A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,
CHANGING THE NAME OF BRUSHY CREEK COURT TO
SOUTH BLUFORD AVENUE; DIRECTING THE CITY
CLERK TO PROVIDE NOTICE OF THE CHANGE TO
CERTAIN PARTIES; PROVIDING FOR SEVERABILITY;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the name, "Brushy Creek Court," is the platted name of a segment
of that certain street in the City of Ocoee, Florida, located within the recorded plat of the West
End Professional Park subdivision, plat book 34, page 139; and
WHEREAS, the name, "South Bluford Avenue," is the name of the remaining
segments of the same street in the City of Ocoee, Florida; and
WHEREAS, the sole property owner (Heller Brothers Groves) adjacent to the
segment with the Brushy Creek Court name has requested that the name be changed to South
Bluford Avenue as an aid to finding addressed sites located on this segment; and
WHEREAS, there are currently no buildings or other addressed facilities on
Brushy Creek Court; and
WHEREAS, the Ocoee Land Development Code states that "new streets which
are an extension of or in alignment with existing streets shall bear the same name as that borne
by such existing streets;" and
WHEREAS, the City desires to assign the same street name to all segments that
form a continuous path of travel.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA,AS FOLLOWS:
Section 1. Authority. The City Commission of the City of Ocoee has the authority to
adopt this resolution pursuant to Article VIII of the Constitution of the State of Florida and
Chapter 166, Florida Statutes.
Section 2. Changing the name of Brushy Creek Court to South Bluford Avenue.
The approximately 270-foot street segment south of Old Winter Garden Road, presently named
as Brushy Creek Court, is hereby renamed and designated as "South Bluford Avenue," with
future addresses assigned to facilities on this street segment being numbered so as to continue the
system presently used for the balance of South Bluford Avenue.
Section 3. Further Acts; Notice. The City Commission of the City of Ocoee hereby
authorizes the Mayor, the City Clerk, and other city staff to execute any documents and take such
other actions as may be necessary to effectuate the designations referenced in Section 2, above.
Without limiting the forgoing, the City Clerk is hereby directed to provide notice of the adoption
of this resolution to all affected property owners, the United States Postal Service, Orange
County Property Appraiser's Office, Orange County Tax Collector's Office, Orange County
Emergency Services, and other relevant entities.
Section 4. Severability. If any section, subsection, sentence, clause, phrase or portion of
this resolution is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining portion hereto.
Section 5. Effective Date. This Resolution shall become effective immediately upon
passage and adoption.
