Code Enforcement Board
February 25,2020
I.CALL TO ORDER
Chairman Lowery called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission
Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida.
A. INVOCATION: Member Lowery initiated the moment of silence.
B. PLEDGE OF ALLEGIANCE: Member Odom led the Board in the Pledge of Allegiance to the U.S.flag.
C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared
a quorum (4) present.
PRESENT: Chairman Lowery& Members: Odom, Mirza, Bandur, & Mann.
Also present: Board Attorney Mary Sneed, Assistant Support Services Director Doug Gaines, Code
Enforcement Clerk Justin Mieras,and Code Enforcement Officer Loeffler.
ABSENT: Member Lewis is an excused absence.
D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code
Enforcement Officers and to anyone intending to speak regarding a case.
II. CONSENT AGENDA
ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT
BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS
UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE
BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY.

Member Odom, seconded by Member Mann, moved that the supplemental consent agenda be accepted as presented.

III. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS
CASE NO 2019-01168

Violation Cited: §115-3.A.(3), §143-27.A., §165-3.A, &§168-6.B.(1)
Summary:
§115-3.A.(3)—No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public
health,safety and welfare.
§143-27.A.—At non-pickup times,garbage carts shall be placed in side yards or rear yards and screened from view to
the extent practicable. Except as provided herein,garbage carts shall at no time be placed in the front yard of the
premises.
§165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property.
§168-6.B.(1)—No owner, private property,shall consent to the parking or storing of vehicles on non-improved
surfaces of the property.
Observation:
§115-3.A.(3)—Misc.Junk,Trash, Debris, Litter Front Driveway And Yard And Overflowing From Garbage Cans.
§143-27.A.—Trash Containers I.Garbage Cans Stored In Prohibited Location
§165-3.A.—Vehicle With No License Tag Stored On Property
§168-6.B.(1)—Vehicle(S) Parked Upon Front Yard Grass Non-Surface Unimproved Surface
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of February 25, 2020,
the property is still in non-compliance. The City asked for Order of Compliance within 15 days, or thereafter to be fined
$15.00 per day, per violation until found in compliance.
Member Odom,seconded by Member Bandur,.moved that Case in#2019-01168, the respondent be found in violation as
cited as of January 06, 2020, and be given until March 06, 2020, to come into compliance or be fined$15.00 per day, per
violation that remains in non-compliance. Member Odom, seconded by Member Bandur moved to amended compliance
to March 11,2020. Motion&Amendment carried unanimously.
CASE NO 2020-01200
OFFICER LOEFFLER 2010 PAULA MICHELE CT DANIEL THOMPSON
Violation Cited: §115-3.A.(3)&§115-4.
Summary:
§115-3.A.(3)—No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public
health, safety and welfare.
§115-4.—Owners shall control excessive weed or grass growths, as enumerated in § 115-3, on the property and on
the portion of the adjoining public right-of-way between the property and the street of each lot.
Observation:
§115-3.A.(3)—Overgrown Tall Weeds And Grass Front,Side & Rear Yards
§115-4.—Tall Weeds And Grass; Easement Between Pedestrian Sidewalk And Street
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of February 25, 2020,
the property is still in non-compliance. The City asked for Order of Compliance within 15 days or thereafter to be fined
$15.00 per day, per violation until found in compliance.
Member Odom, seconded by Member Mirza, moved that Case in #2020-01200, the respondent be found in violation as
cited as of January 22,2020, and be given until March 11, 2020, to come into compliance or be fined$15.00 per day, per
violation that remains in non-compliance. Motion carried unanimously.
IV.CASE RESOLUTION
CASE NO 2019-01063
OFFICER SIEGRIST 2265 TWISTED PINE RD DEBRA A MCGOWAN
Violation Cited: §54-3.A.(1)B.C.D.E.
Summary:All buildings shall have the assigned building number properly displayed,whether or not mail is delivered to
the building.
Observation::No address numbers on house nor mailbox.
Officer Siegrist explained that the property was found in compliance in accordance with the Board's Order Requiring
Compliance. No further action requested.
CASE NO 2019-01078
OFFICER LOEFFLER 605 JAY ST STEPHEN H NAUSUKIEWICZ
Violation Cited: §51-13.
Summary:It shall be a violation to do work related to construction without first obtaining a permit.
Observation: Re-roof without required permits, plans, approval and inspections.
Assistant Support Services Director Doug Gaines explained that as of.February 25, 2020, the property is still in non-
compliance.The City asked for an Order Imposing Fine.
Member Mirza, seconded by Member Odom, moved that Case in #2019-01078, the Board imposes fines as of February
13,2020, as previously set by this Board. Motion carried unanimously.
CASE NO 2019-01137
OFFICER DIAZ 609 CABORCA CT MONTY EUGENE STINSON
Violation Cited: §115-3.B.
Summary: No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds,grass,
undergrowth or other dead or living plant life.
Observation:Overgrown grass and weeds front back of property.
Assistant Support Services Director Doug Gaines explained that the property was found in compliance in accordance
with the Board's Order Requiring Compliance. No further action requested.
