BACKGROUND SUMMARY:
The First Reading of the Substantial Amendment to the PUD/LUP for Ocoee Village Center PUD was on July
21. 2020.
Parcel Identification Number(s): 05-22-28-0000-00-040, 05-22-28-0000-00-046, & 05-22-28-0000-00-004
Property Size: +/- 73.17 acres
The Ocoee Village Center PUD is located on the north side of Clarcona Ocoee Road and east of SR 429, South
of Clarcona Ocoee Road and east of N. Lakewood Ave., and east of the intersection of Fullers Cross Road and
N. Lakewood Avenue. The site is located within the SR 429 "Interchange Village Character Area."
The project received approval for rezoning to PUD and PUD Land Use plan on June 18, 2019. The original plan
included the development rights for a mixed-use community that will consist of 150,000 S.F. of Commercial,
196 Unit Townhomes and 316 Apartments units. The applicant is proposing a Substantial Amendment to the
Ocoee Village Center PUD in order to increase the townhome development from 196 Unit Townhomes to 232
units and the portion of the apartment from 316 units to 320 units.
ISSUE:
Should the Honorable Mayor and City Commissioners approve the Substantial Amendment to the Ocoee
Village Center PUD Land Use Plan (PUD/LUP), amending the apartment units from 316 to 320 and the
townhome units from 196 to 232?
DISCUSSION:
Since the project's previous approval, the applicant has .come to terms on contracts for the
commercial, townhomes, and apartment builder. The commercial is not proposing to change at this
time. However, due to fine-tuning of the building placement and type, additional units were created
that fit within the previous footprints shown on the plan. The increase in units above what was
previously approved requires an amendment to the PUD. The townhome builder and applicant have
also changed the layout of the townhome subdivision, which: i) created 36 more townhome units and
ii) provided additional public road access to the west. Both of these changes require amending the
PUD:
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
On February 10, 2020, the DRC met to determine if the proposed Substantial Amendment to the Ocoee Village
Center PUD/LUP was consistent with the City's regulations and intent for the character area. The Development
Review Committee voted unanimously to recommend approval of the Amendment to the Ocoee Village Center
PUD.
PLANNING AND ZONING RECOMMENDATION:
The Planning and Zoning Commission (P&Z) met on February 11, 2020, to determine if the proposed
Substantial Amendment to the Ocoee Village Center PUD/LUP was consistent with the City's regulations. The
Planning and Zoning Commission voted unanimously to recommend approval of the Amendment to the Ocoee
Village Center PUD.
RECOMMENDATIONS:
Staff recommends the Honorable Mayor and City Commissioners to approval the Substantial Amendment to the
Ocoee Village Center PUD Land Use Plan (PUD/LUP) amending the apartment units from 316 to 320 and the
townhome units from 196 to 232.

(Amendment to the Ocoee Village Center PUD)
AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA
APPROVING A SUBSTANTIAL AMENDMENT TO THE
LAND USE PLAN FOR OCOEE VILLAGE CENTER PUD
FOR CERTAIN REAL PROPERTY CONTAINING
APPROXIMATELY 73.17 ACRES LOCATED ON THE
NORTH AND SOUTH SIDES OF CLARCONA OCOEE
ROAD, EAST SIDE OF SR 429 EXPRESSWAY,
NORTHISOUTH AND EAST SIDES OF NORTH
LAKEWOOD AVENUE, AND AT THE EASTERN
TERMINUS OF FULLERS CROSS ROAD AND NORTH
LAKEWOOD AVENUE; FINDING CONSISTENCY WITH
THE OCOEE COMPREHENSIVE PLAN; REPEALING
INCONSISTENT ORDINANCES; PROVIDING FOR
SEVERABLY; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the owner of certain real property located within the corporate limits of the
City of Ocoee, Florida, as hereinafter described owner (the "Owner"), has submitted an application
to the City Commission of the City of Ocoee, Florida (the "Ocoee City Commission") to approve
an amendment (the "Amendment") to the Ocoee Village Center PUD, as approved by the Ocoee
City Commission on June 18, 2019 (the "PUD");
WHEREAS, the Amendment was scheduled for study and recommendation by the
Development Review Committee ("DRC") on February 10, 2020; and
WHEREAS, the DRC recommended approval of said Amendment; and
WHEREAS, the Amendment was scheduled for study and recommendation by the
Planning and Zoning Commission of the City of Ocoee ("P&Z") on February 11, 2020; and
WHEREAS, on February 11, 2020, the P&Z held an advertised public hearing on the
Amendment and, after discussion, recommended approval of the amendment; and
WHEREAS, on , 2020, the Ocoee City Commission has held an
advertised de novo public hearing with respect to the proposed Amendment and this Ordinance and
determined that the amendment to the PUD is consistent with the City of Ocoee Comprehensive
Plan, as amended; and
WHEREAS, this Ordinance has been considered by the Ocoee City Commission in
accordance with the procedures set forth in Section 166.041(3), Florida Statutes.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMAUSSION OF
THE CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. Authority. The City Commission of the City of Ocoee has the
authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida
and Chapter 166, Florida Statutes.
SECTION 2. Amendment to PUD. The Amendment to the PUD, as prepared by
Wohlfarth Consulting Group, LLC, Engineers and Planners, date stamped received by the City of
Ocoee on December 9, 2019, with such additional revisions thereto, if any, as may be reflected in
the minutes of the City Commission of the City of Ocoee meeting approving same, is hereby
approved, subject to the Conditions of Approval as first approved on February 10, 2020. The
Amendment to the PUD is attached hereto as Exhibit "A", and by this reference made a part
hereof. As described herein, the Amendment to the PUD amends the previously approved PUD for
Ocoee Village Center PUD, as indicated on said Amendment. All references to the PUD or the
Amended PUD for Ocoee Village Center PUD shall hereafter refer to the previously approved PUD
for Ocoee Village Center PUD as amended by the attached Amendment to the PUD.

SECTION 3. Ocoee Comprehensive Plan. The Ocoee City Commission
hereby finds that this Ordinance is consistent with the Ocoee Comprehensive Plan.
SECTION 4. Inconsistent Ordinances. All ordinances or parts of ordinances
in conflict or inconsistent herewith are repealed and rescinded as of the effective date of this
Ordinance.
SECTION 5. Severability. If any section, subsection, sentence, clause, phrase,
or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision
and such holding shall not affect the validity of the remaining portion hereto.
SECTION 6. Effective Date. This Ordinance shall become effective ten (10)
days after its passage and adoption.

NOTICE IS HFRF.RY GIVEN, pursuant to Article I, Section 1-10, Article IV, Sec-
tion 4-5, and Article V, Section 5-9, of the City of Ocoee Land Development Code,
that on TUESDAY, OCTOBER 6, 2020, AT 6:15 P.M. or as soon thereafter as
practical, the OCOEE CITY COMMISSION will hold a PUBLIC HEARING at
the City of Ocoee Commission Chambers, 150 North Lakeshore Drive, Ocoee, Flor-
ida, to consider the Substantial Amendment to the PUD for Ocoee Village Center.
The property consists of three (3) parcels identified as parcel number(s) 05-22-28-
0000-00-040, 05-22-28-0000-00-046, & 05-22-28-0000-00-004. The subject
property is approximately 73.17 acres in size. The applicant is requesting a major
modification to the PUD increasing the approved units of Townhomes from 196 to
232 Townhomes Units, and increasing the number of units of Apartments from 316
units to 320 units.

ERTY CONTAINING APPROXIMATELY 73.17 ACRES LOCATED
ON THE NORTH AND SOUTH SIDES OF CLARCONA OCOEE
ROAD, EAST SIDE OF SR 429 EXPRESSWAY, NORTH/SOUTH
AND EAST SIDES OF NORTH LAKEWOOD AVENUE, AND AT THE
EASTERN TERMINUS OF FULLERS ERR CROSS ROAD AND NORTH
LAKEWOOD AVENUE; FINDING CONSISTENCY WITH THE
OCOEE COMPREHENSIVE PLAN; REPEALING INCONSISTENT
ORDINANCES; PROVIDING FOR SEVERABLY; PROVIDING AN
EFFECTIVE DATE.

the meeting. City Hall is closed to the public and is subject to change based on the
Governor's Executive Order. This meeting is broadcasted live on Spectrum Chan-
