Background Summary: The Commission awarded the Construction Manager At Risk (CMR) contract for the Fullers Cross Road and Ocoee-Apopka Road Intersection Improvements at the September 17, 2019 meeting to Oelrich Construction, Inc., (Oelrich), and approved the pre-construction services portion of the contract on November 5, 2019. Oelrich, VHB Engineers and City staff diligently worked on the next step in the CMR process which is to negotiate the Guaranteed Maximum Price (GMP) and completion dates based on a collaborative value engineering process of all involved. From the inception of the concept between the City and County to jointly improve the intersection, the region has experienced an unprecedented surge in construction industry costs The City and County have evaluated the GMP proposal from Oelrich and have determined the pricing to be in line with current industry standards, however this pricing was above the funding limits set in the original Interlocal Agreement approved in 2018. An Amendment to the Interlocal Agreement between the City and County has increased the limits of the joint funding to allow the project to proceed to the construction phase The County will be contributing $1,100,000.00 to the total cost of the project. The City's increase is funded through Road Impact Fees Public Works is requesting Commission approval for the GMP at $2,038,974.00 for the project with elements that include adding left and right turn lanes, stormwater improvements and new traffic signalization. Issue: Request City Commission approval of the Guaranteed Maximum Price for the Fullers Cross Road and Ocoee-Apopka Road Intersection Improvements Construction Manager At Risk contract with Oelrich Construction, Inc. Recommendations: Recommend approval of the Guaranteed Maximum Price of the Construction Manager At Risk contract, RFQ #19-008, with Oelrich Construction, Inc., of Jonesville, Florida, of $2,038,974.00, authorizing the Mayor, City Clerk and Staff to execute the required contract documents and for the City Manager and staff to approve additional work up to the limit of his purchasing authority and up to the allowable budget for unforeseen conditions. Attachments: Oelrich GMP Proposal. Financial Impact: The cost for the Guaranteed Maximum Price is adequately funded by Road Impact Fees and with funding from Orange County up to $1,100,000.00. Exhibit C - Constuction Approval Plan Documents: Qualifications This estimate includes the improvements of the intersection at Fullers Cross Road and Ocoee Apopka Road. This estimate is based on the Construction Approval Plans produced by VRB Engineers dated November 22nd 2019,the City of Ocoee Engineering Standards Manual produced by the City of Ocoee dated February 20th, 2012, site meetings and discussions, and the qualifications below. Division 01- General Conditions • The estimated project construction duration will be twenty-two (22) weeks. • Work will be accomplished during normal work hours. This will include various activities which will cause loud noises. • A Builder's Risk Insurance and a General Liability Insurance policy has been included in this proposal. • A Payment and Performance Bond has been included in this proposal. • We have included costs for permit fees. • We have not included costs for impact fees. • No provisions for temporary power/water are included in this proposal. It is assumed that we will have some form of available power and water from the building for the duration of the project. • We have included temporary protection for existing finishes required. • We have included provisions for temporary job site office trailer. • All required temporary enclosures, storage facilities, dumpsters, toilets, signage, etc. have been included as a part of the project. • Hazardous materials removal or mitigation is not included in our price or schedule. • Relocation or repair of existing M/E/P/FP Systems to accommodate new systems not specifically presented on the project scope of work is excluded. We are not responsible for the existing building systems. • Moving or relocation of existing furniture, fixtures, and equipment is not included. • Costs are included for material testing and inspections. • A Construction Contingency of 3% is included to cover estimating variances, and unexpected events in the construction process and schedule. The estimate does not include separate owner or design contingencies. Exhibit C - Constuction Approval Plan Documents: Qualifications Division 03- Concrete • We have included all concrete sidewalks as per the Construction Plans. Division 05- Metals • We have included the furnish and erection of all structural steel as per the structural drawings. Division 31- Earthwork • We have included all Earthwork and grading as per the Construction Plans. • We have included to de-muck any unsuitable soils and replace with clean fill. Removal of muck/unsuitable and replacement shall be quantified by the geotechnical engineer. • We have included the construction of a temporary construction parking/storage area. Division 32- Exterior Improvements • We have included all 12" stabilized sub-base, 8" base, prime and sand, tack, milling, 4" SP, 1.5" SP, and 1" maximum overbuild. • We have included sodding the disturbed areas with bahai sod. • We have included the following for storm and run off: seven (7) proposed ditch blocks, 24" RCP, new 24" headwall, new 8' x 6' box culvert, new double wing wall, all 6" underdrain, eleven (11) clean outs, all fittings, and all fine aggregate sand for backfill of underdrain. • Includes approximately one thousand nine hundred (1,900) square feet of Rip Rap in lieu of Armor Flex ditch lining. Division 33- Utilities • We have excluded the removal and relocation of any telephone or power poles. Division 34- Transportation • We have included all conduit for signalization units, both open trenched and directionally bored. • We have included all signal cable, both new and reconstructed. • We have included thirteen (13) pull and splice boxes,with cover size 13" x 24". • We have included all electrical service wire. • We have included one (1) prestressed concrete service pole. • We have included two (2) 30' prestressed concrete poles. • We have included two (2) aluminum signal poles. • We have included four(4) steel mast arm assemblies with 60'arms. • We have included eight (8), three section, vehicular traffic signals. • We have included four(4), four section, vehicular traffic signals. • We have included two (2) pedestrian signals. • We have included one (1) vehicle detection system,cabinet equipment. • We have included four(4) above ground equipment's for vehicle detection system • We have included one (1) signal priority and preemption system cabinet. • We have included four(4) detectors for signal priority and preemption system.
