Code Enforcement Board
July 28,2020
I. CALL TO ORDER
Chairman Lowery called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers
of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida.
A. INVOCATION: Member Lewis initiated the moment of silence.
B. PLEDGE OF ALLEGIANCE: Member Mann led the Board in the Pledge of Allegiance to the U.S.flag.
C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared
a quorum (4) present.
PRESENT: Chair Lowery& Members: Odom, Lewis, Mirza, Bandur, & Mann.
Also present: Board Attorney Mary Sneed, Assistant Support Services Director Doug Gaines, Code
Enforcement Clerk Justin Mieras,and Code Enforcement Officers Diaz& Loeffler.
ABSENT: None.
D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code
Enforcement Officers and to anyone intending to speak regarding a case.
II. CONSENT AGENDA
ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT
BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS
DISCUSSION IS DESIRED BYA MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK
TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY.

III. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS
CASE NO 2019-01127
OFFICER LOEFFLER 1110 BELLINI LN DAO GIA
Violation Cited: §165-3.A.
Summary:
§165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property.
Observation:
§165-3.A.—Non-Operational, Partially Disassembled, Flat Tire, Fluid Leaking, Expired/No Tag Vehicle Front Drive Way.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of July 28, 2020, the
property is still in non-compliance.The City asked for Order of Compliance within 15 days or thereafter to be fined$25.00
per day, per violation until found in compliance.
Member Odom, seconded by Member Mirza, moved that Case in #2019-01127, the respondent be found in violation as
cited as of December 12, 2019, and be given until August 12, 2020, to come into compliance or be fined$25.00 per day,
per violation that remains in non-compliance. Motion carried unanimously.
CASE NO 2020-01282
OFFICER DIAZ 323 HORMIGAS ST RODRIGUEZ ELOY
Violation Cited: §165-3.A.
Summary:
§165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property.
Observation:
§165-3.A.—Junk Untagged/ Expired Tag/Inoperable Vehicle on the property.
Officer Diaz presented the case and gave its history. Officer Diaz further explained that as of July 28, 2020, the property
is still in non-compliance.The City asked for Order of Compliance within 15 days or thereafter to be fined$75.00 per day,
per violation until found in compliance.
Member Mann, seconded by Member Odom, moved that Case in #2020-01282, the respondent be found in violation as
cited as of April 29, 2020, and be given until August 12, 2020, to come into compliance or be fined$75.00 per day, per
violation that remains in non-compliance. Motion carried unanimously.
CASE NO 2020-01633
OFFICER LOEFFLER 1107 KIMBALL DR ROSADO JESUS
Violation Cited: §51-13., §108-22., §108-35., §108-23.E.(1)(2), &§108-23.L.
Summary:
§51-13.—It shall be a violation to do work related to construction without first obtaining a permit.
§108-22.—Every electrical outlet and fixture,all wiring and equipment shall be installed, maintained and connected to
a source of electric power in accordance with the provisions of the Florida Building Code.
§108-35.—When nuisance conditions or hazards degenerate or cumulatively impact on structures, dwellings or other
buildings regulated by the Minimum Standards Codes, to the extent that repair, removal, securing or demolition is
necessary for the public health, safety and welfare, then the Code Enforcement Board is authorized to order the
property owner or City agents to repair, remove, secure, vacate or demolish such structures according to procedures
outlined herein.
§108-23.E.(1)(2) — All portions, additions, or sections of a roof shall be complete and shall not display signs of
deterioration.
§108-23.L.—Every window sash shall be fully supplied with glass window panes or an approved substitute which are
without open cracks or holes.
Observation:
§51-13. — Un Permitted Not-To-Code Electric Service And Water Service Supplying Accessory Structure In Back Yard;
Including Additional Waste Plumbing To A Makeshift 2nd Septic System
§108-22.— Exterior Electric Service Panel, Mast, Weather-Head, Service, Face Plate All Loose, Damaged, Exposed Wiring,
Not-To-Code; Service Wire Exiting Mast Straight Into Cracked Crumbling Block. Exterior Service For A/C Unit In Same
Unsafe Condition.
§108-23.E.(1)(2)—Roof Not Weather/Water Tight Admitting Moisture Onto Interior Components Including Ceiling With
Active Leaking Into Pots During Rain. Rood Has No Ventilation Or Breathing Ability.
§108-23.L.—Windows And Related Components Loose Not Working Correctly
§108-35.—Occupancy Of An Accessory Structure (Shed) In The Rear Yard Not In Compliance With The Requirements Of
The Minimum Housing Standards And Creating A Nuisance Condition To The Occupants And The Surrounding Properties
Including Waste Discharge,Set-Back Encroachments Of Waste Plumbing Water Supply, Propane Tank.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of July 28, 2020, the
property is still in non-compliance.The City asked for Order of Compliance within 30 days or thereafter to be fined$25.00
per day, per violation until found in compliance.
Member Mirza, seconded by Member Lewis, moved that Case in #2020-01633, the respondent be found in violation as
cited as of July 15, 2020, and be given until August 12, 2020, to come into compliance or be fined$25.00 per day,'per
violation that remains in non-compliance. Motion carried unanimously.
IV.CASE RESOLUTION
CASE NO 2020-01248
OFFICER DIAZ 41 E ORLANDO AVE REZA ADELA SANCHEZ
Violation Cited: §168-6.C.&§168-6.B.(1)
Summary:
§168-6.C. —The parking of commercial vehicles; camping/travel trailers; hauling trailers; recreational vehicles (RV);
boats or camping vehicles on privately owned streets and public road rights-of-way or on any private property
which is zoned residential shall be prohibited.
§168-6.B.(1)—No owner, private property,shall consent to the parking or storing of vehicles on non-improved
surfaces of the property.
Observation:
§168-6.C.—Trailer parked in violation of City Ordinance.
§168-6.B.(1) — Multiple vehicles continuously parked on the grass. Off—Street Parking Violations. Vehicle(s) routinely
parked/stored in the front yard (or vehicles routinely parked/stored in the front easement).
Officer Loeffler explained that as of July 28, 2020, the property is still in non-compliance. The City asked for an Order
Imposing Fine.
Member Odom,seconded by Member Lewis,moved that Case in#2020-01248, the Board imposes fines as of July 01,2020,
as previously set by this Board. Motion carried unanimously.
CASE NO 2020-01369
OFFICER LOEFFLER 502 WURST RD SWIFT MICHAEL LEE ESTATE
Violation Cited: §108-24.D. & §143-27.A.
Summary:
§108-24.D.—It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice
box, refrigerator, stove, glass, building material, building rubbish or similar items. It shall be the duty every such
owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items.
§143-27.A.—At non-pickup times,garbage carts shall be placed in side yards or rear yards and screened from view to
the extent practicable. Except as provided herein,garbage carts shall at no time be placed in the front yard of the
premises.
Observation:
§108-24.D.—Misc Junk Debris Including Old Tarps On Fence, Furniture Appliances On Porch.
§143-27.A.—Waste/Garbage Cans Maintained In A Prohibited Location.
Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of June 23, 2020, the
property is in compliance. No further action requested.
CASE NO 2020-01399
OFFICER LOEFFLER 2008 LAUREN BETH AVE LANG DERRICK SCOTT
Violation Cited: §108-24.D.&§115-3.B.
Summary:
§108-24.D.—It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice
box, refrigerator, stove, glass, building material, building rubbish or similar items. It shall be the duty every such
owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items.
§115-3.B.—No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds,grass,
undergrowth or other dead or living plant life.
Observation:
§108-24.D.—Old Tires& Misc Junk Debris.
§115-3.B.— Tall Weeds And Grass.
Officer Loeffler explained that as of July 28, 2020, the property is still in non-compliance. The City asked for an Order
Imposing Fine.
Member Odom,seconded by Member Lewis,moved that Case in#2020-01399, the Board imposes fines as of July 08,2020,
as previously set by this Board. Motion carried unanimously.
CASE NO 2020-01457
OFFICER LOEFFLER 126 PARKER COVE CT M-FACILITY INC .
Violation Cited: §165-3.A.
Summary:
§165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property.
Observation:
§165-3.A.— Vehicle with No Tag/Expired Tag/Non-Operations Rear Side Yard.
Officer Loeffler explained that as of July 28, 2020, the property is still in non-compliance. The City asked for an Order
Imposing Fine.
Member Odom, seconded by Member Bandur, moved that Case in #2020-01457, the Board imposes fines as of July 08,
2020, as previously set by this Board. Motion carried unanimously.
CASE NO 2020-01495
OFFICER LOEFFLER 1703 LITTLE SPRING HILL DR TORRES CISNEROS
HERNANDO
Violation Cited: §51-13.
Summary:
§51-13.—It shall be a violation to do work related to construction without first obtaining a permit.
Observation:
§51-13.—Construction Without Permit(S)Shed/Accessory Structure, 6' Fence and Paver Driveway Extension.
Officer Loeffler explained that as of July 28, 2020, the property is still in non-compliance. The City asked for an Order
Imposing Fine.
Member Odom,seconded by Member Lewis,moved that Case in#2020-01495, the Board imposes fines as of July 08,2020,
as previously set by this Board. Motion carried unanimously.
CASE NO 2020-01569
OFFICER LOEFFLER 619 N LAKEWOOD AVE OCHOA SILVA BRENDA N
Violation Cited: §54-3., §115-3.A.(3), §143-27.A., &§165-3.A.
Summary:
§54-3.— All buildings shall have the assigned building number properly displayed, whether or not mail is delivered to
the building.
§115-3.A.(3).—No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public
health,safety and welfare.
§143-27.A.—At non-pickup times, garbage carts shall be placed in side yards or rear yards and screened from view to
the extent practicable. Except as provided herein, garbage carts shall at no time be placed in the front yard of the
premises.
§165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property.
Observation:
§54-3.— Building/Mail Box Missing Address Numbers.
§115-3.A.(3).—Property Littered with Beer Cans Paper Misc Trash Junk Debris.
§143-27.A.—City Issued Waste/Garbage Can Left In Prohibited Location Middle Of Front Yard.
§165-3.A. -Non-Operational Expired Tag/No Tag 4 Door Sedan On Side Of Property.
Officer Loeffler explained that as of July 28, 2020, the property is still in non-compliance. The City asked for an Order
Imposing Fine.
Member Mirza, seconded by Member Odom, moved that Case in #2020-01569, the Board imposes fines as of July 08,
2020, as previously set by this Board. Motion carried unanimously.
