HomeMy WebLinkAboutItem 01 Approval of the Minutes for the Regular City Commission Meeting held May 5, 2020 MINUTES REGULAR CITY COMMISSION MEETING MAY 5, 2020 CALL TO ORDER- 0:15 PI\I Mayor Johnson called the regular session to order at 6:15 PM in the Commission Chambers of City Hall. The invocation was led by Mayor Johnson, followed by the Pledge of Allegiance to the Flag led by Commissioner Firstner. City Clerk Sibbitt called the roll and declared a quorum present. Present: Mayor Johnson,Commissioner Brinson,Commissioner Wilsen,Commissioner Firstner, Commissioner Oliver Also Present: City Manager Frank, City Attorney Cookson, City Clerk Sibbitt PRESENTATIONS AND PROCLAMATIONS -None Mayor Johnson announced the following. "All interested parties are invited to be heard during the public comments and public hearing portion of the meeting. Due to the current State of Emergency regarding COVID-19, City Hall is closed to the public; however, the City requests the public to call or email comments and/or questions to 407-554-7118 or citizensnocoee.org." STAFF REPORTS AND AGENDA REVIEW City Manager Frank announced before them is the following: Emergency Item #1 — Approval of the First Amendment to the Interlocal Agreement between Orange County and City of Ocoee for the Improvements and the Transfer of the Intersection of Fullers Cross Road and Ocoee-Apopka Road. (City Attorney Cookson) City Manager Frank briefly explained that the City and County have evaluated the Guaranteed Maximum Price (GMP) proposal from the awarded Construction Manager at Risk, Oelrich Construction, Inc., and have determined the pricing to be in line with current industry standards; however,this pricing is above the funding limits set in the original Interlocal Agreement approved in 2018. The Amendment will increase the limits of the joint 50% funding split between the City and County to allow the project to proceed to the construction phase.The City's increase is funded through Road Impact Fees with the adjustment covered under the separate Second Reading of Ordinance for Fiscal Year 2020 Budget Amendment agenda item Commissioner Brinson inquired about the financing within the budget amendment,and Finance Director Roberts addressed his questions. Motion: Move to approve Emergency Item #1, First Amendment to the Interlocal Agreement between Orange County and City of Ocoee for the Improvements and the Transfer of the Intersection of Fullers Cross Road and Ocoee-Apopka Road. Moved by Commissioner Wilsen, seconded by Commissioner Brinson; Motion carried unanimously. Regular City Commission Meeting May 5, 2020 City Manager Frank announced before them is a memorandum outlining the Ocoee Restaurant Outdoor Dining program in regard to relaxing regulations in order to encourage outdoor seating. An outdoor seating permit is required;however,the City is waiving the permit for 30 days or until full seating is allowed by the State of Florida. Consensus of the City Commission was to authorize the City Manager to take reasonable steps in relaxing regulations regarding the reopening of restaurants. City Manager Frank announced the City will be doing a soft opening in approximately a week. The City's COVID-19 Subcommittee/Task Force is evaluating certain departments that deal with the public and reconfiguring City Hall with one-way entrances/exits, and waiting areas to follow social distancing guidelines. They are also preparing staff with the essential PPE, cleaning supplies, and/or modifying their work spaces. COMMISSIONERS ANNOUNCEMENTS Commissioner Firstner — Thanked the Public Works Department and the contractors for the work being done in the medians on Maguire Road with regard to the Beautification Project; and further said it looks very good and brightens up the area. Commissioner Wilsen—None. Commissioner Brinson—None. Commissioner Oliver— Inquired how citizens that do not have cable, intemet or social media can view the agenda items. Discussion ensued regarding different ways the citizens are able to get the information about the agenda items. Mayor Johnson—None. COMMENTS FROM CITIZENS/PUBLIC City Clerk Sibbitt announced no emails or telephone calls were received. CONSENT AGENDA Consent Agenda Motion Motion: Move to adopt the Consent Agenda Items#1 -#2 with Item#3 being pulled for discussion and separate consideration. Moved by Commissioner Wilsen, seconded by Commissioner Brinson; Motion carried 5-0. 1. Approval of the Minutes for the Regular City Commission Meeting held April 21, 2020. (City Clerk Sibbitt) Approved on Consent. Motion carried 5-0. Wage Regular City Commission Meeting May 5,2020 2. Approval of Reappointments of Three Current Members on the Human Relations Diversity Board (HRDB). (City Clerk Sibbitt) The terms of Members Ira Calloway, Nichole Dawkins and Lori Hart will expire in May 2020. All three members have indicated an interest in being considered for reappointment for another term ending May 2023. In 2019 Members Calloway, Dawkins and Hart attended 7 out of 10 meetings. Approved on Consent. Motion carried 5-0. 3. Approval of Short-Term Lease Agreement with Manheim Remarketing, Inc. for Storage of Automobiles on City-owned Properties. (Assistant City Manager Shadrix) Manheim operates one of the largest automobile auctions in the world at its location on Story Road in Ocoee. This business supports many of our local businesses weekly due to the volume of units bought and sold. The current COVID 19 crisis and associated economic effects have tremendously affected the Manheim auction in Ocoee,resulting in losses enumerated in the millions. Representatives of Manheim recently reached out to the City seeking opportunities for storage of additional inventory of automobiles until the auction is able to resume full operations, citing increasing revenue losses and the extremely high expense of shipping excess inventory to areas outside the City of Ocoee a) Lease Agreement for 951 Ocoee Apopka Road (Rogers Property). b) Lease Agreement for 843 Marshall Farms Road. Commissioner Oliver inquired if the lease agreements are only for a six-month period. City Manager Frank explained they are for a six-month period and longer, if necessary. Typically, this is not something the City engages in; however, with the COVID-19 crisis. City staff decided this would help a local business as well as help the City in regard to loss in sales tax revenue Commissioner Oliver expressed this is a positive temporary solution for both the business and the City. Further discussion ensued regarding the City's loss of revenue from the impact of COVID-19. Mayor Johnson commented on the positive financial stability of the City due to reserves and funds received from impact fees and development; and further, he stated residents should not worry about a tax increase. He thanked the City Manager, the Finance Department, and City staff for running a tight ship and keeping the reserves where they are. Motion: Move to adopt Consent Agenda Item #3; moved by Commissioner Oliver, seconded by Commissioner Firstner; Motion carried 5-0. PUBLIC HEARING- None FIRST READING OF ORDINANCES 4. First Reading of Ordinance to Amend Chapter 51 of the City Code of Ordinances to Enact Fees Pertaining to Private Providers for Building Plan Reviews and Inspections. (Second Reading and Pubbc Hearing scheduled for June 2, 2020, Regular City Commission Meeting at 6:15 pm or soon thereafter)(Development Services Director Rumer) House Bill 7103,effective July 1,2019,includes changes to Florida Statute 553 791 regarding the outsourcing of inspections and plan examination to private providers In response,the Ocoee Building Division is seeking to implement changes to fees and business processes in order to facilitate and comply with the new law City Attorney Cookson read the title of the Ordinance. Wage Regular City Commission Meeting May 5,2020 Mayor Johnson announced that this will he presented as a second reading and public hearing at the next scheduled City Commission meeting on June 2, 2020 at 6:15 PM or soon thereafter. SECOND READING OF ORDINANCE—PUBLIC HEARING 5. Second Reading of Ordinance for Fiscal Year 2020 Budget Amendment. (Advertised in the West Orange Times on Thursday,April 23, 2020.) (Finance Director Roberts) The City Commission adopted an annual operating budget for the city on September 25,2019 Subsequent to the adoption of the budget staff identified the need for additional appropriations in the General Fund, the Sanitation Fund and the Wastewater Fund The staff report outlines the budget funding appropriations City Attorney Cookson read the title of the ordinance. Finance Director Roberts explained the primary budget items that staff identified the need for additional appropriations in the General Fund, the Sanitation Fund, and the Wastewater Fund. Commissioner Brinson inquired about the Police Department's request of$103,000 for certified mailings to persons not paying the red-light camera fines: and after doing the math, he found it came to around 17,000 violators and inquired if there really are that many. Finance Director Roberts expressed she believes there are that many. City Manager Frank said that does sound like a high number, and staff will look into that Commissioner Oliver shared that he researched the Florida Statutes, and could not find that certified letters are required. Discussion ensued regarding the red-light camera notices. The public hearing was opened As no telephone calls or enailc were received, the public hearing was closed Motion: Move to adopt Ordinance No. 2020-014, Fiscal Year 2020 Budget Amendment, subject to the $103,082 Line Item coming back to the City Commission with a staff presentation by the Police Department; and further, if the Commission deems the $103,082 Line Item inappropriate after the presentation, such funds or a portion thereof as determined by the Commission shall be removed from the increase of appropriations; Moved by Commissioner Brinson, seconded by Commissioner Oliver; Motion carried unanimously. REGULAR AGENDA - None STAFF ACTION ITEMS -None COMMENTS FROM CITIZENS/PUBLIC The following person(s) addressed the City Commission via email and/or telephone: - Melissa Myers, Ocoee Homeowner and Community Partner, provided an email on the heartfelt loss of the Ocoee High School Football Star, Dexter Rentz, Jr., and asked the City to recognize Dexter. Commissioner Oliver read her statement. He said the coach of Louisville announced they will be making a dedication to Dexter once they get on the field. He suggested the Ocoee Youth Council should look into this as Dexter was one of 41 Page Regular City Commission Meeting May 5, 2020 their own. Mayor Johnson further suggested the Ocoee Youth Council should work with the Ocoee High School on some type of dedication to Dexter. Consensus was to send this email to the Ocoee Youth Council. COMMENTS FROM COMMISSIONERS Commissioner Oliver—Commented on the following: 1) It is mosquito season, and residents can call Orange County for mosquito control. Orange County Mosquito Control contact information was shared. 2) Shared information on how to contact Duke Energy if your neighborhood has a streetlight out. Contact information for Duke Energy was shared. 3) Ingram Road has a small section without sidewalks, and warned residents to be careful when biking/walking. City Manager Frank advised he would have staff look into this. 4) Updated the Commission that on April 23rd, 100 meals were sent to feed our heroes at the hospital; and further, stated he is thinking about them and encouraged them to keep doing a great job. Commissioner Brinson—Commented on the following: 1) Reminded residents to be safe during this time especially when many residents are doing outdoor activities. 2) Shared he received a few calls regarding when the parks will be opening up. City Manager Frank indicated the City is following the County s guidelines; and further, he spoke with staff and anticipates opening up the boat ramp in approximately a week. He said residents are currently utilizing the parks, and as long as they are taking measures to he safe such as no more than 10 allowed and practicing social distancing, the Police Department is not bothering them. Commissioner Wilsen—Commented on the following: 1) Announced that a baffle box is being installed on Hawthorne Cove Drive as part of the Lake Olympia Drainage Project, which will help keep Lake Olympia clean from debris. 'this project is in conjunction with FDOT. Commissioner Firstner—None Mayor Johnson—Commented on the following: 1) Thanked City staff involved with the cleaning product giveaway, which was a great success, and the residents were very appreciative.
