zones were identified and defined in the provided Land Use Plan. As shown on the Land Use Plan, there is a 25 feet wide buffer zone on the north side consisting of a six (6) foot high brick wall and landscaping. On the west side, there is a ten (10) foot wide buffer landscaping. Water, sanitary sewer, reclaimed water (when available), solid waste and police & fire protection will all be provided by the City of Ocoee. It should be noted; since the development proposal is under 25,000 square feet, it will be reviewed and approved administratively by staff as a Small-Scale Site Plan. Since Small-Scale Site Plans are administratively approved, the P&Z and City Commission will not be acting on the site plan approval. Development Review Committee Recommendation: On December 3, 2019, the DRC (Development Review Committee) met to determine if the requested substantial PUD/LUP amendment was consistent with the City's regulations and future land use plan. Upon discussion, the Development Review Committee voted unanimously to recommend approval of the substantial amendment to the Planned Unit Development/Land Use Plan (PUD/LUP). Planning and Zoning Commission Recommendation: The Planning and Zoning Commission (P&Z) hearing was scheduled for December 10, 2019. City Staff presented a brief summary and overview of the requested actions. A resident from the Brentwood Subdivision spoke about her concern for privacy with the proposed two-story building, asking that windows be forbidden on the second floor. In addition, she mentioned concern for traffic on Ridgefield Avenue, turning into the subject property due to a concrete median. After deliberations, the P&Z Commission acting as the Local Planning Agency voted unanimously to recommend approval of the proposed action with two added conditions; that the building not exceed one-story; and a cut-through be installed in the Brentwood median on Ridgefield Avenue to allow left-turn movement onto the subject property. Please see the attached elevation. The applicant has committed to providing no exterior windows to the rear of the building to ensure privacy for residents to the north of the property. Staff Recommendation: Based on the recommendation of the DRC and discussions during the Planning and Zoning Commission Meeting, Staff supports the applicant's request for the proposed substantial amendment to the Planned Unit Development/ Land Use Plan (PUD/LUP) by Crystal Investments for 1414 E. Silver Star Rd for a two-story building with a total building floor area of 18,000 square feet. RZ-19-10-12: Crystal Investment Plaza PUD/LUP AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, APPROVING A SUBSTANTIAL AMENDMENT TO THE LAND USE PLAN FOR THE CRYSTAL INVESTMENT PUD/LUP FOR CERTAIN REAL PROPERTY COMPRISING APPROXIMATELY 1.73 ACRES LOCATED ON THE NORTHWEST CORNER OF E. SILVER STAR ROAD AND THE WEST SIDE OF RIDGEFIELD AVENUE; PURSUANT TO THE APPLICATION SUBMITTED BY THE PROPERTY OWNER; AMENDING THE CRTSTAL INVESTMENT PLAZA PUD/LUP TO CHANGE THE DESIGNATED LAND USE FROM AN ASSISTED LIVING FACILITY (ALF) TO PROFESSIONAL OFFICE AND RETAIL; FINDING CONSISTENCY WITH THE OCOEE COMPREHENSIVE PLAN; REPEALING INCONSISTENT ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the owner of certain real property located within the corporate limits of the City of Ocoee, Florida, as hereinafter described owner (the "Owner"), has submitted an application to the City Commission of the City of Ocoee, Florida (the "Ocoee City Commission") to approve an amendment(the"Amendment")to the Crystal Investment Plaza PUD Land Use Plan, as approved by the Ocoee City Commission on October 20, 2015 (the"PUD/PSP"); WHEREAS, the Amendment was scheduled for study and recommendation by the Development Review Committee ("DRC")on December 3, 2019; and WHEREAS,the DRC recommended approval of said Amendment; and WHEREAS, the Amendment was scheduled for study and recommendation by the Planning and Zoning Commission of the City of Ocoee ("P&Z"); WHEREAS, on December 10, 2019, the P&Z held an advertised public hearing on the Amendment and, after discussion, recommended approval of the proposed action with two added conditions; that the building not exceed one-story; and to install a cut-through in the Brentwood median on Ridgefield Avenue for left-turn movement; and WHEREAS, on , 2020, the Ocoee City Commission has held an advertised de novo public hearing with respect to the proposed Amendment and this Ordinance and determined that an Amendment to the PUD/LUP to change the designated Land Use from an Assisted Living Facility (ALF) to Professional Office and Retail and this Ordinance are consistent with the City of Ocoee Comprehensive Plan, as amended; and WHEREAS,this Ordinance has been considered by the Ocoee City Commission in accordance with the procedures set forth in Section 166.041(3), Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE,FLORIDA,AS FOLLOWS: SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Amendment to PUD/LUP. The Amended PUD/LUP, prepared by Regional Consulting Engineers, LLC, date stamped received by the City of Ocoee on October 3, 2019, with such additional revisions thereto, if any, as may be reflected in the minutes of the City Commission of the City of Ocoee meeting approving same, is hereby approved, subject to the Conditions of Approval as approved on October 20, 2015. The Amended PUD/LUP is attached hereto as Exhibit "A", and by this reference made a part hereof. As described therein, the Amended PUD/LUP amends the previously approved PUD/LUP for Crystal Investment Plaza -2- PUD/LUP. All references to the PUD/LUP or the Amended PUD/LUP for Crystal Investment Plaza PUD/LUP shall hereafter refer to the previously approved PUD/LUP for Crystal Investment Plaza PUD/LUP as amended by the attached Amended PUD/LUP. SECTION 3. Ocoee Comprehensive Plan. The Ocoee City Commission hereby finds that this Ordinance is consistent with the Ocoee Comprehensive Plan. SECTION 4. Inconsistent Ordinances. All ordinances or parts of ordinances in conflict or inconsistent herewith are repealed and rescinded as of the effective date of this Ordinance. SECTION 5. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 6. Effective Date. This Ordinance shall become effective ten (10) days after its passage and adoption.
