A.CLRM PUD –McCormick Road Property Preliminary Subdivision Plan
(PSP);Project No: LS-2020-005.(Advertised in the West Orange Times on Thursday,
July 2, 2020)(Development Services Director Rumer)
Development Services Director Rumer explained the process of this Preliminary Subdivision
Plan. The subject property is located south of E. McCormick Road and west of N. Apopka
Vineland Road with the Parcel ID Numbers: 33-21-28-0000-00-007, 33-21-28-0000-00-020 &
34-21-28-0000-00-022,and is approximately 212.3 acres in size.On November 5, 2019 the City
Commissionapprovedthe Annexation, Land Use Plan and Rezoning for this project, which
changed the Large-Scale Future Land Use Map amendment from “Orange County” Rural to
“City of Ocoee” Low-Density Residential. The Future LandUse designation for the subject site
is “Low-Density Residential” which allows up to four (4)dwelling units per acre.
This is a planned residential subdivision that proposes a total of 377 single-family residential lots
with a requested density of 2.21 units per acre. There are three (3) lot sizes proposed within the
Preliminary Subdivision Plan and approved by the PUD: 40’ x 120’, 50’ x 120’, and 60’ x 120’.
The PUD has a minimum living area set at 1,200 square feet, and the development isto be
developed in four (4) phases. The setback for the subdivision will be a front setback of 15 feet,
side setback of 5 feet, a rear setback of 20 feet,and a side street setback of 10 feet.The
subdivision will comprise of 60.29 acres of open space, 5.86 acres of park tracts, a 9.68 acres
lake, and 23.12 acres in stormwater retention. The internal streets (50’ wide) will be dedicated as
public right-of-way to be owned and maintained by the City of Ocoee.
As shown on the plans, the subject subdivision will have two (2) access points on McCormick
Road, which is an Orange County Maintained Road. A 30-foot-wide strip of land adjacent to

McCormick Road will be dedicated to Orange County for a future trail extension. The Plan
provides for significant buffering along McCormick Road with a decorative three (3) rail fence.
Amenity areas, including a pool and cabana, are provided.Potable water and sewer will be
provided by Orange County. A lift station is required to be provided and will be owned and
maintained by Orange County.
Development Review Committee (DRC) Recommendation:The Development Review
Committee (DRC) met on July 9, 2020, and reviewed the Preliminary Subdivision Plan for the
CLRM –McCormick Road Property PUD. When the discussion was finished, the DRC voted to
recommend approval of the Preliminary Subdivision Plan.
Staff Recommendation:Staff recommends that the Planning and Zoning Commission
recommend approval of the Preliminary Subdivision Plan for the CLRM – McCormick Road
Property PUD.
Discussion:
The applicant waspresent for questions.
Member Mellenindicated he noticed the one home that is front-to-back,and he does not want to
see another fence variance because of thiscircumstance.Development Services Director
Rumer indicated maybe at the final site plan the developer can install a fence so there would be
no disputes.
Member Forgesinquired what “CLRM” stands for and whether that will be the name of this
community. Development Services Director Rumer said the name of the community has not
been disclosed yet, but it is not CLRM.
Member Loweasked how wide the interior streets are going to be, because a lot of homeowners
have more than two vehicles, and the vehicles end up being parked in the street.Development
Services Director Rumerindicated the interior streets are public, which are 50-foot-wide, but
every home will have a two-car garage.
Chair Kellerinquired about the connection to the West Orange Trail.Development Services
Director Rumerindicated currently there is not planned a trail connection in the vicinity of the
open space on the southside of this project. However, the HOA may in the future request a
sidewalk connection on the south.Chair Kellersaid he is concerned about the entrance not
lining up with Damon Road. He stated lining them up together with a traffic signalwould be
best.
DavidKelly, P.E., C.F.M.,Applicant, Poulos & Bennett, LLC, explained the spacing between
traffic signals is 1,320 feet, and he believes there is not enough spacing to be able to line them up
for a traffic signal. Discussion on the entrance and traffic lights ensued.

Joseph Hardimanemailedasking for more information on the West Orange Trail expansion.
Development Services Director Rumerexplained itis not an expansionof the trail, but a
McCormickconnector to the trail.There is a planned trail running down McCormick Road from
the west, near the SR 429, heading to Apopka Vineland Road.
Development Services Director Rumerfurther discussed two calls that he received today about
this project. The questions referenced the traffic signal funding commitment, which will be a
condition of approval within the plan.
Recording Clerkannounced no further emails and/or telephone calls were received.
The public hearing was closed.

Development Services Director Rumerupdated the Board with the following:
An update onthe P&Z meeting next month.He stated there will be a
ComprehensivePlan Text Amendment to no longer require Capacity
Enhancement Agreements in order to approve subdivisions that may impact
school capacity. Assistant City Attorney Crosby-Collier explained further.
City Center West Orange is completing MaineStreet to Blackwood Avenue.

CONSISTENCY WITH STATE & LOCAL REGULATIONS:
Annexation:With respect toState annexation criteria, Chapter 171.044 of the Florida Statutes
grants municipalities the authority to annex contiguous, compact, non-circuitous territory so long
as it does not create an enclave. The subject property is consideredcontiguous to the City of
Ocoee since itis borderedby property located within the City limits on the south, east, and
west.
Joint Planning Area Agreement
: The subject property is located within theOcoee-Orange
County Joint Planning Area (JPA) and is being considered for annexation as outlined in the
proposedJPA Agreement.
Rezoning
:The parcelwill receive an “R-1A”(Single Family) zoningupon annexation.
Comprehensive Plan:
The annexation is consistent with the Future Land Use Element Policy
2.5 that states in part, “The City shall consider requests for voluntary annexation into the City
when those lands are logical extensions of the existing City limits, when services can be
properly provided, and when proposed uses are compatible with the City's Comprehensive
Plan, the JPA Agreement, and the City’s Annexation Policy….” \[Emphasis added\].The rezoning
is consistent with Future Land Use Element Policy 1.15 that states in part, “The City may assign
an initialzoning, after annexation, which is consistent with both the Future Land Use Map and
the JPA Agreement.”
DISCUSSION:
Annexation Feasibility & Public Facilities Analysis Report (See attached):The property is
located withintheOcoee-Orange CountyJPAareaand is borderedby the City of Ocoee to the
north, east, and south. The propertyalready benefits from Ocoee Fire Rescue services via a
joint “First Responder” Agreement with Orange County.The property will require City of Ocoee
water service.
Summary: The proposed annexation is a logical extension of the City limits, urban services can
be provided, and the annexation meets state and local regulations.
DEVELOPMENT REVIEW COMMITTEE (DRC) RECOMMENDATION:
On August4,2020,the DRC met to determine if the proposed annexationand rezoningwere
consistent with the City’s regulations and policies. When the discussion was finished, the DRC
voted unanimously to recommend approval of the annexationand rezoningforthe Brown
Property.
STAFF RECOMMENDATION:
Based on the above analysis and the subsequent DRC recommendation, Staff recommends
that the Planning & Zoning Commission, acting as the Local Planning Agency, recommend
approval of theannexation and rezoning from “Orange County”R-1A(Single Family)to “City of
Ocoee”R-1A(Single Family)of the property known as the BrownProperty.

NOTICE IS HEREBY GIVEN,pursuant to Article I,Subsection 1-10(A)(1),of the
City of Ocoee Land Development Code,that on TUESDAY,AUGUST 11,2020,at

rezoning would be from Orange County R-IA"Single Family"to City of Ocoee R-lA
"Single Family Dwelling".The subject property is approximately 0.30 acres in size
and is located at 213 Bay Street
If the applicant's request for annexation is approved,the annexation would
incorporate the property into the City of Ocoee.Interested parties may appear at
the public hearing and be heard with respect to the proposed annexation.Pur-
suant to Subsection 5-9 B.of the Land Development Code,the Planning Direc-

The subject property is located on the north side of West Colonial Dr. (SR 50),on thesoutheast

facility will have two access points, one onWest Colonial Drive, and the other off Marshall

waiver requestsarefor the maximum building height, front building setback, minimum parking
space requirement,maximum pond side slope, and drive aisle width. The waiver to the building
height is to allowa maximumof six-storiesin lieu of the four-storiesrequired by codefor a
Community Commercial (C-2) zoning district, which would alsopromote a moreurbanized
development.To further promote that urban feel, the applicant is proposing a 20-foot front
building setback in lieu of the required 50-footsetback.This waiver request is intended for a
one-story restaurant separate to the hotel building, which is to be developed at a future date.
The hotel and restaurant will beofsingle ownership withjoint use parking. Because there are
varyingpeak parking demand times between a hotel and restaurant, the applicant is requesting
the 137 required parking spaces be reduced to 133 to take into consideration this single
ownership joint use ability.A waiver request to the pond side slopefrom a 5:1 to a 3:1 ratiois
due to the location’s dentention area being designed with steeper side slopes to minimize
impact to the adjacent wetland areas. Lastly due to the limited width of the parcel and the
wetlands to the north, a reduced drive isleon 22 feetis requested on just one row on the
parking, versus the required 24 feet.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
OnThursday,May 7,2020,the DRC met to determine if the proposed Preliminary/Final Large
Scale Site Planwasconsistent with the City’s regulations and policies. When the discussion
was finished, the DRC voted unanimously to recommend approval of the Preliminary/Final
Large Scale Site Plan, pending staff comments.
STAFF RECOMMENDATION:
Based on the recommendation of the DRC, Staff respectfully recommends that the Planning
and Zoning Commission recommend approval of the Preliminary/Final Large-Scale Site Planfor
Comfort Inn –Mainstay Suites.

Should the Planning and Zoning Commission (P&Z) acting as the Local Planning Agency (LPA)
recommend transmittal of proposed Large-Scale Comprehensive Plan Text Amendment CPA-
2020-002to the Public SchoolFacilities Element removing the requirement for a Capacity
Enhancement Agreements(CEA)?
BACKGROUND:
Public Schools Facilities Element Objective 1.3,of the City of OcoeeComprehensive Plan,
establishes that the Cityand Orange County Public Schools (OCPS) shall develop and maintain
throughout the planning period a joint process for the implementation of School Concurrency,as
provided for in the adopted interlocal agreement, adopted in 2008 and subsequently amended in
2010 (the “Interlocal Agreement”). Presently, any requested Comprehensive Plan amendment
and/or rezoning within the City that entails a proposed increase in residential density must
undergo a capacity review by OCPS. If there is insufficient capacity at an impacted elementary,
middle, and/or high school, the prospective developer and OCPS must enter into a Capacity
Enhancement Agreement (CEA). These agreements typically include provisions requiring the pre-
payment of impact fees, a timing mechanism, and payment of a “capital contribution”, in addition
to school impact fees.
House Bill 7103, signed into law on June 28, 2019, and effective as of July 1, 2019, now requires
a credit against school impact fees on a dollar-for-dollar basis for any such contribution. This
credit, in essence, means OCPS would not receive any additional monies to mitigate the impacts
of additional students generated by the increased residential density. As such, at the June 23,
2020, School Board meeting, OCPS issued a Declaration Relating to the HB 7103 Impact on
School Overcrowding Mitigation (the “Declaration”). That Declaration declares that OCPS will no
longer enter into CEAs, but will only certify whether school capacity exists. Therefore, any project
which was required to apply for a CEA on or after July 1, 2019, is on hold. Currently, there are a
total of 18 projects, countywide, and one (1) within the City of Ocoee (Ocoee Village Center) that
have been placed on hold since July 1, 2019.
To resolve the present impasse, stafffrom Orange County and other municipalities within Orange
Countyareproposing amendmentsto Public Schools Facilities Elementsto help rectify the
situation.

That policy currently prohibits the Cityfrom approving any developer-initiated Comprehensive
Plan amendment or rezoning that would increase residential density,for which OCPS has not
certified that school capacity exists or for which a CEA has not been executed. If the proposed
text amendment is approved, theamended policy will require Citystaff, in its review of any
developer-initiated Comprehensive Plan amendment or rezoning petition that would increase
residential density,to seek input from OCPS regarding the existence of sufficient school capacity
at the public schools that would serve the development. In cases in whichsufficient capacity is
not available in the affected school(s), OCPS would provide information to the Cityon the severity
of the overcrowding and the timing of the availability of the needed capacity to accommodate the
proposed development.
Since the CEA process has been removed, the City of Ocoee under a new processfor joint multi-
jurisdictional approval on projects that affect capacity of schools, will have the discretion to weigh
school overcrowding and timing of school capacity in its decision to approve or deny developer-
initiated Comprehensive Plan amendments or rezoningthat would increase residential density.
If adopted, this proposed amendment to Object 1.3, Policy 1.3.1,will provide for continued
cooperation between the Cityand OCPS to address the issues of school overcrowding while
allowing for the development of additional housing for Orange County’s growing residential
population.
