PLANNING AND ZONING COMMISSION
ACTING AS THE LOCAL PLANNING AGENCY
Tuesday, June 9, 2020
I. CALL TO ORDER- 6:33 pm

Present: Chair Joel Keller, Vice-Chair Lavon Williams, Member Lou Forges, Member Brad

Absent: Member Jason Mellen (absent/unexcused)
Also Present: Development Services Director Mike Rumer, Zoning Manager Kiel Gajadhar,
Assistant City Attorney Dana Crosby-Collier, Recording Clerk Kathy Heard
Chair Keller announced the following, "All interested parties are invited to be heard during the
public hearing portion of this meeting. Due to the current State of Emergency regarding COVID-
19, City Hall is closed to the public; however, the City requests the public to call or email
comments and/or questions to 407-554-7118 or citizens@ocoee.org."
Chair Keller welcomed the newly-appointed alternate member, Jerry T. Lowe.
II. CONSENT AGENDA
A. Minutes of the P&Z Commission Meetings held May 12, 2020, and May 19, 2020.

IV. NEW BUSINESS — Public Hearings
A. Comfort Inn - Mainstay Suites, 11409 W. Colonial Drive
Preliminary/Final Large Scale Site Plan Project No: LS-2020-007.
(Continued from the May 19, 2020 P&Z Meeting and Advertised in the West Orange Times on
Thursday, April 30, 2020)
Chair Keller announced the applicant has requested to cancel this public hearing, and he read
the cancelation notice into the record.
B. Ocoee Landings — Substantial Amendment to the Planned Unit
Development (PUD), Project No.: RZ-20-04-03. (Advertised in the West Orange
Times on Thursday, May 28, 2020) (6:38 pm)
Zoning Manager Gajadhar presented a PowerPoint on the subject property, which is a mixed-
use development consisting of 9.15 acres of residential and 6.89 acres of commercial. The parcel
is located directly north of Silver Star Road, east of Clarke Road, and west of Johio Shores Road.
The commercial portion of the PUD will contain four (4) commercial lots, which will have
access to Silver Star Road and Lake Johio Drive. The commercial portion was initially approved
for C-2 (Community Commercial) uses with the exclusion of specific uses (Automobile Sales,
Hotel, Motel). The applicant is requesting an amendment to the PUD/Land Use Plan to allow
automobile repair and carwash in the list of permitted uses. This request is required in order to
allow for a Firestone Automotive Repair to be established on Lot 1 of the commercial lots with
the bays facing the commercial side. This proposed substantial amendment is being requested
because automobile repair and carwash facilities are currently not allowed in C-2 zonings;
however, they are allowed in General Commercial (C-3).
Development Review Committee (DRC) Recommendation: The Development Review
Committee (DRC) met on June 4, 2020, and reviewed the Amendment to the PUD/Land Use
Plan. The DRC made a recommendation of approval for the Substantial Amendment to the
Ocoee Landings PUD located at 1842 E. Silver Star Rd.
Staff Recommendation: Staff recommends the Planning and Zoning Commission recommend
approval of the Substantial Amendment to the PUD/Land Use Plan to allow automotive repair
on lot 1, and carwash as an approved use in the PUD/Land Use Plan. The proposed automotive
repair shop on Lot 1 with be a Firestone, subject to the designed renderings.

Discussion:
Vice-Chair Williams asked whether the special exception for the carwash will have to come
back to this board at a later time. Zoning Manager Gajadhar answered in the affirmative.
Member Forges asked if the bays will be opening towards the Publix or the residential. Zoning
Manager Gajadhar explained the bays will be facing west, towards the Publix. Member
Lomneck asked what the difference is between this development and the development off of
Ocoee Crown Point Pkwy by the Dunkin' Donuts. Development Services Director Rumer
explained the gas station off of Ocoee Crown Point Pkwy is considered a neighborhood gas
station, which is much smaller in nature with less gas pumps. Chair Keller asked if anything
will be put in place to not allow the storage of tires anywhere on the perimeter of the building.
Zoning Manager Gajadhar answered based on zoning regulations, storage of any kind is not
permitted on the outside of the buildings. Vice-Chair Williams asked why this location and not
somewhere else. Zoning Manager Gajadhar explained this Firestone is an upgraded, newer
design, and they believe there is a need for this type of use in this vicinity.
The applicant was present for questions.
Chip Bryan, Applicant/Owner, indicated he was satisfied with Staff's presentation and did not
have anything further to add, but was happy to answer any questions that the board may have.
Discussion ensued regarding the carwash use. Development Services Director Rumer
explained this is only for approval of a carwash use within this C-2 zoning; however, a special
exception for a carwash will have to come before this board at a later time.

Development Services Director Rumer announced he received one email with a question
regarding whether this proposed project is adjacent to the Publix or the proposed Memory Care
project to which he answered it is adjacent to the Publix.

Motion: Move that the Planning and Zoning Commission, acting as the Local Planning
Agency, recommend to the Ocoee City Commission Approval of the Ocoee Landings
Substantial Amendment to the Planned Unit Development (PUD), Project No.: RZ-
20-04-03, subject to resolution of the remaining staff comments before the City
Commission meeting; Moved by Member Lomneck, Seconded by Member Forges;
motion passed unanimously with Member Mellen absent.

C. Memory Care Cottages at Ocoee Preliminary/Final Subdivision Plan;
Project No: LS-2020-010. (Advertised in the West Orange Times on Thursday, May 28,
2020) (7:02 pm)
Zoning Manager Gajadhar presented a PowerPoint on the subject property, which is located
directly north and west of East Silver Star Road, south of Old Silver Star Road, and east of
Johio Shores Road. It is 6.92 acres in size and is currently undeveloped with heavy vegetation.
The Future Land Use designation for the subject site is "Low Density Residential" (LDR).
The requested "Memory Care/Assisted Living" use is consistent with the Future Land Use
Element and Zoning (R-1AA) District, as it is a permitted use within Residential Districts. The
Preliminary/Final Site Plan will consist of a 96-bed Memory Care/Assisted Living Facility
that will be divided among four (4) residences, and one (1) commons building, totaling
approximately 66,723 sq. ft. All buildings are proposed to be one-story. The main access point
will be off of Johio Shores Road with a gated emergency-only access off of Old Silver Star
Road. The perimeter of the parcel will consist of a fifteen (15) to twenty-five (25) foot
landscape buffer, and fencing will surround each building. Water, sanitary sewer, reclaimed
water (when available), solid waste, police, and fire protection will all be provided by the City
of Ocoee. Stormwater management will be handled by on-site drainage retention areas. The
Applicant has requested no Waivers from the Land Development Code for this project.
Development Review Committee (DRC) Recommendation: The Development Review
Committee (DRC) met on June 4, 2020, and reviewed the Preliminary/Final Subdivision Plan for
the Memory Care Cottages at Ocoee. When the discussion was finished, the DRC voted to
recommend approval of the Preliminary/Final Subdivision Plan.
Staff Recommendation: Staff recommends that the Planning and Zoning Commission
recommend approval of the Preliminary/Final Subdivision Plan for the Memory Care Cottages at
Ocoee ALF.
Discussion:
Member Forges asked if there will be a requirement from FDOT for a traffic signal at Johio
Shores Road and E. Silver Star Road. Zoning Manager Gajadhar said a traffic study was done
in which no signal was deemed necessary, because of the low amount of traffic that would utilize
this site. Vice-Chair Williams asked whether the buildings are apartment style, which was
deferred to the Applicant. She mentioned her concerns about traffic and possible U-turns on E.
Silver Star Road.
The applicant was present for questions.
Chuck Pigeon, P.E., Applicant & Engineer, Pigeon-Roberts & Associates, explained the
cottages will be single-story and built to look like residential homes. There will be 24 individual
units within one (1) building. He emphasized they are not apartments; however, each unit
resembles a studio unit. He indicated there is an FDOT facility adjacent to this site, and all of
FDOT's standards have been met.

Chair Keller opened the public hearing.
The following called in to be heard:
- David Swisher, 2432 Johio Drive, Ocoee, said he lives across the street from this proposed
facility. He indicated he does not see a gate or fence and asked about the safety measures. He
stated he is concerned about traffic that is going above the speed limit around the corner on E.
Silver Star Road. He asked if there has been an environmental study to mitigate the tortoise
population on the property. Mr. Pigeon addressed his questions and concerns indicating the
four (4) buildings will be enclosed with decorative fencing and landscaping for safety
purposes. Discussion ensued regarding traffic on E. Silver Star Road. He indicated a complete
environmental study was done specifically for protected species, in which case they will be
relocated.
- Sandra Krubiner, 2695 Ashville Street, Orlando, asked where the air-conditioning units will
be located. Mr. Pigeon indicated the transformers will be between the buildings, but he was
not sure whether the air-conditioning units will be in between the buildings or on the rooftops.
She further requested a rendering of the back of the buildings off of Old Silver Star Road.
Recording Clerk announced no further emails or telephone calls were received.

Motion: Move that the Planning and Zoning Commission acting as the Local Planning
Agency, recommend to the Ocoee City Commission Approval of the Memory Care
Cottages at Ocoee Preliminary/Final Subdivision Plan; Project No: LS-2020-010;
Moved by Member Lomneck;
Member Forges asked whether generators will be required; and if so, where will they be
located. Mr. Pigeon said generators will be required and described where they will be placed.
Seconded by Vice-Chair Williams; motion passed unanimously with Member Mellen
absent.
V. MISCELLANEOUS - (7:31 pm)
A. Legislative Update
Assistant City Attorney Crosby-Collier indicated the 2020 Legislative Session
adjourned in March, and she gave a brief summary of the following Senate Bills:
Senate Bill 1410 - Broke Management Bill
Senate Bill 712 - Environmental Resources Management Bill
Senate Bill 1066 - Impact Fee Bill
Senate Bill 1339 - Affordable Housing Bill
Development Services Director Rumer spoke about Orange County's procedures with
regard to residential developments, private providers and impact fees. Discussion ensued
regarding the senate bills.

B. Project Status Report
Development Services Director Rumer updated the Board with the following:
• The Vermeer Trinity site located off of Palm Drive & Ocoee Apopka is currently
under construction.
• Floors Direct off of SR 50 is ready for their preconstruction meeting.
• The Innovation Montessori Ocoee is planning on expanding; their plans are
forthcoming.
• An office/warehouse is being constructed off of Bluford Avenue across from Top
Gun Cheer, which will create an urban feel and bring jobs to downtown Ocoee.
C. June Calendar - No updates
Motion: Move to adjourn the Planning and Zoning Commission meeting; Moved by
Member Lomneck, Seconded by Member Forges; motion passed unanimously with
Member Mellen absent.
