Background Summary:
The Engineering Design Services for the Commission approved Downtown Streets were awarded to
CPH, Inc., under RFQ #1705. In coordinating the concurrent design projects for West Oakland Avenue,
the Downtown Master.Stormwater Park, the new City Hall campus, Bill Breeze Park and East Oakland
Avenue, revisions were required to the designs while in progress. The revisions are divided into two (2)
Change Orders for the separate portions of Oakland Avenue in order to simplify the tracking of the
additional work.
Change Order No. 3, West Oakland.Ave., incorporates a baffle box design which eliminated the need
for a temporary pond site and any associated property acquisition. The baffle box will also provide
additional long-term stormwater treatment for drainage entering the Stormwater Park. The plans were
separated into two elements to allow the construction of the new City Hall project to proceed as
scheduled independent of the West Oakland streetscape improvements and the Stormwater Park.
Change Order No. 4, East Oakland Ave., incorporates revisions to allow the Lakewood and East
Oakland portions:to proceed to construction which will complete the southern improvements to Bill
Breeze park and provide the stormwater treatment,for the completed City Hall campus improvements.
McKey St. will be advertised for construction at a time concurrent with the. new City Hall site
improvements in order to have simultaneous completion dates. McKey St. will be the major
construction access point for the new City Hall.
Public Works negotiated the total fees for this work at $67,680.00. Public Works recommends approval
of the work with CPH, Inc.
Issue:
Request the City Commission to approve Change Order Nos. 3 & 4 for the Engineering Design Services
RFQ # 1705 with CPH, Inc.
Recommendations:
Recommend the City Commission approve Change Order Nos. 3 & 4 to the Engineering Design
Services for the Downtown Streets Redevelopment plan with CPH, Inc., under RFQ # 1705, for the total
not to exceed cost of $67,680.00 as funded in the Stormwater Division's Capital Outlay budget. Also
recommend the City Manager and staff be authorized to approve change orders to this contract up to.
the limit of his purchasing authority for each change order, and up to the budgeted amount for this
project for all change orders.

CHANGES ORDERED:
I. REQUIRED CHANGES
Roadway design for the portion of Oakland Avenue between Taylor Street to Bluford Avenue:
• Separation of the original W. Oakland Ave. set into two plan sets: one for the drainage improvements to
accommodate the future City Hall campus and for the remainder of the streetscape improvements.
• Redesign of the stoiniwater system to utilize a baffle box treatment system in place of a temporary pond.
• Redesign of the stormwater system to address Downtown Master Stormwater Park plan revisions and
City Hall campus.
• Additional permitting for the revised plan sets for West Oakland Ave.
II. JUSTIFICATION
In coordinating the concurrent design projects for West Oakland Ave, the Downtown Master Stormwater Park
and the new City Hall campus, revisions were required to the work covered under RFQ #1705 with CPH. The
addition of the baffle box design eliminated the need for a temporary pond site and any associated property
acquisition. The baffle box will also provide additional long-term stormwater treatment for drainage entering
the Stormwater Park. Separating the plans into two elements allows the construction of the new City Hall
project to proceed as scheduled independent of the West Oakland streetscape improvements and the Stormwater
Park.
III. NARRATIVE OF NEGOTIATIONS
Public Works negotiated with the Engineer to the amount submitted.
IV. PAYMENT
Funding for the work will be through the Stormwater Division's Capital Outlay budget.
V. APPROVAL AND CHANGE AUTHORIZATION
This proposed change to the Contract requires approval by the Ocoee City Commission or the City Manager,
dependent upon project approval authority, in order to supplement the project budget to fund the changes. It is
expressly understood and agreed that the approval of the Change Order shall have no effect on the original
contract other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments in
Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs
and modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No
other claim for increased costs of performance or modifications of time will be granted by the OWNER for the
Work covered by this Change Order. The CONTRACTOR hereby waives and releases any further claims for
cost or time against the OWNER arising from or relating to the matters or Work set forth or contemplated by
this Change Order.

FINAL DESIGN SCOPE OF SERVICES
Additional Services No. 2A
CPH understands the CITY is planning a number of improvements to the downtown area,
including the City Hall site, Bill Breeze Park improvements, the waterfront improvements, and
Stormwater Master Plan. Due to the nature of these improvements, the CITY has asked CPH to
prepare a scope for the following additional tasks:
TASK 1 — PROJECT ADMINISTRATION
CPH will provide general project management, including, but not limited to communication and
coordination with the CITY and their other consultants, preparing project billing, preparing
invoice report, and tracking project budget and schedule, and attend general project meetings.
Primarily this includes coordination with GAI, Inc. to maintain a cohesive design integration of
the proposed streetscape improvements with the Downtown Stormwater Master Pond design.
TASK 3—DESIGN SERVICES
3.1 —Roadway Design Services
CPH will prepare Plan Revisions for:
• Separation of the original W. Oakland Ave. set into two plans sets: one for the drainage
improvements only and one for the remainder of the streetscape improvements.
• Redesign of the stormwater system on W. Oakland Ave. to utilize a baffle box instead of
a temporary pond.
• Redesign of W. Oakland Ave. stormwater system to address Downtown Stormwater
Pond plan revisions and the City Hall outfall.
• Additional permitting for the revised plans sets for Oakland Avenue.
This work effort includes the separation of the W. Oakland Ave. plan set into two sets: one for
the drainage improvements only from Bluford Ave. to the existing culvert crossing beneath
Cumberland Ave and another set for the remainder of the improvements. This separation
requires re-work of the drainage system so that it will function with the existing outfall at the
Cumberland Ave. culvert crossing, as well as the proposed outfall in the Downtown Stormwater
Pond. Additional re-work was needed to remove the originally proposed temporary pond and
replace it with a baffle box in order to obtain the SJRWMD permit for the project so that it could
be constructed prior to the Downtown Stormwater Pond.
Based on the CITY's review of each submittal phase, CPH will address comments, and move
forward with preparing the subsequent submittal. If significant revisions to the plans are
requested resulting in the estimated Staff-Hours to be exceeded, requested revisions will be
addressed as additional services.
SERVICES NOT INCLUDED
The following services are not provided as part of this Scope of Services and will require an
amendment if requested:
1. Post Design Services
2. Construction Engineering and Inspection Services
3. Right-of-Way or Easement acquisition services
4. Permits or authorization not specifically mentioned in this Scope of Services
5. Any other issues not specifically described in this proposal
COMPENSATION
Labor
CONSULTANT will perform the Scope of Services contained in this Agreement as identified on
each task on a lump-sum basis, as identified in the corresponding task of the Scope of Services.
The following is the breakdown of fees for each task.

baffle box design coordination, and GAI coordination for Master Stormwater Pond

It is understood that fees for the subject project, including but not limited to, application fees,
impact fees, above ground utility relocation design fees, utility connection fees, review fees, etc.,
will be paid directly by the CITY.
CONSULTANT will submit invoices on a monthly basis to the CITY for payment. Lump Sum
tasks will be billed as percent complete. In addition to the labor compensation outlined above,
CPH shall be reimbursed directly for project specific expenditures such as, but not limited to
travel, printing and reprographics, meals, postage, and phone usage. Reimbursable expenses
will be billed at their actual cost, without increase.

Oakland Avenue.
This work includes the separation of the plans for McKey Street into two separate plan sets, as
described above. This separation requires re-work of both the proposed grading and drainage
systems at the intersection of McKey Street and Lakewood Ave., in order that the proposed
improvements on Lakewood Ave. would continue to function properly even if the McKey Street
improvements had not yet been built. Additional permitting will be required for the separate set
of plans as they will be advertised separately from the original project.
Based on the CITY's review of each submittal phase, CPH will address comments, and move
forward with preparing the subsequent submittal. If significant revisions to the plans are
requested resulting in the estimated Staff-Hours to be exceeded, requested revisions will be
addressed as additional services.
